PAG LIN 1 1 Amend House Joint Resolution 14 as follows: 1 2 #1. Page 1, by striking lines 10 through 22, and 1 3 inserting the following: "equal to its total revenue 1 4 in the base year, adjusted for the cumulative 1 5 percentage rate of price inflation or deflation since 1 6 the base year, and for any cumulative percentage 1 7 population increase since the base year. A school 1 8 district's "population" is its full-time equivalent 1 9 student enrollment. The "base year" is the last 1 10 fiscal year before this Article becomes". 1 11 #2. Page 1, by striking lines 25 through 32, and 1 12 inserting the following: 1 13 "SEC. 2. "Revenue" includes all amounts received 1 14 from all sources, except (1) amounts lawfully refunded 1 15 to the payors; (2) gifts from nongovernmental sources; 1 16 (3) federal research grants and contracts; (4) federal 1 17 disaster aid; (5) all receipts of a local government 1 18 enterprise which was operating in the base year and 1 19 receives no tax revenue; (6) amounts borrowed 1 20 lawfully, but this does not authorize any borrowing; 1 21 and (7) receipts applied to pay principal and interest 1 22 on bonds approved by vote of the electors, bonds 1 23 outstanding when this article become effective, and 1 24 revenue bonds on which no payment can be made from tax 1 25 revenue." 1 26 #3. Page 2, by striking lines 14 through 16, and 1 27 inserting the following: "or applied as tax credits 1 28 against local taxes." 1 29 #4. Page 2, by striking lines 22 through 27, and 1 30 inserting the following: "government's electors 1 31 voting in a referendum." 1 32 #5. Page 3, by striking line 5, and inserting the 1 33 following: "shall not exceed the sum". 1 34 #6. Page 3, by striking lines 7 through 20, and 1 35 inserting the following: "change under section 4, 5, 1 36 or 6, and (2) net unspent funds carried over from the 1 37 preceding year, but excluding trust funds for 1 38 unemployment, retirement, medical, or other benefits. 1 39 "Spending" includes payments into, and excludes 1 40 payments out of, these trust funds. "Spending" 1 41 includes all other outlays, except that amounts 1 42 excluded from revenue are also excluded from 1 43 spending." 1 44 #7. Page 3, line 22, by striking the word "date" 1 45 and inserting the following: "year". 1 46 #8. Page 3, by striking lines 32 and 33, and 1 47 inserting the following: 1 48 "SEC. 11. If a state law or rule adopted after 1 49 this Article becomes". 1 50 #9. Page 4, by striking lines 3 through 5, and 2 1 inserting the following: "by that amount." 2 2 #10. Page 4, by striking lines 11 through 22, and 2 3 inserting the following: 2 4 "SEC. . Any taxpayer has standing to sue to 2 5 enforce this Article and laws implementing it. If 2 6 successful, the taxpayer shall be reimbursed for all 2 7 reasonable expenses of the suit." 2 8 #11. Page 4, line 25, by striking the words "and 2 9 ratification". 2 10 #12. Page 4, by striking lines 26 through 28, and 2 11 inserting the following: "shall implement this 2 12 Article, adopt further restrictions and limits, and 2 13 shall require consistent accounting for all 2 14 governments in accordance with generally accepted 2 15 accounting principles." 2 16 #13. Page 4, line 35, by striking the words "does 2 17 not authorize any borrowing and". 2 18 #14. Page 5, by striking lines 2 through 17, and 2 19 inserting the following: "VII. 2 20 3. To make the adjustment for price inflation or 2 21 deflation, the most reliable index of general price 2 22 inflation in the United States shall be selected in 2 23 good faith as provided by law. The selection of index 2 24 shall not be changed if the change would have the 2 25 effect of weakening the limits." 2 26 #15. Page 5, by striking lines 22 through 24, and 2 27 inserting the following: 2 28 "4. "Revenue" includes, but is not limited to, all 2 29 taxes, fees, charges, assessments, receipts from the 2 30 federal government, and other receipts of the state 2 31 and local governments, except amounts expressly 2 32 excluded by section 2 or 3 of Article XIII. Amounts 2 33 transferred between governments are counted only 2 34 once." 2 35 #16. By striking page 5, line 29 through page 6, 2 36 line 2, and inserting the following: "included with 2 37 county governments. "Local government enterprise" 2 38 includes but is not limited to a hospital, airport, 2 39 transportation system, recreation facility, or public 2 40 utility owned or operated by a local government." 2 41 #17. Page 6, by striking lines 6 through 8 and 2 42 inserting the following: "Article XIII." 2 43 #18. Title page, by striking lines 3 through 6, 2 44 and inserting the following: "by limiting taxes, 2 45 revenue, and spending of the state and local 2 46 governments." 2 47 #19.
