1 1 Amend the amendment, H-3710, to House File 370 as

1 7 "Section 1. Section 422.51, Code 1995, is amended
1 8 by adding the following new subsection:
1 9 NEW SUBSECTION. 5. The taxes remitted pursuant to
1 10 this division shall be reduced by a methane energy
1 11 purchase tax credit. An electric utility which has
1 12 purchased electricity from a methane-producing
1 13 sanitary landfill pursuant to section 476.43 shall be
1 14 granted the credit. The credit shall equal the amount
1 15 paid by the electric utility in excess of its
1 16 incremental cost as defined in section 476.43A,
1 17 subsection 2. The amount of the credit shall, in the
1 18 first instance, be determined by the electric utility,
1 19 which shall make a monthly report of such credits to
1 20 the Iowa utilities board and the department, deducting
1 21 this credit from the periodic deposits of taxes due
1 22 under this division. If the department disputes the
1 23 amount of any such credit, such disputes shall be
1 24 resolved by the Iowa utilities board.""
1 25 #2. Page 2, by inserting after line 46 the
1 26 following:
1 27 "6A. Whenever a contract approved by the board
1 28 requires an electric utility to purchase electricity
1 29 from a methane-producing sanitary landfill pursuant to
1 30 this section, the electric utility shall be entitled
1 31 to a methane energy purchase tax credit as provided in
1 32 section 422.51. The electric utility shall reflect
1 33 the methane energy purchase tax credit received by the
1 34 electric utility in the electric utility's automatic
1 35 adjustment pursuant to section 476.6, subsection 11,
1 36 to the extent its payments to the methane-producing
1 37 sanitary landfill, in excess of the incremental cost
1 38 of alternative electric energy, were included in the
1 39 automatic adjustment clause."
