  1  1    Amend Senate File 2265, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  Page 1, by inserting before line 1 the
  1  4 following:
  1  5    "Section 1.  Section 598.7A, Code Supplement 1995,
  1  6 is amended to read as follows:
  1  7    598.7A  DISSOLUTION OF MARRIAGE DOMESTIC RELATIONS
  1  8 PROCEEDING – MEDIATION.
  1  9    In addition to the custody mediation provided
  1 10 pursuant to section 598.41, unless the court
  1 11 determines that a history of domestic abuse exists as
  1 12 specified in section 598.41, subsection 3, paragraph
  1 13 "j", or unless the court determines that direct
  1 14 physical harm or significant emotional harm to the
  1 15 child, other children, or a parent is likely to
  1 16 result, or unless the action involves a child support
  1 17 or medical support obligation enforced by the child
  1 18 support recovery unit, on the application of either
  1 19 party, or on the court's own motion, the court may
  1 20 require shall determine in each domestic relations
  1 21 proceeding or modification of any order relating to
  1 22 those proceedings whether the parties to the
  1 23 proceeding shall participate in mediation to attempt
  1 24 to resolve differences between the parties relative to
  1 25 the granting of a marriage dissolution decree, if the
  1 26 court determines that mediation may effectuate a
  1 27 resolution of the differences without court
  1 28 intervention.  The court may order participation in
  1 29 mediation at any time prior to the entering of a final
  1 30 order or the granting of a final decree.
  1 31    The costs of mediation shall be paid in full or in
  1 32 part by the parties, as determined by the court and
  1 33 taxed as court costs."
  1 34    #2.  Page 1, line 1, by striking the word and
  1 35 figure "Section 1." and inserting the following:
  1 36 "Sec. 2."
  1 37    #3.  Page 1, by striking lines 3 through 13 and
  1 38 inserting the following:
  1 39    "1.  The parties to a dissolution of marriage,
  1 40 modification of an order entered relating to a
  1 41 dissolution of marriage or any action which involves
  1 42 the issues of child custody or visitation shall
  1 43 participate in a court-approved course to educate and
  1 44 sensitize the parties to the needs of any child or
  1 45 party during and subsequent to the proceeding within
  1 46 forty-five days of the service of notice and petition
  1 47 for dissolution of marriage or other action or within
  1 48 forty-five days of the service of notice and
  1 49 application for modification of an order.
  1 50 Participation in the course may be waived or delayed
  2  1 by the court for good cause including, but not limited
  2  2 to, a default by any of the parties.  Participation in
  2  3 the course is not required if the proceeding involves
  2  4 termination of parental rights of any of the parties.
  2  5 A final decree shall not be granted or a final order
  2  6 shall not be entered until the parties have complied
  2  7 with this section."
  2  8    #4.  Page 1, by inserting after line 29 the
  2  9 following:
  2 10    "5.  In addition to the provisions of this section
  2 11 relating to the required participation in a court-
  2 12 approved course by the parties to an action as
  2 13 described in subsection 1, the court may require age-
  2 14 appropriate counseling for children who are involved
  2 15 in a dissolution of marriage action.  The counseling
  2 16 may be provided by a public or private entity approved
  2 17 by the court.  The costs of the counseling shall be
  2 18 taxed as court costs."
  2 19    #5.  Page 1, line 30, by striking the word "This"
  2 20 and inserting the following:  "Section 2 of this".
  2 21    #6.  Title page, line 1, by inserting after the
  2 22 word "to" the following:  "domestic relations
  2 23 including".
  2 24    #7.  By renumbering as necessary.
