  1  1    Amend House File 2477 as follows:
  1  2    #1.  Page 3, by inserting after line 4 the
  1  3 following:
  1  4    "   .  NATIONAL GUARD TUITION AID PROGRAM
  1  5    For tuition aid for Iowa national guard members as
  1  6 provided in section 261.21:  
  1  7 .................................................. $    150,000
  1  8    For the fiscal year beginning July 1, 1996, and
  1  9 ending June 30, 1997, not more than 300 approved
  1 10 claims shall be paid by the college student aid
  1 11 commission under section 261.21, and the total amount
  1 12 paid shall not average more than $800 per claim."
  1 13    #2.  Page 32, by inserting after line 16 the
  1 14 following:
  1 15    "Sec.    .  NEW SECTION.  261.21  NATIONAL GUARD
  1 16 TUITION AID PROGRAM.
  1 17    1.  Subject to an appropriation of sufficient funds
  1 18 by the general assembly, a member of the national
  1 19 guard who meets the eligibility requirements of this
  1 20 subsection is entitled to attend and pursue any
  1 21 undergraduate course of study at a community college
  1 22 as defined in chapter 260C, or an institution of
  1 23 higher learning under the control of the state board
  1 24 of regents upon the payment by the member personally
  1 25 of fifty percent of the tuition charged by the
  1 26 community college or institution of higher learning.
  1 27 The remaining tuition shall be paid by the college
  1 28 student aid commission from funds appropriated to the
  1 29 commission in subsection 4.  To be eligible for
  1 30 tuition aid under this section, a national guard
  1 31 member shall meet the following conditions:
  1 32    a.  Be a resident of the state and a member of an
  1 33 Iowa army or air national guard unit throughout each
  1 34 semester or duration of the vocational program for
  1 35 which the member has applied for benefits.
  1 36    b.  Have satisfactorily completed required initial
  1 37 active duty training.
  1 38    c.  Have maintained satisfactory performance of
  1 39 duty upon return from initial active duty training,
  1 40 including attending a minimum ninety percent of
  1 41 scheduled drill dates and attending annual training.
  1 42    d.  Have satisfactorily met the entrance
  1 43 requirements for admission to a community college, or
  1 44 institution of higher learning under the control of
  1 45 the state board of regents, and maintain satisfactory
  1 46 academic progress.
  1 47    e.  Have provided proper notice of national guard
  1 48 status to the community college or institution at the
  1 49 time of registration for the term in which tuition
  1 50 benefits are sought.
  2  1    f.  Apply to the adjutant general of Iowa, who
  2  2 shall determine eligibility and whose decision is
  2  3 final.
  2  4    2.  Participation in the tuition aid program by an
  2  5 accredited private institution, as defined in section
  2  6 261.9, is voluntary.  Subject to an appropriation of
  2  7 sufficient funds by the general assembly, a member of
  2  8 the Iowa national guard who meets the eligibility
  2  9 requirements of subsection 1 is entitled to attend and
  2 10 pursue any undergraduate course of study at any
  2 11 participating accredited private institution, as
  2 12 defined in section 261.9, upon payment of tuition less
  2 13 an amount equal to fifty percent of the resident
  2 14 tuition rate established for institutions of higher
  2 15 learning under the control of the state board of
  2 16 regents.  The remaining tuition, not to exceed fifty
  2 17 percent of the resident tuition rate for a regents
  2 18 university, shall be paid by the college student aid
  2 19 commission from funds appropriated to the commission
  2 20 in subsection 4.
  2 21    3.  An eligible member of the national guard,
  2 22 attending an educational institution as a full-time
  2 23 student, shall not receive tuition aid under this
  2 24 section for more than eight semesters, or if attending
  2 25 as a part-time student, not more than sixteen
  2 26 semesters of undergraduate study, or the trimester or
  2 27 quarter equivalent.  A guard member who has met the
  2 28 educational requirements for a baccalaureate degree is
  2 29 ineligible for tuition aid under this section.
  2 30    4.  For the fiscal year beginning July 1, 1997, and
  2 31 for each succeeding year, there is appropriated from
  2 32 the general fund of the state an amount sufficient to
  2 33 pay the approved claims of educational institutions
  2 34 for tuition aid to eligible members of the national
  2 35 guard who received assistance under this section in
  2 36 the previous year and who continue to meet the
  2 37 eligibility requirements of this section, and for not
  2 38 more than three hundred new eligible Iowa national
  2 39 guard members as provided in this section with the
  2 40 total amount paid not exceeding an average of eight
  2 41 hundred dollars per approved claim, per fiscal year.
  2 42 However, not more than fifteen hundred claims shall be
  2 43 paid in accordance with this section in any fiscal
  2 44 year.  The eligibility of applicants shall be
  2 45 certified by the adjutant general of Iowa to the
  2 46 college student aid commission, and all amounts that
  2 47 are or become due to a community college, accredited
  2 48 private institution, or institution of higher learning
  2 49 under the control of the state board of regents under
  2 50 this section shall be paid to the college or
  3  1 institution by the college student aid commission upon
  3  2 receipt of certification by the president or governing
  3  3 board of the educational institution as to accuracy of
  3  4 charges made, and as to the attendance of the
  3  5 individual at the educational institution.  The
  3  6 college student aid commission shall maintain an
  3  7 annual record of the number of participants and the
  3  8 tuition dollar value of the participation.
  3  9    5.  The college student aid commission shall adopt
  3 10 rules pursuant to chapter 17A to administer this
  3 11 section."
