  1  1    Amend the amendment, H-5482, to Senate File 2446,
  1  2 as amended, passed, and reprinted by the Senate, as
  1  3 follows:
  1  4    #1.  Page 7, by inserting after line 38 the
  1  5 following:
  1  6    "c.  CONDITION OF APPROPRIATION.  The amount
  1  7 appropriated pursuant to this subsection shall be
  1  8 conditional upon the division adopting by rule, which
  1  9 shall become effective December 31, 1996, requirements
  1 10 relating to the disposal of manure in close proximity
  1 11 to a designated area.  The rules shall prohibit a
  1 12 person disposing of manure on cropland within two
  1 13 hundred feet from a designated area, as defined in
  1 14 section 159.27, Code Supplement 1995."
  1 15    #2.  Page 15, by inserting before line 20 the
  1 16 following:
  1 17    "Sec.    .  Section 455B.201, subsection 2, Code
  1 18 Supplement 1995, is amended to read as follows:
  1 19    2.  Manure from an animal feeding operation shall
  1 20 be disposed of in a manner which will not cause
  1 21 surface water or groundwater pollution.  Disposal in
  1 22 accordance with the provisions of state law, including
  1 23 this chapter, rules adopted pursuant to the provisions
  1 24 of state law, including this chapter, and guidelines
  1 25 adopted pursuant to this chapter, and section 159.27,
  1 26 shall be deemed as compliance with this requirement.
  1 27    Sec.    .  Section 455B.204, subsection 2, Code
  1 28 Supplement 1995, is amended by striking the
  1 29 subsection.
  1 30    Sec.    .  REPEAL.
  1 31    1.  Section 159.27, Code Supplement 1995, is
  1 32 repealed.
  1 33    2.  This section takes effect December 31, 1996."
  1 34    #3.  By renumbering as necessary.
