1 1 Amend House File 2447 as follows:
1 2 #1. By striking everything after the enacting
1 3 clause and inserting the following:
1 4 "Sec. . Section 476.6, subsection 19, paragraph
1 5 d, Code 1995, is amended by striking the paragraph and
1 6 inserting in lieu thereof the following:
1 7 d. A gas or electric rate-regulated public utility
1 8 may recover, through an automatic adjustment mechanism
1 9 filed pursuant to subsection 11, over a period not to
1 10 exceed the term of the plan, the costs of an energy
1 11 efficiency plan approved by the board in a contested
1 12 case proceeding conducted pursuant to paragraph "a".
1 13 The board shall periodically conduct a contested case
1 14 proceeding to evaluate the reasonableness and prudence
1 15 of the utility's implementation of an approved energy
1 16 efficiency plan and budget. If a utility is not
1 17 taking all reasonable actions to cost-effectively
1 18 implement an approved energy efficiency plan, the
1 19 board shall not allow the utility to recover from
1 20 customers costs in excess of those costs that would be
1 21 incurred under reasonable and prudent implementation
1 22 and shall not allow the utility to recover future
1 23 costs at a level other than what the board determines
1 24 to be reasonable and prudent. If the result of a
1 25 contested case proceeding is a judgment against a
1 26 utility, that utility's future level of cost recovery
1 27 shall be reduced by the amount by which the programs
1 28 were found to be imprudently conducted. The utility
1 29 shall not represent energy efficiency in customer
1 30 billings as a separate cost or expense unless the
1 31 board otherwise approves."

1 34 recovery of certain utility costs."
