1 4 "Section 1. Section 476.1, unnumbered paragraph 4,
1 5 Code 1995, is amended to read as follows:
1 6 Mutual telephone companies in which at least fifty
1 7 percent of the users are owners, co-operative
1 8 telephone corporations or associations, telephone
1 9 companies having less than fifteen thousand customers
1 10 and less than fifteen thousand access lines,
1 11 municipally owned utilities, and unincorporated
1 12 villages which own their own distribution systems are
1 13 not subject to the rate regulation provided for in
1 14 this chapter or to sections 476.30A through 476.30D."
1 15 #2. Page 3, by inserting after line 6 the
1 16 following:
1 17 "2A. "Basic communications price factor" means the
1 18 following:
1 19 a. For purposes of a local exchange carrier having
1 20 less than fifteen thousand customers and less than
1 21 fifteen thousand access lines, a factor determined
1 22 annually as the lower of the following:
1 23 (1) Forty-one and six thousand six hundred sixty-
1 24 seven ten thousandths percent of the percentage change
1 25 of the average annual gross national product price
1 26 index.
1 27 (2) The percentage change of the average annual
1 28 gross national product price index minus two and
1 29 seventy-five hundredths percentage points.
1 30 b. For purposes of the local exchange carrier
1 31 having fifteen thousand or more customers and fifteen
1 32 thousand or more access lines, a factor determined
1 33 annually as the lower of the following:
1 34 (1) Fifty-two and eight hundred thirty-four ten
1 35 thousandths percent of the percentage change of the
1 36 average annual gross national product price index.
1 37 (2) The percentage change of the average annual
1 38 gross national product price index minus two and six
1 39 hundred twenty-five thousandths percentage points."
1 40 #3. Page 5, by striking lines 24 through 30 and
1 41 inserting the following: "the prices for basic
1 42 communications services based upon the basic
1 43 communications price factor."
1 44 #4. By renumbering as necessary.
