1 1 Amend the amendment, H-3030, to Senate File 69, as
1 2 passed by the Senate, as follows:
1 3 #1. Page 4, by inserting before line 35 the
1 4 following:
1 5 "Sec. 100. Section 422.7, Code 1995, is amended by
1 6 adding the following new subsection:
1 7 NEW SUBSECTION. 32. For a person who is disabled,
1 8 or is fifty-five years of age or older, or is the
1 9 surviving spouse of an individual or a survivor having
1 10 an insurable interest in an individual who would have
1 11 qualified for the exemption under this subsection for
1 12 the tax year, subtract, to the extent included, the
1 13 total amount of a governmental or other pension,
1 14 retirement pay, annuity, or other similar periodic
1 15 payment made under a plan maintained or contributed to
1 16 by an employer, or maintained or contributed to by a
1 17 self-employed person as an employer, up to a maximum
1 18 of seven thousand five hundred dollars for a person
1 19 who files a separate state income tax return, and up
1 20 to a maximum of fifteen thousand dollars for a husband
1 21 and wife who file a joint state income tax return.
1 22 However, a surviving spouse who is not disabled or
1 23 fifty-five years of age or older can only exclude the
1 24 amount of annuities or other similar periodic payments
1 25 received as a result of the death of the other
1 26 spouse."
1 27 #2. Page 4, by inserting after line 46 the
1 28 following:
1 29 "Sec. . APPLICABILITY. Section 100 of this Act
1 30 applies retroactively to January 1, 1995, for tax
1 31 years beginning on or after that date."
