  1  1    Amend the amendment, H-4145, to Senate amendment,
  1  2 H-4033, to House File 519, as amended, passed, and
  1  3 reprinted by the House, as follows:
  1  4    #1.  Page 7, by striking lines 23 through 36 and
  1  5 inserting the following:
  1  6    "   .  If an animal feeding operation is a small
  1  7 animal feeding operation as defined in section
  1  8 455B.161, there shall be a rebuttable presumption that
  1  9 the small animal feeding operation is not a public or
  1 10 private nuisance under this chapter or under
  1 11 principles of common law, and that the small animal
  1 12 feeding operation does not unreasonably interfere with
  1 13 another person's comfortable use and enjoyment of the
  1 14 person's life or property under any other cause of
  1 15 action.  The rebuttable presumption shall".
