1 1 Amend the amendment, H-5102, to House File 2298 as
1 2 follows:
1 3 #1. Page 1, by striking lines 2 and 3 and
1 4 inserting the following:
1 5 "# . Page 1, line 5, by striking the word
1 6 "shall" and inserting the following: "may".
1 7 # . Page 1, line 9, by striking the words "shall
1 8 not" and inserting the following: "may".
1 9 # . Page 1, lines 31 and 32, by striking the
1 10 words "adopt rules as necessary to administer this
1 11 paragraph" and inserting the following: "conduct a
1 12 study for each managed care plan in order to determine
1 13 if it is capable of serving appropriately the needs of
1 14 the subscriber population in the service area".
1 15 # . Page 1, by inserting after line 32 the
1 16 following:
1 17 "A plan shall not be implemented until completion
1 18 of the study of the needs of the subscriber population
1 19 in the service area. Following completion of a study,
1 20 the commissioner of insurance shall hold a public
1 21 hearing for the purpose of allowing commentary by the
1 22 public on the plan. Following the hearing, the
1 23 commissioner of insurance shall issue an order
1 24 regarding the capability of each plan to serve the
1 25 needs of the service area including the proper
1 26 concentration and number of providers who shall be a
1 27 part of the plan. The order shall be issued not more
1 28 than two weeks following the hearing."
1 29 # . Page 2, by inserting after line 7 the
1 30 following:
1 31 "Sec. . There is appropriated to the insurance
1 32 division of the department of commerce for the fiscal
1 33 year beginning July 1, 1996, and ending June 30, 1997,
1 34 the following amount, or so much thereof as may be
1 35 necessary, for the purpose of carrying out the studies
1 36 and public hearings as provided for in section
1 37 514C.11:
1 38 .................................................. $ 500,000".
1 39 # . Title page, line 3, by inserting after the
1 40 word "physicians" the following: "and making an
1 41 appropriation"."
