  1  6    Section 1.  There is appropriated from the general
  1  7 fund of the state to the department of education for
  1  8 the fiscal year beginning July 1, 1995, and ending
  1  9 June 30, 1996, the following amounts, or so much
  1 10 thereof as may be necessary, to be used for the
  1 11 purposes designated:
  1 12    1.  GENERAL ADMINISTRATION
  1 13    For salaries, support, maintenance, miscellaneous
  1 14 purposes, and for not more than the following full-
  1 15 time equivalent positions:

  1 18    The department of education shall conduct a study
  1 19 of chapter 299, the compulsory education law of this
  1 20 state, in cooperation with interested individuals from

  1 23 general assembly by January 1, 1996.
  1 24    2.  VOCATIONAL EDUCATION ADMINISTRATION

  1 36    It is the intent of the general assembly that the
  1 37 division of vocational rehabilitation services of the
  1 38 department of education shall seek, in addition to
  1 39 state appropriations, funds other than federal funds,
  1 40 which may include but are not limited to local funds,
  1 41 for purposes of matching federal vocational
  1 42 rehabilitation funds.
  1 43    Notwithstanding the full-time equivalent position
  1 44 limit established in this subsection for the fiscal
  1 45 year ending June 30, 1996, if federal funding is
  1 46 available to pay the costs of additional employees for
  1 47 the vocational rehabilitation division who would have
  1 48 duties relating to vocational rehabilitation services
  1 49 paid for through federal funding, authorization to
  1 50 hire not more than four full-time equivalent employees
  2  1 shall be provided, the full-time equivalent position
  2  2 limit shall be exceeded, and the additional employees
  2  3 shall be hired by the division.
  2  4    b.  For matching funds for programs to enable
  2  5 severely physically or mentally disabled persons to
  2  6 function more independently, including salaries and

  2 48    For salaries, support, maintenance, capital

  3  3    Of the full-time equivalent positions provided for
  3  4 under this subsection for the fiscal year beginning
  3  5 July 1, 1995, and ending June 30, 1996, it is the
  3  6 intent of the general assembly that 4.0 full-time
  3  7 equivalent positions be provided for purposes formerly
  3  8 provided for under the Star Schools program.
  3  9    The public broadcasting division shall conduct a
  3 10 study, in collaboration with all entities receiving
  3 11 services via the Iowa communications network, of the
  3 12 efficiencies of the network and shall make
  3 13 recommendations relating to the elimination of
  3 14 duplicative efforts.  The study shall include an
  3 15 investigation of the duties and functions of employees
  3 16 of the division, other state agencies, area education
  3 17 agencies, and public schools, if those duties and
  3 18 functions involve the Iowa communications network.
  3 19 The division shall submit a report of its findings and
  3 20 recommendations to the general assembly and the
  3 21 legislative fiscal bureau by January 1, 1996.
  3 22    11.  NATIONAL ASSESSMENT OF EDUCATION PROGRESS
  3 23 (NAEP)
  3 24    For participation by the department of education in
  3 25 a state and national project to determine the academic
  3 26 achievement of Iowa students in math, reading,
  3 27 science, United States history, or geography:

  3 29    12.  VOCATIONAL EDUCATION TO SECONDARY SCHOOLS
  3 30    For reimbursement for vocational education
  3 31 expenditures made by secondary schools:

  3 34 for expenditures made by school districts to meet the
  3 35 standards set in sections 256.11, 258.4, and 260C.14

  3 38 vocational education expenditures made by secondary
  3 39 schools in the manner provided by the department of
  3 40 education for implementation of the standards set in
  3 41 1989 Iowa Acts, chapter 278.

  3 43    Notwithstanding chapter 260D, for general state
  3 44 financial aid, including general financial aid to
  3 45 merged areas in lieu of personal property tax
  3 46 replacement payments under section 427A.13, to merged
  3 47 areas as defined in section 260C.2, for vocational
  3 48 education programs in accordance with chapters 258 and
  3 49 260C, to purchase instructional equipment for
  3 50 vocational and technical courses of instruction in
  4  1 community colleges, and for salary increases:

  4 20    Sec. 2.  Notwithstanding 1994 Iowa Acts, chapter
  4 21 1193, section 2, subsection 2, funds appropriated and
  4 22 allocated to the merged areas pursuant to 1994 Iowa
  4 23 Acts, chapter 1193, section 2, for the fiscal year
  4 24 beginning July 1, 1994, and ending June 30, 1995,
  4 25 pursuant to section 8.53, unnumbered paragraph 1,
  4 26 shall be paid to the merged areas by June 30, 1995.  
  4 27             COLLEGE STUDENT AID COMMISSION
  4 28    Sec. 3.  There is appropriated from the general
  4 29 fund of the state to the college student aid
  4 30 commission for the fiscal year beginning July 1, 1995,
  4 31 and ending June 30, 1996, the following amounts, or so
  4 32 much thereof as may be necessary, to be used for the
  4 33 purposes designated:

  4 41 SCIENCES
  4 42    a.  For forgivable loans to Iowa students attending
  4 43 the university of osteopathic medicine and health
  4 44 sciences, under the forgivable loan program pursuant
  4 45 to section 261.19A:

  4 47    b.  For the university of osteopathic medicine and
  4 48 health sciences for an initiative in primary health
  4 49 care to direct primary care physicians to shortage
  4 50 areas in the state:

  5  2    The moneys appropriated in this lettered paragraph
  5  3 shall be used as follows:
  5  4    (1)  To reduce student loan debt for primary care
  5  5 physicians in an amount not to exceed $30,000 per
  5  6 student for a four-year period of medical service in
  5  7 medically underserved areas of the state.
  5  8    (2)  For tuition scholarships for students
  5  9 attending the university of osteopathic medicine and
  5 10 health sciences who agree to practice primary care
  5 11 medicine in medically underserved areas of the state.
  5 12 The student shall practice in the state two years for
  5 13 every year of tuition.  A person receiving funds under
  5 14 this subparagraph shall not be eligible for funds
  5 15 under subparagraph (1).
  5 16    (3)  For general administration costs of the
  5 17 university for the primary care initiative, the
  5 18 university shall expend an amount not to exceed
  5 19 $50,000.
  5 20    The university of osteopathic medicine and health
  5 21 sciences shall report quarterly to the legislative
  5 22 fiscal bureau concerning the expenditure of funds used
  5 23 pursuant to subparagraphs (1), (2), and (3) of this
  5 24 lettered paragraph.  The university shall also submit
  5 25 the annual audit of the university to the legislative
  5 26 fiscal bureau within six months following the year
  5 27 being audited.  The college student aid commission
  5 28 shall not provide moneys for subparagraphs (1) and (2)
  5 29 of this lettered paragraph until the university has
  5 30 signed and submitted contracts for the use of these
  5 31 moneys for reduction of student loan debt and tuition
  5 32 scholarships.  Funds for subparagraph (3) of this
  5 33 lettered paragraph shall be provided quarterly to the
  5 34 university.  Notwithstanding section 8.33, the funds
  5 35 for this lettered paragraph shall not revert to the
  5 36 general fund but be available for expenditure the
  5 37 following fiscal year for purposes of subparagraphs
  5 38 (1) and (2).
  5 39    3.  STUDENT AID PROGRAMS
  5 40    For payments to students for the Iowa grant
  5 41 program:

  5 43    Sec. 4.  There is appropriated from the loan
  5 44 reserve account to the college student aid commission
  5 45 for the fiscal year beginning July 1, 1995, and ending

  6  6    Sec. 5.  There is appropriated from the general
  6  7 fund of the state to the state board of regents for

  6  9 June 30, 1996, the following amounts, or so much
  6 10 thereof as may be necessary, to be used for the
  6 11 purposes designated:

  6 19 are augmented by reimbursements from the institutions

  6 24 of the joint appropriations subcommittee on education.
  6 25    b.  For allocation by the state board of regents to
  6 26 the state university of Iowa, the Iowa state
  6 27 university of science and technology, and the
  6 28 university of northern Iowa to reimburse the
  6 29 institutions for deficiencies in their operating funds
  6 30 resulting from the pledging of tuitions, student fees
  6 31 and charges, and institutional income to finance the
  6 32 cost of providing academic and administrative
  6 33 buildings and facilities and utility services at the
  6 34 institutions:

  6 36    The state board of regents, the department of

  7 27    Funds appropriated in this lettered paragraph shall
  7 28 not be used to perform abortions except medically
  7 29 necessary abortions, and shall not be used to operate
  7 30 the early termination of pregnancy clinic except for
  7 31 the performance of medically necessary abortions.  For
  7 32 the purpose of this lettered paragraph, an abortion is
  7 33 the purposeful interruption of pregnancy with the
  7 34 intention other than to produce a live-born infant or
  7 35 to remove a dead fetus, and a medically necessary
  7 36 abortion is one performed under one of the following
  7 37 conditions:
  7 38    (1)  The attending physician certifies that
  7 39 continuing the pregnancy would endanger the life of
  7 40 the pregnant woman.
  7 41    (2)  The attending physician certifies that the
  7 42 fetus is physically deformed, mentally deficient, or
  7 43 afflicted with a congenital illness.
  7 44    (3)  The pregnancy is the result of a rape which is
  7 45 reported within 45 days of the incident to a law
  7 46 enforcement agency or public or private health agency
  7 47 which may include a family physician.
  7 48    (4)  The pregnancy is the result of incest which is
  7 49 reported within 150 days of the incident to a law
  7 50 enforcement agency or public or private health agency
  8  1 which may include a family physician.
  8  2    (5)  The abortion is a spontaneous abortion,
  8  3 commonly known as a miscarriage, wherein not all of
  8  4 the products of conception are expelled.
  8  5    The total quota allocated to the counties for
  8  6 indigent patients for the fiscal year beginning July
  8  7 1, 1995, shall not be lower than the total quota
  8  8 allocated to the counties for the fiscal year
  8  9 commencing July 1, 1994.  The total quota shall be
  8 10 allocated among the counties on the basis of the 1990
  8 11 census pursuant to section 255.16.

  9 36    (1)  Of the moneys appropriated in this lettered
  9 37 paragraph, for the fiscal year beginning July 1, 1995,
  9 38 and ending June 30, 1996, the appropriation of the sum
  9 39 of $326,347 is contingent upon the announcement by the
  9 40 United States department of transportation of the
  9 41 selection of the university of Iowa as the contractor
  9 42 for the development of the national advanced driving
  9 43 simulator system.
  9 44    (2)  If the contingency in subparagraph (1) is met
  9 45 it is the intent of the general assembly that of the
  9 46 moneys appropriated in this lettered paragraph,the
  9 47 state university of Iowa shall expend $350,000, for
  9 48 the fiscal year beginning July 1, 1995, and ending
  9 49 June 30, 1996, for planning and architectural services
  9 50 related to the construction of the facility to house
 10  1 the national advanced driving simulator to be located
 10  2 at the Oakdale research park.  It is further the
 10  3 intent of the general assembly to provide funding in
 10  4 fiscal years beginning July 1, 1996, and July 1, 1997,
 10  5 in the total amount of $5.35 million for the
 10  6 construction of the facility to house the national
 10  7 advanced driving simulator to match federal funds
 10  8 provided for the project.  Funds provided for the
 10  9 construction of the facility to house the national
 10 10 advanced driving simulator in fiscal years beginning
 10 11 July 1, 1996, and July 1, 1997, shall only be expended
 10 12 upon receiving notification from the national highway
 10 13 traffic safety administration that the United States
 10 14 congress has authorized the construction of the
 10 15 national advanced driving simulator, that federal
 10 16 funds have been appropriated to begin construction,
 10 17 and that delivery of the motion base, graphics system,
 10 18 and integrating software will take place in
 10 19 substantial compliance with the United States
 10 20 department of transportation's acquisition schedule as
 10 21 set forth in the cooperative agreement between the
 10 22 state university of Iowa and the national highway
 10 23 traffic safety administration.

 11 36    Sec. 6.  Reallocations of sums received under
 11 37 section 5, subsections 2, 3, 4, 5, and 6, of this Act,
 11 38 including sums received for salaries, shall be
 11 39 reported on a quarterly basis to the co-chairpersons
 11 40 and ranking members of the legislative fiscal
 11 41 committee and the joint appropriations subcommittee on
 11 42 education.
 11 43    Sec. 7.  For the fiscal year beginning July 1,
 11 44 1995, and ending June 30, 1996, the state board of
 11 45 regents may use notes, bonds, or other evidences of
 11 46 indebtedness issued under section 262.48 to finance
 11 47 projects that will result in energy cost savings in an
 11 48 amount that will cause the state board to recover the
 11 49 cost of the projects within an average of six years.
 11 50    Sec. 8.  MEDICAL ASSISTANCE &endash; SUPPLEMENTAL
 12  1 AMOUNTS.
 12  2    For the fiscal year beginning July 1, 1995, and
 12  3 ending June 30, 1996, the department of human services
 12  4 shall continue the supplemental disproportionate share
 12  5 and a supplemental indirect medical education
 12  6 adjustment applicable to state-owned acute care
 12  7 hospitals with more than 500 beds and shall reimburse
 12  8 qualifying hospitals pursuant to that adjustment with
 12  9 a supplemental amount for services provided medical
 12 10 assistance recipients.  The adjustment shall generate
 12 11 supplemental payments intended to equal the state
 12 12 appropriation made to a qualifying hospital for
 12 13 treatment of indigent patients as provided in chapter
 12 14 255.  To the extent of the supplemental payments, a
 12 15 qualifying hospital shall, after receipt of the funds,
 12 16 transfer to the department of human services an amount
 12 17 equal to the actual supplemental payments that were
 12 18 made in that month.  The aggregate amounts for the
 12 19 fiscal year shall not exceed the state appropriation
 12 20 made to the qualifying hospital for treatment of
 12 21 indigent patients as provided in chapter 255.  The
 12 22 department of human services shall deposit the portion
 12 23 of these funds equal to the state share in the
 12 24 department's medical assistance account and the
 12 25 balance shall be credited to the general fund of the
 12 26 state.  To the extent that state funds appropriated to
 12 27 a qualifying hospital for the treatment of indigent
 12 28 patients as provided in chapter 255 have been
 12 29 transferred to the department of human services as a
 12 30 result of these supplemental payments made to the
 12 31 qualifying hospital, the department shall not,
 12 32 directly or indirectly, recoup the supplemental
 12 33 payments made to a qualifying hospital for any reason,
 12 34 unless an equivalent amount of the funds transferred
 12 35 to the department of human services by a qualifying
 12 36 hospital pursuant to this provision is transferred to
 12 37 the qualifying hospital by the department.
 12 38    If the state supplemental amount allotted to the
 12 39 state of Iowa for the federal fiscal year beginning
 12 40 October 1, 1995, and ending September 30, 1996,
 12 41 pursuant to section 1923 (f)(3) of the federal Social
 12 42 Security Act, as amended, or pursuant to federal
 12 43 payments for indirect medical education is greater
 12 44 than the amount necessary to fund the federal share of
 12 45 the supplemental payments specified in the preceding
 12 46 paragraph, the department of human services shall
 12 47 increase the supplemental disproportionate share or
 12 48 supplemental indirect medical education adjustment by
 12 49 the lesser of the amount necessary to utilize fully
 12 50 the state supplemental amount or the amount of state
 13  1 funds appropriated to the state university of Iowa
 13  2 general education fund and allocated to the university
 13  3 for the college of medicine.  The state university of
 13  4 Iowa shall transfer from the allocation for the
 13  5 college of medicine to the department of human
 13  6 services, on a monthly basis, an amount equal to the
 13  7 additional supplemental payments made during the
 13  8 previous month pursuant to this paragraph.  A
 13  9 qualifying hospital receiving supplemental payments
 13 10 pursuant to this paragraph that are greater than the
 13 11 state appropriation made to the qualifying hospital
 13 12 for treatment of indigent patients as provided in
 13 13 chapter 255 shall be obligated as a condition of its
 13 14 participation in the medical assistance program to
 13 15 transfer to the state university of Iowa general
 13 16 education fund on a monthly basis an amount equal to
 13 17 the funds transferred by the state university of Iowa
 13 18 to the department of human services.  To the extent
 13 19 that state funds appropriated to the state university
 13 20 of Iowa and allocated to the college of medicine have
 13 21 been transferred to the department of human services
 13 22 as a result of these supplemental payments made to the
 13 23 qualifying hospital, the department shall not,
 13 24 directly or indirectly, recoup these supplemental
 13 25 payments made to a qualifying hospital for any reason,
 13 26 unless an equivalent amount of the funds transferred
 13 27 to the department of human services by the state
 13 28 university of Iowa pursuant to this paragraph is
 13 29 transferred to the qualifying hospital by the
 13 30 department.
 13 31    Continuation of the supplemental disproportionate
 13 32 share and supplemental indirect medical education
 13 33 adjustment shall preserve the funds available to the
 13 34 university hospital for medical and surgical treatment
 13 35 of indigent patients as provided in chapter 255 and to
 13 36 the state university of Iowa for educational purposes
 13 37 at the same level as provided by the state funds
 13 38 initially appropriated for that purpose.
 13 39    The department of human services shall, in any
 13 40 compilation of data or other report distributed to the
 13 41 public concerning payments to providers under the
 13 42 medical assistance program, set forth reimbursements
 13 43 to a qualifying hospital through the supplemental
 13 44 disproportionate share and supplemental indirect
 13 45 medical education adjustment as a separate item and
 13 46 shall not include such payments in the amounts
 13 47 otherwise reported as the reimbursement to a
 13 48 qualifying hospital for services to medical assistance
 13 49 recipients.
 13 50    For purposes of this section, "supplemental
 14  1 payment" means a supplemental payment amount paid for
 14  2 medical assistance to a hospital qualifying for that
 14  3 payment under this section.  
 14  4             DEPARTMENT OF CULTURAL AFFAIRS
 14  5    Sec. 9.  There is appropriated from the general
 14  6 fund of the state to the department of cultural
 14  7 affairs for the fiscal year beginning July 1, 1995,
 14  8 and ending June 30, 1996, the following amounts, or so
 14  9 much thereof as is necessary, to be used for the
 14 10 purposes designated:
 14 11    1.  ARTS DIVISION
 14 12    For salaries, support, maintenance, miscellaneous
 14 13 purposes, including funds to match federal grants, for
 14 14 areawide arts and cultural service organizations that
 14 15 meet the requirements of chapter 303C, and for not
 14 16 more than the following full-time equivalent

 14 49    Sec. 10.  Notwithstanding section 8.33, funds
 14 50 appropriated in 1994 Iowa Acts, chapter 1193, section
 15  1 14, remaining unencumbered or unobligated on June 30,
 15  2 1995, shall not revert to the general fund of the
 15  3 state but shall be available for purposes of the Iowa
 15  4 grant program, in addition to funds appropriated in
 15  5 section 3, subsection 3, of this Act, with funds to be
 15  6 distributed pursuant to section 261.93A.
 15  7    Sec. 11.  Notwithstanding section 8.33, funds
 15  8 appropriated in 1994 Iowa Acts, chapter 1199, section
 15  9 35, remaining unencumbered or unobligated on June 30,
 15 10 1995, shall not revert to the general fund of the
 15 11 state but shall be appropriated and available to the
 15 12 historical division of the department of cultural
 15 13 affairs for purposes of contracting with the national
 15 14 park service to complete a reconnaissance study of
 15 15 blood run national historic landmark in Lyon county to
 15 16 determine the feasibility of incorporating the
 15 17 landmark into the national park system.
 15 18    Sec. 12.  There is appropriated from the
 15 19 scholarship and tuition grant reserve fund to the
 15 20 college student aid commission for the fiscal year
 15 21 beginning July 1, 1995, and ending June 30, 1996, the
 15 22 amount of $160,000, or the unobligated and
 15 23 unencumbered moneys transferred by August 31, 1995, to
 15 24 the fund at the close of the 1994-1995 fiscal year,
 15 25 whichever amount is greater, for purposes of the work-
 15 26 study program, in addition to funds appropriated in
 15 27 section 261.85.
 15 28    Sec. 13.  Funds appropriated for state scholarships
 15 29 pursuant to section 261.25, subsection 2, for the
 15 30 fiscal year beginning July 1, 1995, and ending June
 15 31 30, 1996, shall be used in their entirety to fund
 15 32 scholarships to eligible students, and the college
 15 33 student aid commission shall not place an across-the-
 15 34 board ceiling on the amount distributed under the
 15 35 state scholarship program.
 15 36    Sec. 14.  From funds appropriated in section
 15 37 294A.25, there is appropriated from phase III moneys
 15 38 to the department of education for the fiscal year
 15 39 beginning July 1, 1995, and ending June 30, 1996, the
 15 40 amount of $45,000 for purposes of the Iowa public
 15 41 broadcasting division.
 15 42    Sec. 15.  The director of the department of
 15 43 cultural affairs shall assume the duties of the
 15 44 administrator of the historical division.  The funds
 15 45 appropriated during the fiscal year beginning July 1,
 15 46 1994, and ending June 30, 1995, for the salary of the
 15 47 administrator, which were not paid to the
 15 48 administrator due to a vacancy in the position, shall
 15 49 revert to the general fund as provided in section
 15 50 8.33.
 16  1    Sec. 16.  Section 11.6, subsection 1, paragraph a,
 16  2 unnumbered paragraph 1, Code 1995, is amended to read
 16  3 as follows:
 16  4    The financial condition and transactions of all
 16  5 cities and city offices, counties, county hospitals
 16  6 organized under chapters 347 and 347A, memorial
 16  7 hospitals organized under chapter 37, entities
 16  8 organized under chapter 28E having gross receipts in
 16  9 excess of one hundred thousand dollars in a fiscal
 16 10 year, merged areas, area education agencies, and all
 16 11 school offices in school districts, shall be examined
 16 12 at least once each year, except that cities having a
 16 13 population of seven hundred or more but less than two
 16 14 thousand shall be examined at least once every four
 16 15 years, and cities having a population of less than
 16 16 seven hundred may be examined as otherwise provided in
 16 17 this section.  The examination shall cover the fiscal
 16 18 year next preceding the year in which the audit is
 16 19 conducted.  The examination of school offices shall
 16 20 include an audit of all school funds, the certified
 16 21 annual financial report, and the certified enrollment
 16 22 as provided in section 257.6.  Examinations of
 16 23 community colleges shall include an audit of eligible
 16 24 and noneligible contact hours as defined in section
 16 25 260D.2.  Eligible and noneligible contact hours and
 16 26 any differences in certified enrollment shall be
 16 27 reported to the department of management.
 16 28    Sec. 17.  Section 257.31, subsection 16, Code 1995,
 16 29 is amended to read as follows:
 16 30    16.  The committee shall perform the duties
 16 31 assigned to it under chapter 260D and section 257.32.
 16 32    Sec. 18.  NEW SECTION.  260C.24  PAYMENT OF
 16 33 APPROPRIATION.
 16 34    Payment of appropriations for distribution under
 16 35 this chapter or of appropriations made in lieu of such
 16 36 appropriations, shall be made by the department of
 16 37 revenue and finance in monthly installments due on or
 16 38 about the fifteenth of each month of a budget year,
 16 39 and installments shall be as nearly equal as possible,
 16 40 as determined by the department of revenue and
 16 41 finance, taking into consideration the relative budget
 16 42 and cash position of the state resources.
 16 43    Sec. 19.  Section 260C.39, unnumbered paragraphs 3
 16 44 and 4, Code 1995, are amended by striking the
 16 45 unnumbered paragraphs.
 16 46    Sec. 20.  Section 260C.39, unnumbered paragraph 5,
 16 47 Code 1995, is amended to read as follows:
 16 48    The terms of employment of personnel, for the
 16 49 academic year following the effective date of the
 16 50 agreement to combine the merged areas shall not be
 17  1 affected by the combination of the merged areas,
 17  2 except in accordance with the procedures under
 17  3 sections 279.15 to 279.18 and section 279.24, to the
 17  4 extent those procedures are applicable, or under the
 17  5 terms of the base bargaining agreement.  The authority
 17  6 and responsibility to offer new contracts or to
 17  7 continue, modify, or terminate existing contracts
 17  8 pursuant to any applicable procedures under chapter
 17  9 279, shall be transferred to the acting, and then to
 17 10 the new, board of the combined merged area upon
 17 11 certification of a favorable vote to each of the
 17 12 merged areas affected by the agreement.  The
 17 13 collective bargaining agreement of the merged area
 17 14 with serving the largest number of contact hours
 17 15 eligible for general aid, as defined under section
 17 16 260D.2, students shall serve as the base agreement for
 17 17 the combined merged area and the employees of the
 17 18 merged areas which combined to form the new combined
 17 19 merged area shall automatically be accreted to the
 17 20 bargaining unit from that former merged area for
 17 21 purposes of negotiating the contracts for the
 17 22 following years without further action by the public
 17 23 employment relations board.  If only one collective
 17 24 bargaining agreement is in effect among the merged
 17 25 areas which are combining under this section, then
 17 26 that agreement shall serve as the base agreement, and
 17 27 the employees of the merged areas which are combining
 17 28 to form the new combined merged area shall
 17 29 automatically be accreted to the bargaining unit of
 17 30 that former merged area for purposes of negotiating
 17 31 the contracts for the following years without further
 17 32 action by the public employment relations board.  The
 17 33 board of the combined merged area, using the base
 17 34 agreement as its existing contract, shall bargain with
 17 35 the combined employees of the merged areas that have
 17 36 agreed to combine for the academic year beginning with
 17 37 the effective date of the agreement to combine merged
 17 38 areas.  The bargaining shall be completed by March 15
 17 39 prior to the academic year in which the agreement to
 17 40 combine merged areas becomes effective or within one
 17 41 hundred eighty days after the organization of the
 17 42 acting board of the new combined merged area,
 17 43 whichever is later.  If a bargaining agreement was
 17 44 already concluded in the former merged area which has
 17 45 the collective bargaining agreement that is serving as
 17 46 the base agreement for the new combined merged area,
 17 47 between the former merged area board and the employees
 17 48 of the former merged area, that agreement is void,
 17 49 unless the agreement contained multiyear provisions
 17 50 affecting academic years subsequent to the effective
 18  1 date of the agreement to form a combined merged area.
 18  2 If the base collective bargaining agreement contains
 18  3 multiyear provisions, the duration and effect of the
 18  4 agreement shall be controlled by the terms of the
 18  5 agreement.  The provisions of the base agreement shall
 18  6 apply to the offering of new contracts, or the
 18  7 continuation, modification, or termination of existing
 18  8 contracts between the acting or new board of the
 18  9 combined merged area and the combined employees of the
 18 10 new combined merged area.
 18 11    Sec. 21.  Section 260C.45, unnumbered paragraph 3,
 18 12 Code 1995, is amended by striking the unnumbered
 18 13 paragraph.
 18 14    Sec. 22.  Section 260C.46, Code 1995, is amended to
 18 15 read as follows:
 18 16    260C.46  PROGRAM AND ADMINISTRATIVE SHARING.
 18 17    By September 1, 1990, the department shall
 18 18 establish guidelines and an approval process for
 18 19 program sharing agreements and for administrative
 18 20 sharing agreements entered into by two or more
 18 21 community colleges or by a community college and a
 18 22 higher education institution under the control of the
 18 23 board of regents.  Guidelines established shall be
 18 24 designed to increase student access to programs,
 18 25 enhance educational program offerings throughout the
 18 26 state, and enhance interinstitutional cooperation in
 18 27 program offerings.  A community college must submit an
 18 28 application and obtain approval from the department in
 18 29 order to become eligible to receive funds from the
 18 30 community college excellence 2000 account under
 18 31 section 260D.14A for an administrative sharing or
 18 32 program sharing agreement.  The application shall
 18 33 describe the sharing agreement, costs, and benefits
 18 34 associated with the sharing proposal.
 18 35    Sec. 23.  Section 261.12, subsection 1, paragraph
 18 36 b, Code 1995, is amended to read as follows:
 18 37    b.  For the fiscal year beginning July 1, 1989
 18 38 1995, and for each following fiscal year, two thousand
 18 39 six nine hundred fifty dollars.
 18 40    Sec. 24.  Section 261.25, subsection 1, Code 1995,
 18 41 is amended to read as follows:
 18 42    1.  There is appropriated from the general fund of
 18 43 the state to the commission for each fiscal year the
 18 44 sum of thirty-two thirty-five million four two hundred
 18 45 twenty-two thirty-eight thousand three seven hundred
 18 46 sixty-two one dollars for tuition grants.
 18 47    Sec. 25.  Section 261C.6, unnumbered paragraph 2,
 18 48 Code 1995, is amended to read as follows:
 18 49    A pupil is not eligible to enroll on a full-time
 18 50 basis in an eligible postsecondary institution and
 19  1 receive payment for all courses in which a student is
 19  2 enrolled.  If an eligible postsecondary institution is
 19  3 a community college established under chapter 260C,
 19  4 the contact hours of a pupil for which a tuition
 19  5 reimbursement amount is received are not contact hours
 19  6 eligible for general aid under chapter 260D.
 19  7    Sec. 26.  Section 294A.25, subsection 8, Code 1995,
 19  8 is amended to read as follows:
 19  9    8.  For the fiscal year beginning July 1, 1994
 19 10 1995, to the department of education from phase III
 19 11 moneys the amount of one million two hundred fifty
 19 12 thousand dollars for support for the operations of the
 19 13 new Iowa schools development corporation and for
 19 14 school transformation design and implementation
 19 15 projects administered by the corporation.  Of the
 19 16 amount provided in this subsection, one hundred fifty
 19 17 thousand dollars shall be used for the school and
 19 18 community planning initiative.
 19 19    Sec. 27.  Section 303.3, subsection 3, Code 1995,
 19 20 is amended to read as follows:
 19 21    3.  Notwithstanding section 8.33, moneys committed
 19 22 to grantees under contract that remain unexpended on
 19 23 June 30 of any fiscal year shall not revert but shall
 19 24 be available for expenditure for purposes of the
 19 25 contract program until June 30 of the succeeding
 19 26 fiscal year.
 19 27    Sec. 28.  FUNDS TRANSFERRED.
 19 28    1.  For the fiscal year beginning July 1, 1995, and
 19 29 ending June 30, 1996, the amount of $150,000 is to be
 19 30 paid to the department of education from additional
 19 31 funds transferred from phase I to phase III for
 19 32 development of a K-12 and community college management
 19 33 information system.  Notwithstanding section 294A.20,
 19 34 if the additional funds transferred from phase I to
 19 35 phase III are insufficient for purposes of the
 19 36 appropriation provided under this subsection, moneys
 19 37 allocated to phase III, which would otherwise revert
 19 38 to the general fund under section 294A.20, shall be
 19 39 transferred to the department in an amount sufficient
 19 40 to fully fund the appropriation made under this
 19 41 subsection.  The department shall submit a report to
 19 42 the legislative fiscal bureau by January 1, 1996,
 19 43 describing the specific expenditure of funds
 19 44 appropriated by the general assembly for purposes of
 19 45 the management information system; the estimated time
 19 46 of completion of the system; the department's
 19 47 accomplishments under the system; and any
 19 48 recommendations for future system funding needs.
 19 49    2.  For the fiscal year beginning July 1, 1995, and
 19 50 ending June 30, 1996, up to $50,000 from additional
 20  1 funds transferred from phase I to phase III is to be
 20  2 paid to the department of education for support of the
 20  3 Iowa mathematics and science coalition.  If funds
 20  4 available from the specified sources are insufficient
 20  5 to fully fund the appropriation, the amount
 20  6 appropriated to the department under this subsection
 20  7 shall be reduced to an amount equal to the available
 20  8 funds.
 20  9    Sec. 29.  Section 261.52A, Code 1995, is repealed.
 20 10    Sec. 30.  Chapter 260D, Code 1995, is repealed.
 20 11    Sec. 31.  Sections 2, 10, 11, 15, and 27 of this
 20 12 Act, being deemed of immediate importance, take effect
 20 13 upon enactment."
