  1  1    Amend the Senate amendment, H-5589, to House File
  1  2 2416, as passed by the House, as follows:
  1  3    #1.  Page 16, by inserting before line 47 the
  1  4 following:
  1  5    "Sec. 101.  DEFINITIONS.  As used in sections 101
  1  6 through 104, unless the context otherwise requires:
  1  7    1.  "Extension service" means the Iowa cooperative
  1  8 extension service in agriculture and home economics at
  1  9 Iowa state university of science and technology.
  1 10    2.  "Director" means the study director appointed
  1 11 by the director of the extension service.
  1 12    Sec. 102.  EXTENSION SERVICE STUDY – STUDY
  1 13 COMPLETION.
  1 14    1.  The lottery commissioner shall contract with
  1 15 the director of the extension service to conduct a
  1 16 comprehensive study of gambling in the state.
  1 17 Pursuant to the contract, the extension service shall
  1 18 conduct a comprehensive legal and factual study of
  1 19 gambling in this state and existing policies and
  1 20 practices with respect to the legalization or
  1 21 prohibition of gambling activities and formulate and
  1 22 propose changes in those policies and practices as the
  1 23 extension service deems appropriate.  The extension
  1 24 service may seek the cooperation of other states and
  1 25 tribal councils in obtaining information regarding
  1 26 gambling activities within those jurisdictions.
  1 27    2.  The study shall include, but is not limited to,
  1 28 the following matters:
  1 29    a.  The economic impact of gambling on the state of
  1 30 Iowa, political subdivisions of this state, and native
  1 31 American tribes conducting gambling activities in this
  1 32 state.
  1 33    b.  The economic impact of gambling on other
  1 34 businesses.
  1 35    c.  An assessment and review of the political
  1 36 contributions and influences of gambling businesses
  1 37 and promoters on the development of public policy
  1 38 regulating gambling.
  1 39    d.  An assessment of the relationship between
  1 40 gambling and crime.
  1 41    e.  An assessment of the impact of pathological or
  1 42 problem gambling on individuals, families, social
  1 43 institutions, criminal activity, and the economy.
  1 44    f.  A review of the demographics of gamblers.
  1 45    g.  A review of the effectiveness of existing
  1 46 practices in law enforcement, judicial administration,
  1 47 and corrections to combat and deter illegal gambling
  1 48 and illegal activities related to gambling.
  1 49    h.  A review of the costs and effectiveness of
  1 50 state and federal gambling regulatory policy.
  2  1    i.  Other relevant issues and topics as considered
  2  2 appropriate by the extension service.
  2  3    3.  The extension service shall complete its study
  2  4 and submit its final report to the governor and the
  2  5 general assembly not later than January 31, 1998.  The
  2  6 final report shall contain a detailed statement of the
  2  7 findings and conclusions of the extension service with
  2  8 its recommendations for legislation and administrative
  2  9 actions as the extension service deems appropriate.
  2 10    Sec. 103.  POWERS OF THE DIRECTOR.
  2 11    1.  The director may hold hearings, administer
  2 12 oaths, take testimony, receive evidence, and require
  2 13 by subpoena the attendance and testimony of witnesses
  2 14 and the production of materials as the director
  2 15 considers advisable to carry out the purposes of
  2 16 sections 101 through 104.
  2 17    A subpoena of the extension service shall be served
  2 18 in the manner provided for a subpoena issued by a
  2 19 district court under the Iowa rules of civil
  2 20 procedure.  A subpoena may be served anywhere in the
  2 21 judicial district in which the person required to be
  2 22 served resides or may be found.  A subpoena shall
  2 23 state the time and place a person is required to
  2 24 appear, be signed by the director, and be attested to
  2 25 by the director of the extension service.
  2 26    2.  Upon request of the director, the head of any
  2 27 state agency shall furnish the director with the
  2 28 information considered necessary by the director to
  2 29 carry out the provisions of sections 101 through 104.
  2 30    3.  The director of the extension service shall
  2 31 appoint and terminate the employment of a director of
  2 32 the study and any additional personnel as may be
  2 33 necessary to carry out the study.
  2 34    Sec. 104.  STUDY APPROPRIATION.
  2 35    1.  There is appropriated from the general fund of
  2 36 the state to the department of revenue and finance the
  2 37 sum of $50,000, or so much thereof as is necessary, to
  2 38 fund a comprehensive factual and legal study of
  2 39 gambling in this state to be conducted by the Iowa
  2 40 cooperative extension service in agriculture and home
  2 41 economics as provided in section 101 through 104.
  2 42    2.  Notwithstanding section 8.33, all unobligated
  2 43 and unencumbered moneys remaining on January 31, 1998,
  2 44 from the appropriation made in subsection 1, shall
  2 45 revert to the general fund of the state on April 1,
  2 46 1998.
  2 47    Sec. 105.  EFFECTIVE DATE.  This section and
  2 48 sections 101 through 104, being deemed of immediate
  2 49 importance, take effect upon enactment."
