PAG LIN 1 1 Amend Senate File 2140, as amended, passed, and 1 2 reprinted by the Senate, as follows: 1 3 #1. By striking everything after the enacting 1 4 clause and inserting the following: 1 5 "Section 1. Section 321.210, subsection 2, 1 6 paragraph d, Code 1995, is amended to read as follows: 1 7 d. The first two speeding violations within any 1 8 twelve-month period of ten miles per hour or less over 1 9 the legal speed limit in speed zones having a legal 1 10 speed limitbetween thirty-fourequal to or greater 1 11 than thirty-five miles per hourand fifty-six miles1 12per hour. 1 13 Sec. 2. Section 321.285, subsection 6, unnumbered 1 14 paragraph 1, Code 1995, is amended to read as follows: 1 15 Notwithstanding any other speed restrictions, the 1 16 speed limit forallvehicular traffic onfully1 17controlled-access,divided, multilaned highways 1 18including the national system of interstate highways1 19designated by the federal highway administration and1 20this state (23 U.S.C. } 103 (e))is sixty-five miles 1 21 per hour. The speed limit for vehicular traffic on 1 22 the national system of interstate highways and on 1 23 fully controlled-access, divided, multilaned highways 1 24 is seventy miles per hour. However, the department or 1 25citiespolitical subdivisions with the approval of the 1 26 department may establish a lower speed limitupon such1 27 for highways located within thecorporate limits of a1 28cityjurisdiction of the political subdivision. For 1 29 the purposes of this subsection, a fully controlled- 1 30 access highway is a highway that gives preference to 1 31 through traffic by providing access connections with 1 32 selected public roads only and by prohibiting 1 33 crossings at grade or direct private driveway 1 34 connections. A minimum speed of forty miles per hour, 1 35 road conditions permitting, is established on the 1 36 highways referred to in this subsection. 1 37 Sec. 3. Section 321A.3, subsection 4, Code 1995, 1 38 is amended to read as follows: 1 39 4. The abstract of operating recordprovided under1 40this section shall designate which speeding violations1 41occurring on or after July 1, 1986, but before May 12,1 421987, are for violations of ten miles per hour or less1 43over the legal speed limit in speed zones that have a1 44legal speed limit greater than thirty-five miles per1 45hour. For speeding violations occurring on or after1 46May 12, 1987, the abstract providedunder this section 1 47 shall designate which speeding violations are for ten 1 48 miles per hour or less over the legal speed limit in 1 49 speed zones that have a legal speed limit equal to or 1 50 greater than thirty-five miles per hourbut not2 1greater than fifty-five miles per hour. 2 2 Sec. 4. Section 516B.3, subsection 1, Code 1995, 2 3 is amended to read as follows: 2 4 1. The commissioner shall require that insurance 2 5 companies transacting business in this state not 2 6 consider speeding violationsoccurring on or after2 7July 1, 1986, but before May 12, 1987, which are for2 8speeding violations for ten miles per hour or less2 9over the legal speed limit in speed zones that have a2 10legal speed limit greater than thirty-five miles per2 11hour or speeding violations occurring on or after May2 1212, 1987, which are for speeding violationsfor ten 2 13 miles per hour or less over the legal speed limit in 2 14 speed zones that have a legal speed limit equal to or 2 15 greater than thirty-five miles per hourbut not2 16greater than fifty-five miles per hourfor the purpose 2 17 of establishing rates for motor vehicle insurance 2 18 charged by the insurer and shall require that 2 19 insurance companies not cancel or refuse to renew any 2 20 such policy for such violations. In any twelve-month 2 21 period, this section applies only to the first two 2 22 such violations which occur. 2 23 Sec. 5. Section 805.8, subsection 2, paragraph g, 2 24 subparagraph (4), Code Supplement 1995, is amended to 2 25 read as follows: 2 26 (4) Notwithstanding subparagraphs (1) and (3), for 2 27 excessive speed violations in speed zones greater than 2 28 fifty-five miles per hour when in excess of the limit 2 29 by five miles per hour or less the fine is ten 2 30 dollars, by more than five and not more than ten miles 2 31 per hour the fine is twenty dollars, by more than ten 2 32 and not more than fifteen miles per hour the fine is 2 33fortyeighty dollars, by more than fifteen and not 2 34 more than twenty miles per hour the fine issixtyone 2 35 hundred twenty dollars, and by more than twenty miles 2 36 per hour the fine issixtyone hundred twenty dollars 2 37 plus two dollars for each mile per hour of excessive 2 38 speed over twenty miles per hour over the limit. 2 39 Sec. 6. CONSTRUCTION AREA SAFETY STUDY. The state 2 40 department of transportation and the department of 2 41 public safety shall study and prepare a joint report 2 42 relating to vehicle speed management, enhanced speed 2 43 limit enforcement, and work zone safety in 2 44 construction areas. The departments shall confer with 2 45 representatives of the private sector construction 2 46 industry to develop guidelines to promote motorist and 2 47 construction worker safety. The departments shall 2 48 file the joint report with the general assembly by 2 49 January 1, 1997. 2 50 Sec. 7. EFFECTIVE DATE. This Act, being deemed of 3 1 immediate importance, takes effect upon enactment." 3 2 #2.
