  1  1    Amend House File 258 as follows:
  1  2    #1.  Page 1, by inserting after line 12 the
  1  3 following:
  1  4    "c.  "Reasonable suspicion" means evidence that an
  1  5 employee is using or has used alcohol or other drugs
  1  6 in violation of the employer's policy drawn from
  1  7 specific objective and articulable facts and
  1  8 reasonable inferences drawn from those facts in light
  1  9 of experience.  Among other things, such facts and
  1 10 inferences may be based upon, but not limited to, any
  1 11 one or more of the following:
  1 12    (1)  Observable phenomena while at work such as
  1 13 direct observation of alcohol or other drug use or
  1 14 abuse or of the physical symptoms or manifestations of
  1 15 being impaired due to alcohol or other drug use.
  1 16    (2)  Abnormal conduct or erratic behavior while at
  1 17 work or a significant deterioration in work
  1 18 performance.
  1 19    (3)  A report of alcohol or other drug use provided
  1 20 by a reliable and credible source.
  1 21    (4)  Evidence that an employee has tampered with
  1 22 any substance abuse test during the course of
  1 23 employment with the current employer.
  1 24    (5)  Evidence that an employee has caused or
  1 25 contributed to an accident while at work.
  1 26    (6)  Evidence that an employee has manufactured,
  1 27 sold, distributed, solicited, possessed, used, or
  1 28 transferred drugs while working or while on the
  1 29 employer's premises or while operating in the
  1 30 employer's vehicle, machinery, or equipment."

  1 32 and inserting the following:  "suspicion".
