1 1 Amend the amendment, H-5174, to House File 2087, as
1 2 follows:
1 3 #1. Page 4, by inserting after line 31 the
1 4 following:
1 5 "7. ELECTRIC UTILITY PRODUCED ALTERNATIVE ENERGY.
1 6 An electric utility may produce its own alternate
1 7 energy by constructing and operating an alternate
1 8 energy production facility or small hydro facility.
1 9 However, the electric utility shall participate in the
1 10 competitive bidding process using a third-party
1 11 evaluator. A bid from an electric utility producing
1 12 its own alternate energy shall not take into account
1 13 regulated industry-based factors in order to produce a
1 14 lower cost bid. Regulated industry-based factors
1 15 include eminent domain and transmission ownership. An
1 16 electric utility may combine with one or more electric
1 17 utilities to construct and operate an alternate energy
1 18 production facility or small hydro facility for
1 19 purposes of this subsection."
