PAG LIN 1 1 Amend House File 288 as follows: 1 2 #1. Page 1, by inserting before line 1 the 1 3 following: 1 4 "Section 1. Section 123.47B, Code 1995, is amended 1 5 to read as follows: 1 6 123.47B PARENTAL AND SCHOOL NOTIFICATION &endash; 1 7 PERSONS UNDER EIGHTEEN YEARS OF AGE. 1 8 A peace officer shall make a reasonable effort to 1 9 identify a person under the age of eighteen discovered 1 10 to be in possession of alcoholic liquor, wine, or beer 1 11 in violation of section 123.47 and if the person is 1 12 not referred to juvenile court, the law enforcement 1 13 agency of which the peace officer is an employee shall 1 14 make a reasonable attempt to notify the person's 1 15 custodial parent or legal guardian of such possession, 1 16 whether or not the person is arrested or a citation is 1 17 issued pursuant to section 805.16, unless the officer 1 18 has reasonable grounds to believe that such 1 19 notification is not in the best interests of the 1 20 person or will endanger that person. If the person is 1 21 taken into custody, the peace officer shall make a 1 22 reasonable effort to identify the elementary or 1 23 secondary school the person attends, if any, and to 1 24 notify the superintendent of the school district or 1 25 the superintendent's designee, or the authorities in 1 26 charge of the nonpublic school of the taking into 1 27 custody. A juvenile court officer may also notify the 1 28 superintendent of the school district or the 1 29 superintendent's designee, or the authorities in 1 30 charge of the nonpublic school of the taking into 1 31 custody. A reasonable attempt to notify the person 1 32 includes but is not limited to a telephone call or 1 33 notice by first class mail. 1 34 Sec. 2. Section 232.29, Code 1995, is amended by 1 35 adding the following new subsection: 1 36 NEW SUBSECTION. 3. The person performing the 1 37 duties of intake officer shall notify the 1 38 superintendent of the school district or the 1 39 superintendent's designee, or the authorities in 1 40 charge of the nonpublic school which the child 1 41 attends, of any informal adjustment regarding the 1 42 child for an act which would be an indictable offense 1 43 if committed by an adult." 1 44 #2. Title page, line 1, by inserting after the 1 45 words "relating to" the following: "juvenile justice 1 46 by providing for notification of school officials of 1 47 alcoholic beverage violations,". 1 48 #3.
