Page 18, by inserting after line 25 the following: 1 13 "Sec. . Section 455B.183A, Code 1995, is amended 1 14 to read as follows: 1 15 455B.183A WATER QUALITY PROTECTION 1 16 FUND. 1 17 1. A water quality protection fund 1 18 is created in the state 1 19 treasury under the control of the 1 20 department. The fund 1 21 consists of moneys appropriated to the 1 22 fund by the general 1 23 assembly,moneys deposited into the fund1 24from fees described1 25in subsection 2,and other moneys 1 26 available to and obtained or 1 27 accepted by the department from the 1 28 United States government 1 29 or private sources for placement in the 1 30 fund. The fund is 1 31 divided into two accounts, including the 1 32 administration 1 33 account and the public water supply 1 34 system account. Moneys in 1 35 the administration account shall be used 1 36 for purposes of 1 37 carrying out the provisions of this 1 38 division, which relate to 1 39 the administration, regulation, and 1 40 enforcement of the federal 1 41 Safe Drinking Water Act. Moneys in the 1 42 public water supply 1 43 system account shall be used to support 1 44 the program to assist 1 45 supply systems, as provided in section 1 46 455B.183B. 1 472. The commission shall adopt fees1 48as required pursuant to1 49section 455B.105 for permits required1 50for public water supply2 1systems as provided in sections 455B.1742 2and 455B.183. Fees2 3paid pursuant to this section shall not2 4be subject to the2 5sales or services tax. The fees shall2 6be for each of the2 7following:2 8a. The construction, installation,2 9or modification of a2 10public water supply system. The amount2 11of the fees may be2 12based on the type of system being2 13constructed, installed, or2 14modified.2 15b. The operation of a public water2 16supply system,2 17including any part of the system. The2 18fees may be based on2 19the type and size of community served by2 20the system. The2 21commission shall adopt a fee schedule.2 22The commission shall2 23calculate all fees in the schedule to2 24produce total revenues2 25equaling four hundred seventy-five2 26thousand dollars for the2 27fiscal year beginning July 1, 1994, and2 28ending June 30, 1995,2 29seven hundred thousand dollars for the2 30fiscal year beginning2 31July 1, 1995, and ending June 30, 1996,2 32nine hundred thousand2 33dollars for the fiscal year beginning2 34July 1, 1996, and ending2 35June 30, 1997, and one million two2 36hundred thousand dollars2 37for each subsequent fiscal year. For2 38the fiscal year2 39beginning July 1, 1994, and ending June2 4030, 1995, twenty-five2 41thousand dollars shall be deposited in2 42the administration2 43account and four hundred fifty thousand2 44dollars shall be2 45deposited in the public water supply2 46system account. For each2 47subsequent fiscal year, one-half of the2 48fees shall be2 49deposited into the administration2 50account and one-half of the3 1fees shall be deposited into the public3 2water supply system3 3account. By May 1 of each year, the3 4department shall estimate3 5the total revenue expected to be3 6collected from the3 7overpayment of fees, which are all fees3 8in excess of the3 9amount of the total revenues which are3 10expected to be3 11collected under the current fee3 12schedule, and the total3 13revenue expected to be collected from3 14the payment of fees3 15during the next fiscal year. The3 16commission shall adjust the3 17fees if the estimate exceeds the amount3 18of revenue required to3 19be deposited in the fund pursuant to3 20this paragraph.3 213.2. Moneys in the fund are subject to 3 22 an annual audit by 3 23 the auditor of state. The fund is 3 24 subject to warrants by the 3 25 director of revenue and finance, drawn 3 26 upon the written 3 27 requisition of the department. 3 284.3. Section 8.33 does not apply to 3 29 moneys in the fund. 3 30 Moneys earned as income, including 3 31 interest from the fund, 3 32 shall remain in the fund until expended. 3 335.4. On or before November 15 of each 3 34 fiscal year, the 3 35 department shall transmit to the 3 36 department of management and 3 37 the legislative fiscal bureau 3 38 information regarding the fund 3 39 and accounts, including all of the 3 40 following: 3 41 a. The balance of unobligated and 3 42 unencumbered moneys in 3 43 each account as of November 1. 3 44 b. A summary of revenue deposited in 3 45 and expenditures from 3 46 each account during the current fiscal 3 47 year. 3 48 c. Estimates of revenues expected to 3 49 be deposited into the 3 50 public water supply system account 4 1 during the current fiscal 4 2 year, and an estimate of the expected 4 3 balance of unobligated 4 4 and unencumbered moneys in the account 4 5 on June 30 of the 4 6 current fiscal year." 4 7 #4.
