  1  1    Amend Senate File 2470, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  Page 30, by inserting after line 18 the
  1  4 following:
  1  5    "Sec.    .  NEW SECTION.  28E.41  EMERGENCY
  1  6 SERVICES – CONTRACTS FOR MUTUAL AID.
  1  7    1.  A city fire department, benefited fire
  1  8 district, or township fire department may enter into
  1  9 contracts providing for mutual aid regarding emergency
  1 10 services provided by such department or district.  The
  1 11 contracts that are agreed upon may provide for
  1 12 compensation from the parties and other terms that are
  1 13 agreeable to the parties and may be for an indefinite
  1 14 period as long as they include a sixty-day
  1 15 cancellation notice by any party.  The contracts
  1 16 agreed upon shall not be entered into for the purpose
  1 17 of reducing the number of employees of any party.
  1 18    2.  A city fire department, benefited fire
  1 19 district, or township fire department may provide
  1 20 assistance to any other such department or district in
  1 21 the state at the time of a significant emergency such
  1 22 as a fire, earthquake, flood, tornado, hazardous
  1 23 material incident, or other such disaster.  The chief
  1 24 or highest ranking fire officer of an assisting
  1 25 department or district may render aid to a requesting
  1 26 department or district as long as the chief or officer
  1 27 is acting in accordance with the policies and
  1 28 procedures set forth by the governing board of the
  1 29 assisting department or district.
  1 30    3.  The chief or highest ranking officer of the
  1 31 city fire department, benefited fire district, or
  1 32 township fire department of the district within which
  1 33 the incident occurs shall maintain control of the
  1 34 incident in accordance with the provisions of chapter
  1 35 102.  The chief or highest ranking officer of the
  1 36 department or district giving mutual aid shall be in
  1 37 charge of the assisting departmental or district
  1 38 personnel."
  1 39    #2.  Page 35, by inserting after line 32 the
  1 40 following:
  1 41    "Sec.    .  Section 613.17, Code 1995, is amended
  1 42 to read as follows:
  1 43    613.17  EMERGENCY ASSISTANCE IN AN ACCIDENT.
  1 44    A person, who in good faith renders emergency care
  1 45 or assistance without compensation, shall not be
  1 46 liable for any civil damages for acts or omissions
  1 47 occurring at the place of an emergency or accident or
  1 48 while the person is in transit to or from the
  1 49 emergency or accident or while the person is at or
  1 50 being moved to or from an emergency shelter unless
  2  1 such acts or omissions constitute recklessness.  For
  2  2 purposes of this section, if a volunteer fire fighter,
  2  3 a volunteer operator or attendant of an ambulance or
  2  4 rescue squad service, a volunteer paramedic, a
  2  5 volunteer emergency medical technician, or a volunteer
  2  6 registered member of the national ski patrol system
  2  7 receives nominal compensation not based upon the value
  2  8 of the services performed, that person shall be
  2  9 considered to be receiving no compensation.  The
  2 10 operation of a motor vehicle in compliance with
  2 11 section 321.231 by a volunteer fire fighter, volunteer
  2 12 operator, or attendant of an ambulance or rescue squad
  2 13 service, a volunteer paramedic, or volunteer emergency
  2 14 medical technician shall be considered rendering
  2 15 emergency care or assistance for purposes of this
  2 16 section.  For purposes of this section, a person
  2 17 rendering emergency care or assistance includes a
  2 18 person involved in a workplace rescue arising out of
  2 19 an emergency or accident."
