1 2 #1. By striking everything after the enacting
1 3 clause and inserting the following:
1 4 "Sec. . Section 476.44, subsection 2, Code
1 5 1995, is amended to read as follows:
1 6 2. An electric utility subject to this division,
1 7 except a utility which elects rate regulation pursuant
1 8 to section 476.1A, shall not be required to purchase,
1 9 at any one time, more than its share of one hundred
1 10 five megawatts of power from alternative energy
1 11 production facilities or small hydro facilities at the
1 12 rates established pursuant to section 476.43. An
1 13 alternate energy production facility or a small hydro
1 14 facility is limited to providing not more than thirty-
1 15 three percent of the total alternate energy required
1 16 to be purchased under this section. The board shall
1 17 allocate the one hundred five megawatts based upon
1 18 each utility's percentage of the total Iowa retail
1 19 peak demand, for the year beginning January 1, 1990,
1 20 of all utilities subject to this section. If a
1 21 utility undergoes reorganization as defined in section
1 22 476.76, the board shall combine the allocated
1 23 purchases of power for each utility involved in the
1 24 reorganization.
1 25 Notwithstanding the one hundred five megawatt
1 26 maximum, the board may increase the amount of power
1 27 that a utility is required to purchase at the rates
1 28 established pursuant to section 476.43 if the board
1 29 finds that a utility, including a reorganized utility,
1 30 exceeds its 1990 Iowa retail peak demand by twenty
1 31 percent and the additional power the utility is
1 32 required to purchase will encourage the development of
1 33 alternate energy production facilities and small hydro
1 34 facilities. The increase shall not exceed the
1 35 utility's increase in peak demand multiplied by the
1 36 ratio of the utility's share of the one hundred five
1 37 megawatt maximum to its 1990 Iowa retail peak demand."
