  1  1    Amend House File 2447 as follows:
  1  2    #1.  Page 5, by inserting after line 31 the
  1  3 following:
  1  4    "Sec.    .  Section 476.78, Code 1995, is amended
  1  5 to read as follows:
  1  6    476.78  CROSS-SUBSIDIZATION PROHIBITED.
  1  7    A rate-regulated gas or electric public utility
  1  8 shall not directly or indirectly include any costs or
  1  9 expenses attributable to providing nonutility service
  1 10 in regulated rates or charges.  Except for current
  1 11 terms of existing contractual obligations as exempted
  1 12 by the board, the utility or its affiliates shall not,
  1 13 in providing nonutility services, in any manner use
  1 14 the utility's name or logo, or any property,
  1 15 equipment, or facilities included as part of the
  1 16 utility's rate base, or any employees, other than
  1 17 corporate officers, including those of the utility's
  1 18 affiliates, whose salaries or benefits or both are
  1 19 included to any extent as expenses recoverable in a
  1 20 rate case proceeding, unless the utility is providing
  1 21 a nonutility service in a community that does not have
  1 22 adequate provision of nonutility services.  The board
  1 23 shall adopt rules to determine whether a community has
  1 24 adequate provision of nonutility services."
  1 25    #2.  Title page, line 2, by inserting after the
  1 26 word "mandates" the following:  "and cross-
  1 27 subsidization".
  1 28    #3.  By renumbering as necessary.
