  1  1    Amend House Joint Resolution 14 as follows:
  1  2    #1.  Page 1, line 4, by inserting after the figure
  1  3 "XIII" the following:  ", effective for the first
  1  4 state fiscal year beginning at least six months after
  1  5 the article is approved and ratified by the electorate
  1  6 except that the article shall not take effect unless
  1  7 each fund balance of the following funds is restored
  1  8 to the amount of the fund balance as of January 1,
  1  9 1991:  marine fuel tax fund; gamblers assistance fund;
  1 10 bellas hess fund; insurance trust fund; security
  1 11 deposit fund; milk fund; commercial feed fund;
  1 12 fertilizer fund; pesticide fund; energy research and
  1 13 development fund; racing commission fund; railroad
  1 14 assistance fund; dairy trade fund; vehicle salvage
  1 15 fund; odometer fraud fund; agriculture drainage wells
  1 16 fund; special railroad facility fund; aviation fund;
  1 17 public transit assistance fund; excursion boat fund;
  1 18 administration fund; alcoholic beverages fund; banking
  1 19 fund; credit union fund; insurance fund; professional
  1 20 licensing fund; savings and loan fund; and utilities
  1 21 fund".
  1 22    #2.  Page 1, line 4, by inserting after the figure
  1 23 "XIII" the following:  ", effective for the first
  1 24 state fiscal year beginning at least six months after
  1 25 the article is approved and ratified by the electorate
  1 26 except that the article shall not take effect until
  1 27 the state fiscal year following the calendar year in
  1 28 which the department of revenue and finance certifies
  1 29 to the general assembly that three-fourths of the for-
  1 30 profit corporations doing business in this state
  1 31 incurred state corporate income tax liability".
  1 32    #3.  Page 1, line 4, by inserting after the figure
  1 33 "XIII" the following:  ", effective for the first
  1 34 state fiscal year beginning at least six months after
  1 35 the article is approved and ratified by the electorate
  1 36 except that the article shall not take effect unless
  1 37 the state income tax structure is simplified by
  1 38 repealing the corporate and individual income tax
  1 39 deduction for federal income tax liability and by
  1 40 repealing the option to file separately on a joint
  1 41 return and the revenue realized by these changes is
  1 42 utilized to reduce the school foundation property tax
  1 43 levy".
  1 44    #4.  Page 1, line 4, by inserting after the figure
  1 45 "XIII" the following:  ", effective for the first
  1 46 state fiscal year beginning at least six months after
  1 47 the article is approved and ratified by the electorate
  1 48 except that the article shall not take effect for any
  1 49 one fiscal year unless the basis for establishing the
  1 50 maximum medical assistance reimbursement rate for
  2  1 nursing facilities for that fiscal year is set at the
  2  2 ninety-eighth percentile of facilities' cost as
  2  3 calculated from the unaudited compilation of cost and
  2  4 statistical data from the previous fiscal year".
  2  5    #5.  Page 1, line 6, by striking the word "RIGHTS"
  2  6 and inserting the following:  "PROTECTION".
  2  7    #6.  Page 1, line 7, by inserting after the words
  2  8 "local government" the following:  ",excluding school
  2  9 corporations,".
  2 10    #7.  Page 1, line 11, by inserting after the word
  2 11 "years" the following:  ", and the total revenue limit
  2 12 includes a revenue limit on revenues from the motor
  2 13 fuel tax and the special fuel tax to the extent that
  2 14 these taxes shall not be higher than the lowest such
  2 15 tax in any adjacent state and if in excess of that
  2 16 level when this amendment takes effect, they shall be
  2 17 kept at the level existing when this amendment takes
  2 18 effect until the adjacent state with the lowest level
  2 19 raises such taxes".
  2 20    #8.  Page 1, line 17, by inserting after the word
  2 21 "date." the following:  "In addition, the total
  2 22 revenue limit is adjusted by the inclusion of an
  2 23 amount for each fiscal year equal to the annual amount
  2 24 for the relevant fiscal year committed by the state
  2 25 government to the funding of correctional services."
  2 26    #9.  Page 1, line 17, by inserting after the word
  2 27 "date." the following:  "In addition, the total
  2 28 revenue limit is adjusted by the inclusion of an
  2 29 amount for each fiscal year equal to the annual amount
  2 30 for the relevant fiscal year committed by the state
  2 31 government to the funding of the construction of
  2 32 additional prison cells to house persons convicted of
  2 33 the sale and distribution of an illegal substance."

  2 35 "date." the following:  "In addition, the total
  2 36 revenue limit is adjusted by the inclusion of an
  2 37 amount for each fiscal year equal to the annual amount
  2 38 for the relevant fiscal year committed by the state

  2 40 additional prison cells to house persons convicted of
  2 41 a third offense of operating a motor vehicle while
  2 42 intoxicated."
  2 43    #11.  Page 1, line 17, by inserting after the word
  2 44 "date." the following:  "In addition, the total
  2 45 revenue limit is adjusted by the inclusion of an
  2 46 amount for each fiscal year equal to the annual amount
  2 47 for the relevant fiscal year committed by the state

  2 49 additional prison beds to ease prison overcrowding and
  2 50 to reduce the number of high-risk offenders placed on
  3  1 probation or parole."

  7 18 local governments which consolidate after the
  7 19 effective date of this amendment shall not be subject
  7 20 to the revenue and spending limitations established in
  7 21 this amendment unless the ballot proposing
  7 22 consolidation is approved by at least sixty percent of
  7 23 the total vote cast at the election."

  7 27    "Sec.    .  The following amendment to the state of
  7 28 Iowa is proposed:
  7 29    Article VII of the Constitution of the State of
  7 30 Iowa is amended by adding the following new sections:
  7 31    FISH PROTECTION FUND.  Sec. 9.  The revenue from
  7 32 all license fees from fishing activities and excise
  7 33 taxes from fishing, and any public or private funds
  7 34 appropriated, allocated, or given for fish protection
  7 35 purposes, shall be used exclusively for activities
  7 36 related to the propagation, management, harvest, and
  7 37 protection of fish resources.
  7 38    BRUCELLOSIS ERADICATION FUND.  Sec. 10.  The
  7 39 revenue from all permits and fees and penalties, and
  7 40 any public or private funds appropriated, allocated,
  7 41 or given for bovine and swine brucellosis eradication
  7 42 purposes, shall be used exclusively for activities
  7 43 related to the eradication of bovine and swine
  7 44 brucellosis.
  7 45    SNOWMOBILE AND ALL-TERRAIN VEHICLE FUND.  Sec. 11.
  7 46 The revenue from all registration, permit, and other
  7 47 fees, fines, and penalties, and any public or private
  7 48 funds appropriated or allocated, or given for
  7 49 snowmobile and all-terrain vehicle programs in the
  7 50 state shall be used exclusively for snowmobile and
  8  1 all-terrain vehicle programs in the state.  All-
  8  2 terrain vehicle fees, fines, and penalties shall be
  8  3 used only for all-terrain vehicle programs and
  8  4 snowmobile fees, fines, and penalties shall be used
  8  5 only for snowmobile programs.  Joint programs shall be
  8  6 supported from both types of fees on a usage basis.
  8  7 At least fifty percent of the special fund shall be
  8  8 available for political subdivisions or incorporated
  8  9 private organizations or both.
  8 10    BOAT FUND.  Sec. 12.  The revenue from all
  8 11 registration, permit, and other fees, fines, and
  8 12 penalties and any public or private funds appropriated
  8 13 or allocated, or given for boating programs in the
  8 14 state shall be used exclusively for programs to
  8 15 promote safety for persons and property in and
  8 16 connected with the use, operation, and equipment of
  8 17 vessels and to promote uniformity of laws relating to
  8 18 vessels.
  8 19    GROUNDWATER PROTECTION FUND.  Sec. 13.  The
  8 20 revenue, including fees, fines, and penalties,
  8 21 received from sources designated for purposes related
  8 22 to groundwater monitoring and groundwater quality
  8 23 standards and any public or private funds appropriated
  8 24 or allocated shall be used exclusively to establish a
  8 25 groundwater protection fund to provide for projects
  8 26 and programs related to abating and eliminating the
  8 27 threat of contamination of the state's groundwater."
  8 28    #62.  Page 4, by inserting before line 29 the
  8 29 following:
  8 30    "Sec.    .  The following amendment to the
  8 31 Constitution of the State of Iowa is proposed:
  8 32    Section 1 of Article X of the Constitution of the
  8 33 State of Iowa is repealed beginning with the general
  8 34 election in the year 1998, and the following adopted
  8 35 in lieu thereof:
  8 36    HOW PROPOSED &endash; SUBMISSION.  Section 1.  Any
  8 37 amendment or amendments to this Constitution may be
  8 38 proposed in either House of the General Assembly; and
  8 39 if the same shall be agreed to by a majority of the
  8 40 members elected to each of the two houses, such
  8 41 proposed amendment shall be entered on their journals,
  8 42 with the yeas and nays taken thereon, and referred to
  8 43 the Legislature to be chosen at the next general
  8 44 election, and shall be published, as provided by law,
  8 45 for three months previous to the time of making such
  8 46 choice; and if, in the General Assembly so next chosen
  8 47 as aforesaid, such proposed amendment or amendments
  8 48 shall be agreed to, by a majority of all the members
  8 49 elected to each House, then it shall be the duty of
  8 50 the General Assembly to submit such proposed amendment
  9  1 or amendments to the people, in such manner, and at
  9  2 such time as the General Assembly shall provide; and
  9  3 if the people shall approve and ratify such amendment
  9  4 or amendments, by at least sixty percent of the
  9  5 electors qualified to vote for members of the General
  9  6 Assembly, voting thereon, such amendment or amendments
  9  7 shall become a part of the Constitution of this
  9  8 State."
  9  9    #63.  Page 6, line 9, by striking the word
  9 10 "amendment" and inserting the following:
  9 11 "amendments".
  9 12    #64.  Page 6, line 10, by striking the word "is"
  9 13 and inserting the following:  "are".
