PAG LIN 1 1 Amend the amendment, H-3322, to House File 258 as 1 2 follows: 1 3 #1. Page 7, line 17, by striking the words "is 1 4 required to conduct" and inserting the following: 1 5 "must conduct at least one of". 1 6 #2. Page 7, line 20, by striking the word "must" 1 7 and inserting the following: "may". 1 8 #3. Page 7, line 24, by inserting after the word 1 9 "applicant." the following: "An employer may request 1 10 or require a particular job applicant to submit to a 1 11 substance abuse test pursuant to this subparagraph 1 12 only if that employer requests or requires the same 1 13 test of all job applicants or entering employees in 1 14 the same job category." 1 15 #4. Page 7, line 25, by striking the word "must" 1 16 and inserting the following: "may". 1 17 #5. Page 7, line 27, by striking the word "must" 1 18 and inserting the following: "may". 1 19 #6. Page 8, line 1, by inserting after the word 1 20 "employment," the following: "which accident results 1 21 in a personal injury requiring medical treatment away 1 22 from the workplace or in damage to property, including 1 23 equipment, in an amount reasonably estimated at the 1 24 time of the accident to exceed one thousand dollars". 1 25 #7. Page 8, line 2, by striking the word "must" 1 26 and inserting the following: "may". 1 27 #8. Page 11, by inserting after line 37 the 1 28 following: 1 29 "f. Notwithstanding the provisions of this 1 30 section, information on a confirmed positive substance 1 31 abuse test result may be used under any of the 1 32 following circumstances: 1 33 (1) In an arbitration or other proceeding pursuant 1 34 to a collective bargaining agreement, an 1 35 administrative hearing or proceeding under chapter 85, 1 36 96, or 216 or other applicable state or local law, or 1 37 in a judicial proceeding, provided that the 1 38 information is relevant to and concerns the specific 1 39 tested employee or applicant for employment involved 1 40 in the arbitration, hearing, or proceeding. 1 41 (2) The information may be disclosed to any 1 42 federal agency or other unit of the federal government 1 43 as required by federal law, regulation, or order, or 1 44 in accordance with compliance requirements of a 1 45 contract with the federal government. 1 46 (3) The information may be disclosed to a 1 47 substance abuse treatment facility for the purpose of 1 48 evaluation or treatment of the employee." 1 49 1 50 2 1 2 2 SIEGRIST of Pottawattamie 2 3 HF 258.511 76 2 4 ec/jw
