PAG LIN 1 1 Amend House File 2416 as follows: 1 2 #1. Page 24, by inserting after line 15 the 1 3 following: 1 4 "Sec. . Section 453A.6, subsection 1, Code 1 5 1995, is amended to read as follows: 1 6 1. There is imposed, and shall be collected and 1 7 paid to the department,the following taxeson all 1 8 cigarettes used or otherwise disposed of in this state 1 9 for any purpose whatsoever:a tax at the rate of one 1 10 and eight-tenths cents on each cigarette. 1 11Class A. On cigarettes weighing not more than1 12three pounds per thousand, eighteen mills on each such1 13cigarette.1 14Class B. On cigarettes weighing more than three1 15pounds per thousand, eighteen mills on each such1 16cigarette.1 17 Sec. . Section 453A.25, Code 1995, is amended 1 18 by adding the following new subsection: 1 19 NEW SUBSECTION. 4. The director is authorized to 1 20 designate the city or county which issues retail 1 21 licenses and permits to administer and enforce, 1 22 including collecting penalties and fines, the 1 23 provisions of this chapter relating to the retail sale 1 24 of cigarettes and tobacco products. 1 25 Sec. . Section 4543A.35, Code 1995, is amended 1 26 to read as follows: 1 27 453A.35 TAX AND FEES PAID TO GENERAL FUND. 1 28 The proceeds derived from the sale of stamps and 1 29 the payment of taxes, fees and penalties provided for 1 30 under this chapter, and the permit fees received from 1 31 all permits issued by the department, shall be 1 32 credited to the general fund of the state. All permit 1 33 fees and penalties provided for in this chapter and 1 34 collected by cities in the issuance of permits granted 1 35 by the cities shall be paid to the treasurer of the 1 36 city where the permit is effective, or to another city 1 37 officer as designated by the council, and credited to 1 38 the general fund of the city.
