  1  1    Amend Senate File 2063, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  By striking everything after the enacting
  1  4 clause and inserting the following:
  1  5    "Section 1.  NEW SECTION.  295.1  LEGISLATIVE
  1  6 FINDINGS AND INTENT.
  1  7    The general assembly finds that it is in the public
  1  8 interest to develop and equitably fund instructional
  1  9 technology within the public schools of this state to
  1 10 ensure that school students, teachers, and
  1 11 administrators are equipped and prepared to excel in
  1 12 the twenty-first century.  Toward that goal, it is the
  1 13 intent of this chapter to establish and fund a school
  1 14 improvement technology program.  It is the intent of
  1 15 the general assembly that funds received under a
  1 16 school improvement technology program be used to
  1 17 supplement, not supplant, funds schools are expending
  1 18 for technology.
  1 19    Sec. 2.  NEW SECTION.  295.2  SCHOOL IMPROVEMENT
  1 20 TECHNOLOGY APPROPRIATION.
  1 21    1.  There is appropriated from the general fund of
  1 22 the state to the department of education for each
  1 23 fiscal year the sum of thirty million dollars for the
  1 24 school improvement technology program.
  1 25    2.  From the moneys appropriated in subsection 1,
  1 26 the amount of moneys allocated to school districts
  1 27 shall be in the proportion that the basic enrollment
  1 28 of a district bears to the sum of the basic enrollment
  1 29 of all districts in the state for the budget year.
  1 30 However, for the fiscal period beginning July 1, 1996,
  1 31 and ending June 30, 1998, a school district shall not
  1 32 receive less than fifteen thousand dollars in each
  1 33 fiscal year, and the Iowa braille and sight saving
  1 34 school and the state school for the deaf shall each
  1 35 not receive less than sixty thousand dollars in each
  1 36 fiscal year.
  1 37    For the fiscal year beginning July 1, 1998, and
  1 38 each succeeding year in which moneys are appropriated
  1 39 in subsection 1, the Iowa braille and sight saving
  1 40 school and the state school for the deaf shall not
  1 41 receive less than fifteen thousand dollars in each
  1 42 fiscal year.  The Iowa braille and sight saving
  1 43 school, the state school for the deaf, and the Price
  1 44 laboratory school at the university of northern Iowa
  1 45 shall annually certify their basic enrollments to the
  1 46 department of education by October 1.
  1 47    3.  For each year in which moneys are appropriated
  1 48 under subsection 1, the department of education shall
  1 49 notify the department of revenue and finance of the
  1 50 amount to be paid to each school district based upon
  2  1 the distribution plan set forth for the appropriation
  2  2 made pursuant to this section.  The allocation to each
  2  3 school district under this section shall be made in
  2  4 one payment on or about October 15 of the fiscal year
  2  5 in which the appropriation is made, taking into
  2  6 consideration the relative budget and cash position of
  2  7 the state resources.  Prior to the receipt of funds,
  2  8 school districts shall provide to the department of
  2  9 education adequate assurance that they have developed
  2 10 or are developing a technology plan as required by
  2 11 section 295.3 and that funds received under this
  2 12 section will be used in accordance with the required
  2 13 technology plan.  However, approval of the plan by the
  2 14 department is not required.
  2 15    4.  Moneys received under this section shall not be
  2 16 commingled with state aid payments made under section
  2 17 257.16 to a school district and shall be accounted for
  2 18 by the local school district separately from state aid
  2 19 payments.
  2 20    5.  Payments made to school districts under this
  2 21 section are miscellaneous income for purposes of
  2 22 chapter 257.  Each local school district shall
  2 23 maintain a separate technology fund account within its
  2 24 budget for payments received and expenditures made
  2 25 pursuant to this section.
  2 26    6.  Moneys received under this section shall not be
  2 27 used for payment of any collective bargaining
  2 28 agreement or arbitrator's decision negotiated or
  2 29 awarded under chapter 20.
  2 30    7.  For purposes of this section, "school district"
  2 31 means a school district, the Iowa braille and sight
  2 32 saving school, the state school for the deaf, and the
  2 33 Price laboratory school at the university of northern
  2 34 Iowa.
  2 35    Sec. 3.  NEW SECTION.  295.3  SCHOOL IMPROVEMENT
  2 36 TECHNOLOGY PLANNING.
  2 37    1.  The board of directors of a school district
  2 38 shall adopt a technology plan that supports school
  2 39 improvement technology efforts and includes an
  2 40 evaluation component.  The plan shall focus on the
  2 41 attainment of student achievement goals under sections
  2 42 280.12 and 280.18 and shall demonstrate the manner in
  2 43 which the board, over a four-year period, will utilize
  2 44 technology to improve student achievement.  The plan
  2 45 shall be developed by licensed professional staff of
  2 46 the district, including both teachers and
  2 47 administrators.  The advisory committee appointed by
  2 48 the board pursuant to section 280.12, subsection 2,
  2 49 shall advise the board concerning the development of
  2 50 goals and the assessment process and measurements to
  3  1 be used under the plan.  Technology plans shall be
  3  2 kept on file in the district and a copy sent to the
  3  3 appropriate area education agency.  Progress made
  3  4 under these plans shall be included as part of the
  3  5 annual report submitted to the department of education
  3  6 in compliance with sections 280.12 and 280.18.
  3  7    2.  If the board of directors of a school district
  3  8 elects to employ a technology director, the
  3  9 qualifications for the position shall be determined by
  3 10 the board.
  3 11    3.  The Iowa braille and sight saving school, the
  3 12 state school for the deaf, and the Price laboratory
  3 13 school at the university of northern Iowa shall
  3 14 develop a technology plan that supports and improves
  3 15 student achievement, demonstrates the manner in which
  3 16 technology will be utilized to improve student
  3 17 achievement, and includes an evaluation component.
  3 18 Plans and an annual progress report shall be submitted
  3 19 to the state board of regents and the department of
  3 20 education.
  3 21    Sec. 4.  NEW SECTION.  295.4  SCHOOL IMPROVEMENT
  3 22 AND TECHNOLOGY EXPENDITURES.
  3 23    Funds received by a school district pursuant to
  3 24 section 295.2 shall be expended for communication
  3 25 costs, the acquisition, lease, or lease-purchase,
  3 26 installation, and maintenance of instructional
  3 27 technology equipment, including hardware and software,
  3 28 materials and supplies related to instructional
  3 29 technology, and staff development and training.
  3 30 Priorities for the use of the funds shall be made by
  3 31 the school district."
