  1  1    Amend House File 438 as follows:
  1  2    #1.  By striking everything after the enacting
  1  3 clause and inserting the following:
  1  4    "Section 1.  Section 257.2, subsection 12, Code
  1  5 1995, is amended to read as follows:
  1  6    12.  "State percent of growth" means the percent of
  1  7 growth which is established by statute pursuant to
  1  8 section 257.8, and which is used in determining the
  1  9 allowable growth.
  1 10    Sec. 2.  Section 257.8, subsection 1, Code 1995, is
  1 11 amended to read as follows:
  1 12    1.  STATE PERCENT OF GROWTH.  The state percent of
  1 13 growth for a budget year shall be established by
  1 14 statute which shall be enacted within thirty days of
  1 15 the submission in the base year of the governor's
  1 16 budget under section 8.21.  The establishment of the
  1 17 state percent of growth for a budget year shall be the
  1 18 only subject matter of the bill which enacts the state
  1 19 percent of growth for a budget year.  However, if a
  1 20 statute to establish the state percent of growth is
  1 21 not enacted within the required thirty-day period, the
  1 22 state percent of growth is set at the percent, but not
  1 23 less than zero, by which the revenue estimating con-
  1 24 ference estimated, at its previous December meeting,
  1 25 the revenues to the general fund of the state will
  1 26 increase during the budget year over the base year.
  1 27 Any statute enacted subsequent to the thirty-day
  1 28 period set out in this subsection is null and void.
  1 29    Sec. 3.  This Act, being deemed of immediate
  1 30 importance, takes effect upon enactment and applies to
  1 31 the establishing of the state percent of growth for
  1 32 school budget years beginning after the effective date
  1 33 of this Act."
