  1  1    Amend House File 126 as follows:
  1  2    #1.  Page 1, line 23, by inserting after the word
  1  3 "franchise" the following:  ", unless the bona fide
  1  4 offer is received from a person who satisfies all of
  1  5 the following:
  1  6    a.  The person was an existing partner, approved by
  1  7 the franchisor, in the franchise for which the offer
  1  8 is made at the time of the death or permanent
  1  9 incapacity of the franchisee.
  1 10    b.  The person remained a partner in the franchise
  1 11 for which the offer is made until the time of the sale
  1 12 or transfer of the franchise.
  1 13    c.  The person meets the current qualifications of
  1 14 the franchisor for new franchisees at the time of the
  1 15 sale or transfer of the franchise".
