  1 13    "Sec.    .  Section 455B.183A, Code 1995, is amended
  1 14 to read as follows:
  1 15    455B.183A  WATER QUALITY PROTECTION
  1 16 FUND.
  1 17    1.  A water quality protection fund
  1 18 is created in the state
  1 19 treasury under the control of the
  1 20 department.  The fund
  1 21 consists of moneys appropriated to the
  1 22 fund by the general
  1 23 assembly, moneys deposited into the fund
  1 24 from fees described
  1 25 in subsection 2, and other moneys
  1 26 available to and obtained or
  1 27 accepted by the department from the
  1 28 United States government
  1 29 or private sources for placement in the
  1 30 fund.  The fund is
  1 31 divided into two accounts, including the
  1 32 administration
  1 33 account and the public water supply
  1 34 system account.  Moneys in
  1 35 the administration account shall be used
  1 36 for purposes of
  1 37 carrying out the provisions of this
  1 38 division, which relate to
  1 39 the administration, regulation, and
  1 40 enforcement of the federal
  1 41 Safe Drinking Water Act.  Moneys in the
  1 42 public water supply
  1 43 system account shall be used to support
  1 44 the program to assist
  1 45 supply systems, as provided in section
  1 46 455B.183B.
  1 47    2.  The commission shall adopt fees
  1 48 as required pursuant to
  1 49 section 455B.105 for permits required
  1 50 for public water supply
  2  1 systems as provided in sections 455B.174
  2  2 and 455B.183.  Fees
  2  3 paid pursuant to this section shall not
  2  4 be subject to the
  2  5 sales or services tax.  The fees shall
  2  6 be for each of the
  2  7 following:
  2  8    a.  The construction, installation,
  2  9 or modification of a
  2 10 public water supply system.  The amount
  2 11 of the fees may be
  2 12 based on the type of system being
  2 13 constructed, installed, or
  2 14 modified.
  2 15    b.  The operation of a public water
  2 16 supply system,
  2 17 including any part of the system.  The
  2 18 fees may be based on
  2 19 the type and size of community served by
  2 20 the system.  The
  2 21 commission shall adopt a fee schedule.
  2 22 The commission shall
  2 23 calculate all fees in the schedule to
  2 24 produce total revenues
  2 25 equaling four hundred seventy-five
  2 26 thousand dollars for the
  2 27 fiscal year beginning July 1, 1994, and
  2 28 ending June 30, 1995,
  2 29 seven hundred thousand dollars for the
  2 30 fiscal year beginning
  2 31 July 1, 1995, and ending June 30, 1996,
  2 32 nine hundred thousand
  2 33 dollars for the fiscal year beginning
  2 34 July 1, 1996, and ending
  2 35 June 30, 1997, and one million two
  2 36 hundred thousand dollars
  2 37 for each subsequent fiscal year.  For
  2 38 the fiscal year
  2 39 beginning July 1, 1994, and ending June
  2 40 30, 1995, twenty-five
  2 41 thousand dollars shall be deposited in
  2 42 the administration
  2 43 account and four hundred fifty thousand
  2 44 dollars shall be
  2 45 deposited in the public water supply
  2 46 system account.  For each
  2 47 subsequent fiscal year, one-half of the
  2 48 fees shall be
  2 49 deposited into the administration
  2 50 account and one-half of the
  3  1 fees shall be deposited into the public
  3  2 water supply system
  3  3 account.  By May 1 of each year, the
  3  4 department shall estimate
  3  5 the total revenue expected to be
  3  6 collected from the
  3  7 overpayment of fees, which are all fees
  3  8 in excess of the
  3  9 amount of the total revenues which are
  3 10 expected to be
  3 11 collected under the current fee
  3 12 schedule, and the total
  3 13 revenue expected to be collected from
  3 14 the payment of fees
  3 15 during the next fiscal year.  The
  3 16 commission shall adjust the
  3 17 fees if the estimate exceeds the amount
  3 18 of revenue required to
  3 19 be deposited in the fund pursuant to
  3 20 this paragraph.
  3 21    3. 2.  Moneys in the fund are subject to
  3 22 an annual audit by
  3 23 the auditor of state.  The fund is
  3 24 subject to warrants by the
  3 25 director of revenue and finance, drawn
  3 26 upon the written
  3 27 requisition of the department.
  3 28    4. 3.  Section 8.33 does not apply to
  3 29 moneys in the fund.
  3 30 Moneys earned as income, including
  3 31 interest from the fund,
  3 32 shall remain in the fund until expended.
  3 33    5. 4.  On or before November 15 of each
  3 34 fiscal year, the
  3 35 department shall transmit to the
  3 36 department of management and
  3 37 the legislative fiscal bureau
  3 38 information regarding the fund
  3 39 and accounts, including all of the
  3 40 following:
  3 41    a.  The balance of unobligated and
  3 42 unencumbered moneys in
  3 43 each account as of November 1.
  3 44    b.  A summary of revenue deposited in
  3 45 and expenditures from
  3 46 each account during the current fiscal
  3 47 year.
  3 48    c.  Estimates of revenues expected to
  3 49 be deposited into the
  3 50 public water supply system account
  4  1 during the current fiscal
  4  2 year, and an estimate of the expected
  4  3 balance of unobligated
  4  4 and unencumbered moneys in the account
  4  5 on June 30 of the
  4  6 current fiscal year."
