1 1 Amend House File 574 as follows:
1 2 #1. Page 24, by inserting before line 1 the
1 3 following:
1 4 "Sec. 101. Section 476.6, Code 1995, is amended by
1 5 adding the following new subsection:
1 6 NEW SUBSECTION. 22. If a rate-regulated public
1 7 utility acquires all or part of another rate-regulated
1 8 utility, the acquired public utility service area
1 9 shall be considered a separate service area of the
1 10 public utility for the purpose of determining customer
1 11 rates, charges, and schedules. The board shall
1 12 approve rate adjustments, charges, and schedules only
1 13 which reflect the differences between the customer
1 14 rates, charges, and schedules of the separate service
1 15 areas at the time of acquisition."
1 16 #2. Page 24, line 1, by inserting after the words
1 17 "and section" the following: "101, being deemed of
1 18 immediate importance, take effect upon enactment.
1 19 Section 101 of this Act is retroactive to April 1,
1 20 1995. Section".
1 21 #3. Title page, line 3, by inserting after the
1 22 word "for" the following: "regulatory authority and".
1 23 #4. Title page, line 4, by inserting after the
1 24 word "date" the following: "and retroactive date".
