PAG LIN 1 1 Amend the amendment, H-3610, to House File 518 as 1 2 follows: 1 3 #1. Page 4, by striking line 1 and inserting the 1 4 following: "at any time, any other two-way switched 1 5 communications services". 1 6 #2. Page 4, line 9, by striking the words "Primary 1 7 residence" and inserting the following: "Residence". 1 8 #3. Page 7, by striking lines 6 through 14 and 1 9 inserting the following: "A local exchange carrier 1 10 which elects to reduce its rates by six percent shall 1 11 not, at a later time, increase its rates for basic 1 12 communications services as a result of the carrier's 1 13 compliance with the board's rules relating to 1 14 unbundling. In lieu of the six percent reduction, and 1 15 prior to the adoption of rules relating to unbundling 1 16 pursuant to section 476.30D, subsection 4, paragraph 1 17 "a", subparagraph (1), the local exchange carrier may 1 18 request and the board may establish a regulated 1 19 revenue requirement in a rate proceeding under section 1 20 476.3 or 476.6 commenced after the effective date of 1 21 this Act. After the determination of the local 1 22 exchange carrier's regulated revenue requirement 1 23 pursuant to the rate proceeding, the local exchange 1 24 carrier shall not immediately implement rates designed 1 25 to recover that regulated revenue requirement. 1 26 Following the adoption of rules relating to unbundling 1 27 pursuant to section 476.30D, subsection 4, paragraph 1 28 "a", subparagraph (1), the local exchange carrier 1 29 shall commence a tariff proceeding for the approval of 1 30 tariffs implementing such unbundling. The board has 1 31 six months to complete this tariff proceeding and 1 32 determine the local exchange carrier's final unbundled 1 33 rates. The local exchange carrier shall carry forward 1 34 the regulated revenue requirement determined by the 1 35 board pursuant to the rate proceeding and design rates 1 36 that comply with the board's rules relating to 1 37 unbundling that recover the regulated revenue 1 38 requirement, and that implement the board's approved 1 39 rate design established in the tariff proceeding. 1 40 In lieu of taking the six percent reduction, a 1 41 local exchange carrier that submits a plan for price 1 42 regulation after the board adopts rules relating to 1 43 unbundling may file a rate proceeding under section 1 44 476.3 or 476.6 and the board may approve rates 1 45 designed to comply with those rules which allow the 1 46 carrier to recover the established regulated revenue 1 47 requirement and that implement the board's approved 1 48 rate design established in the tariff proceeding." 1 49 #4. Page 11, line 17, by inserting after the word 1 50 "rules" the following: ", except for local exchange 2 1 carriers with less than seventy-five thousand access 2 2 lines which must file such tariffs within two years of 2 3 the effective date of this Act". 2 4 #5.
