  1  1    Amend Senate File 256, as passed by the Senate, as
  1  2 follows:
  1  3    #1.  By striking page 1, lines 1 through 21, and
  1  4 inserting the following:
  1  5    "Section 1.  Section 206.2, subsection 7, Code
  1  6 1995, is amended by striking the subsection.
  1  7    Sec. 2.  Section 206.5, subsection 6, Code 1995, is
  1  8 amended by striking the subsection.
  1  9    Sec. 3.  Section 206.19, subsection 3, Code 1995,
  1 10 is amended to read as follows:
  1 11    3.  Determine in cooperation with municipalities,
  1 12 the proper notice to be given by a commercial or
  1 13 public applicator to occupants of adjoining properties
  1 14 in urban areas prior to or after the exterior
  1 15 application of pesticides, and establish a schedule to
  1 16 determine the periods of application least harmful to
  1 17 living beings, and adopt rules to implement these
  1 18 provisions.  The rules shall provide that a commercial
  1 19 or public applicator must provide notice only if an
  1 20 occupant requests that the commercial or public
  1 21 applicator provide the occupant notice in a timely
  1 22 manner prior to the application.  The request shall
  1 23 include the name and address of the occupant, a
  1 24 telephone number of a location where the occupant may
  1 25 be contacted during normal business hours and evening
  1 26 hours, and the address of each property that adjoins
  1 27 the occupant's property.  The notification shall
  1 28 expire on December 31 of each year, or the date when
  1 29 the occupant no longer occupies the property,
  1 30 whichever is earlier.  Municipalities shall cooperate
  1 31 with the department by reporting infractions and in
  1 32 implementing this subsection.
  1 33    Sec. 4.  Section 206.22, subsection 4, Code 1995,
  1 34 is amended by striking the subsection.
  1 35    Sec. 5.  REPEAL.  Chapter 206A, Code 1995, is
  1 36 repealed."
  1 37    #2.  Title page, lines 1 and 2, by striking the
  1 38 words "notification of the application of pesticides"
  1 39 and inserting the following:  "pesticides, by
  1 40 providing for the notification of application and
  1 41 providing for the elimination of provisions relating
  1 42 to chemigation."
