  Notwithstanding 2017 Iowa Acts, chapter 168, section
722, as amended by 2017 Iowa Acts, chapter 170, section 42,
8of the moneys credited to the watershed improvement fund
9that are unencumbered or unobligated and managed by and
10otherwise appropriated to the department of agriculture and
11land stewardship pursuant to those sections, the department
12shall expend the following amount, or so much thereof as is
13necessary, for the fiscal year beginning July 1, 2018, and
14ending June 30, 2019, for the purpose designated:

30the public purpose of providing a grant to a national nonprofit
31organization with over 80 years of experience in assisting
32children and adults with disabilities and special needs. The
33moneys shall be used to support a nationally recognized program
34that began in 1986 and has been replicated in at least 30 other
35states, but which is not available through any other entity
-5-1in this state, and that provides assistance to farmers with
2disabilities in all 99 counties to allow the farmers to remain
3in their own homes and be gainfully engaged in farming through
4provision of agricultural worksite and home modification
5consultations, peer support services, services to families,
6information and referral, and equipment loan services.
   73.  Notwithstanding section 8.33, moneys appropriated in
8this section that remain unencumbered or unobligated at the
9close of the fiscal year shall not revert but shall remain
10available for expenditure for the purposes designated until the
11close of the succeeding fiscal year.
12   Sec. 9.  2017 Iowa Acts, chapter 168, is amended by adding
13the following new section:
14   NEW SECTION.  SEC. 42A.  FOREIGN ANIMAL DISEASES AFFLICTING
15LIVESTOCK.
  There is appropriated from the general fund of the
16state to the department of agriculture and land stewardship for
17the fiscal year beginning July 1, 2018, and ending June 30,

   301.  There is appropriated from the general fund of the state
31to the department of agriculture and land stewardship for the
32fiscal year beginning July 1, 2018, and ending June 30, 2019,
33the following amount, or so much thereof as is necessary, to be
34used for the purposes designated:

2initiative administered by the division of soil conservation

8used to support projects in subwatersheds as designated by the
9division that are part of high-priority watersheds identified
10by the water resources coordinating council established

13support projects in watersheds generally, including regional
14watersheds, as designated by the division and high-priority
15watersheds identified by the water resources coordinating
16council established pursuant to section 466B.3.
   173.  In supporting projects in subwatersheds and watersheds
18as provided in subsection 2, all of the following shall apply:
   19a.  The demonstration projects shall utilize water quality
20practices as described in the latest revision of the document
21entitled “Iowa Nutrient Reduction Strategy” initially presented
22in November 2012 by the department of agriculture and land
23stewardship, the department of natural resources, and Iowa
24state university of science and technology

26by 2018 Iowa Acts, Senate File 512, section 18
.
   27b.  The division shall implement demonstration projects as
28provided in paragraph “a” by providing for participation by
29persons who hold a legal interest in agricultural land used in
30farming. To every extent practical, the division shall provide
31for collaborative participation by such persons who hold a
32legal interest in agricultural land located within the same
33subwatershed.
   34c.  The division shall implement a demonstration project on
35a cost-share basis as determined by the division. However,
-7-1except for edge-of-field practices, the state’s share of the
2amount shall not exceed 50 percent of the estimated cost of
3establishing the practice as determined by the division or
450 percent of the actual cost of establishing the practice,
5whichever is less.
   6d.  The demonstration projects shall be used to educate other
7persons about the feasibility and value of establishing similar
8water quality practices. The division shall promote field day
9events for purposes of allowing interested persons to establish
10water quality practices on their agricultural land.
   11e.  The division shall conduct water quality evaluations
12within supported subwatersheds. Within a reasonable period
13after accumulating information from such evaluations, the
14division shall create an aggregated database of water quality
15practices. Any information identifying a person holding a
16legal interest in agricultural land or specific agricultural
17land shall be a confidential record under section 22.7.
   184.  The moneys appropriated in subsection 1 shall be used
19to support education and outreach in a manner that encourages
20persons who hold a legal interest in agricultural land used for
21farming to implement water quality practices, including the
22establishment of such practices in watersheds generally, and
23not limited to subwatersheds or high-priority watersheds.
   245.  The moneys appropriated in subsection 1 may be used
25to contract with persons to coordinate the implementation of
26efforts provided in this section.
   276.  The moneys appropriated in subsection 1 may be used by
28the department to support urban soil and water conservation
29efforts, which may include but are not limited to management
30practices related to bioretention, landscaping, the use of
31permeable or pervious pavement, and soil quality restoration.
32The moneys shall be allocated on a cost-share basis as provided
33in chapter 161A.
   347.  Notwithstanding any other provision of law to the
35contrary, the department may use moneys appropriated in
-8-1subsection 1 to carry out the provisions of this section on a
2cost-share basis in combination with other moneys available to
3the department from a state or federal source.
   48.  Not more than 10 percent of the moneys appropriated in
5this section may be used to pay for the costs of administering
6and implementing the water quality initiative by the
7department’s division of soil conservation and water quality as
8provided in section 466B.42 and this section.

   333.  Notwithstanding section 455A.10, the department of
34natural resources may use the unappropriated balance remaining
35in the state fish and game protection fund for the fiscal

31161A.73.
   32g.  The state soil conservation and water quality committee
33established by section 161A.4 may allocate moneys appropriated
34in paragraph “c” to conduct research and demonstration projects
35to promote conservation tillage and nonpoint source pollution

   2h.  The allocation of moneys as financial incentives as
3provided in section 161A.73 may be used in combination with

   23a.  The demonstration projects shall utilize water quality
24practices as described in the latest revision of the document
25entitled “Iowa Nutrient Reduction Strategy” initially presented
26in November 2012 by the department of agriculture and land
27stewardship, the department of natural resources, and Iowa
28state university of science and technology

   31b.  The division shall implement demonstration projects as
32provided in paragraph “a” by providing for participation by
33persons who hold a legal interest in agricultural land used in
34farming. To every extent practical, the division shall provide
35for collaborative participation by such persons who hold a
-21-1legal interest in agricultural land located within the same
2subwatershed.
   3c.  The division shall implement a demonstration project on
4a cost-share basis as determined by the division. However,
5except for edge-of-field practices, the state’s share of the
6amount shall not exceed 50 percent of the estimated cost of
7establishing the practice as determined by the division or
850 percent of the actual cost of establishing the practice,
9whichever is less.
   10d.  The demonstration projects shall be used to educate other
11persons about the feasibility and value of establishing similar
12water quality practices. The division shall promote field day
13events for purposes of allowing interested persons to establish
14water quality practices on their agricultural land.
   15e.  The division shall conduct water quality evaluations
16within supported subwatersheds. Within a reasonable period
17after accumulating information from such evaluations, the
18division shall create an aggregated database of water quality
19practices. Any information identifying a person holding a
20legal interest in agricultural land or specific agricultural
21land shall be a confidential record under section 22.7.
   224.  The moneys appropriated in subsection 1 shall be used
23to support education and outreach in a manner that encourages
24persons who hold a legal interest in agricultural land used for
25farming to implement water quality practices, including the
26establishment of such practices in watersheds generally, and
27not limited to subwatersheds or high-priority watersheds.
   285.  The moneys appropriated in subsection 1 may be used
29to contract with persons to coordinate the implementation of
30efforts provided in this section.
   316.  The moneys appropriated in subsection 1 may be used by
32the department to support urban soil and water conservation
33efforts, which may include but are not limited to management
34practices related to bioretention, landscaping, the use of
35permeable or pervious pavement, and soil quality restoration.
-22-1The moneys shall be allocated on a cost-share basis as provided
2in chapter 161A.
   37.  Notwithstanding any other provision of law to the
4contrary, the department may use moneys appropriated in
5subsection 1 to carry out the provisions of this section on a
6cost-share basis in combination with other moneys available to
7the department from a state or federal source.
   88.  Not more than 10 percent of the moneys appropriated in
9this section may be used to pay for the costs of administering
10and implementing the water quality initiative by the
11department’s division of soil conservation and water quality as
12provided in section 466B.42 and this section.

14IOWA RESOURCES ENHANCEMENT AND PROTECTION (reap) FUND

16be used by the department of natural resources for state park
17maintenance and repair for the fiscal year beginning July 1,
182018, and ending on June 30, 2019.

20IOWA CODE CHANGES
21   Sec. 26.  NEW SECTION.  455B.262B  Cooperation with the state
22geologist.
   23The department may request and shall receive assistance from
24the state geologist pursuant to section 456.14 to allow for the
25allocation and use of water resources, and the preclusion of
26conflicts among users of water resources, as provided in this
27part.
28   Sec. 27.  NEW SECTION.  456.14  Water resource management.
   291.  The state geologist shall maintain historical data,
30collect existing data, and compile new data regarding water
31resources, including surface water sources and groundwater
32sources, and geological formations that impact upon those water
33resources. Such data shall be managed in a manner that allows
34it to be made available for use by the department of natural
35resources and the public.

   12.  The state geologist shall measure, assess, and evaluate
2groundwater sources and subsurface geological formations in
3a manner that assists the department of natural resources in
4optimizing allocations and uses of groundwater sources in
5this state, including as provided in chapter 455B, division
6III, part 4. The state geologist may use data described in
7subsection 1 to measure, assess, and evaluate all of the
8following:
   9a.  The sustainability and existing or potential
10vulnerabilities of groundwater sources.
   11b.  The risk, prediction, or indication of drought, the
12impacts of drought, and the presence, intensity, or duration
13of drought conditions.
   14c.  Subsurface geologic hazards to groundwater resources.
   15d.  The recharge of groundwater sources, including recharge
16rates.
   17e.  The presence of reserves of groundwater sources.
   18f.  The potential of groundwater sources present in
19subsurface geologic formations.
   203.  The state geologist shall develop and use management
21tools, computer programming, or modeling as necessary or
22convenient to administer this section.
   234.  The state geologist shall prepare, use, and make
24available maps or other methods of presentation that provide
25for the geospatial visualization of data described in
26subsection 1 as necessary or convenient to administer this
27section.
   285.  Upon request by the department of natural resources, the
29state geologist shall assist the department in regulating water
30quantity from water resources as provided in section 455B.262B.
31EXPLANATION
32The inclusion of this explanation does not constitute agreement with
33the explanation’s substance by the members of the general assembly.
   34GENERAL. This bill relates to agriculture and natural
35resources by making appropriations for the fiscal year
-25-1beginning July 1, 2018, and ending June 30, 2019, to support
2related entities, including the department of agriculture and
3land stewardship (DALS), the department of natural resources
4(DNR), Iowa state university of science and technology (ISU),
5and the state university of Iowa (UI).
   6The bill primarily appropriates moneys to DALS and DNR.
7 The appropriations are made to support those departments
8for administration, regulation, and enforcement of certain
9programs. The bill requires the departments to submit
10quarterly reports to the general assembly and department of
11management regarding the expenditure of appropriated moneys.
12The bill also provides moneys to support specific programs
13or projects administered by those departments. The bill
14appropriates moneys from a number of sources, including the
15general fund of the state (general fund), including a number
16of major funds, including the state fish and game protection
17fund (Code section 456A.17), the groundwater protection fund
18(Code section 455E.11), and the environment first fund (EFF)
19(Code section 8.57A). The bill also appropriates moneys from
20a number of other sources, including unclaimed pari-mutuel
21wagering winnings (Code section 99D.13), the renewable fuel
22infrastructure fund (Code section 159A.16), the special
23snowmobile fund (Code section 321G.7), and the unassigned
24revenue fund (uncodified). The bill is organized into
25divisions.
   26DALS — GENERAL FUND APPROPRIATION. For DALS, the bill
27appropriates moneys from the general fund in order to support
28its administrative divisions, including consumer protection
29and industry services, soil conservation, and food safety and
30animal health. Moneys are transferred to ISU to support its
31midwest grape and wine institute.
   32DALS — MISCELLANEOUS SOURCES — DESIGNATED APPROPRIATIONS.
33 The bill appropriates moneys to DALS from several sources in
34order to support a number of designated purposes, including
35moneys derived from unclaimed winnings from horse and
-26-1dog races, for administration and enforcement of racing
2regulations; and moneys credited to the renewable fuel
3infrastructure fund for purposes of motor fuel inspection
4and auditing biofuel processing and production. The bill
5also requires DALS to expend remaining moneys credited to the
6watershed improvement fund to support the continuation of a
7statewide voluntary farm management demonstration program to
8demonstrate the effectiveness and adaptability of emerging
9practices in agronomy that protect water resources and provide
10other environmental benefits. The fund had been used to
11support watershed improvement grants under Code chapter 466A
12prior to its repeal and DALS is required to manage the moneys
13until expended.
   14DALS — SPECIAL GENERAL FUND APPROPRIATIONS. The bill
15makes special appropriations from the general fund to DALS in
16order to support specific purposes including milk inspection,
17the local food and farm program, an agricultural education
18organization, and assistance to farmers with disabilities. The
19bill also appropriates moneys to DALS for deposit in the animal
20disease preparedness and response fund (Code section 163.3B).
   21DALS — GENERAL FUND APPROPRIATIONS — WATER QUALITY
22INITIATIVE (WQI). The bill appropriates moneys from the
23general fund to DALS for deposit in the water quality
24initiative fund (Code section 466B.45) to support the WQI,
25including high-priority watershed projects.
   26DNR — GENERAL FUND AND OTHER MAJOR FUNDS APPROPRIATIONS.
27 The bill makes appropriations from the general fund and several
28major funds to DNR in order to support its administrative
29divisions involving natural resources and environmental
30protection including moneys credited to the state fish and
31game protection fund and moneys credited to the groundwater
32protection fund that are not otherwise statutorily allocated.
   33DNR — MISCELLANEOUS SOURCES — DESIGNATED APPROPRIATIONS.
34 The bill appropriates moneys to DNR from a number of sources
35to support designated purposes, including moneys deposited in
-27-1the special snowmobile fund to provide for administering and
2enforcing the state snowmobile programs; and moneys deposited
3in the unassigned revenue fund for purposes of paying for
4administration of DNR’s underground storage tanks section.
   5DNR — SPECIAL GENERAL FUND APPROPRIATIONS. The bill also
6makes special appropriations from the general fund to DNR
7in order to support specific purposes including floodplain
8management and dam safety and forestry health management
9programs.
   10ISU — SPECIAL GENERAL FUND APPROPRIATION. The bill
11appropriates moneys from the general fund to ISU to support the
12operation of the veterinary diagnostic laboratory operated by
13the college of veterinary medicine.
   14DALS, DNR, AND UI — EFF GENERAL APPROPRIATIONS. The
15bill appropriates moneys from the EFF to support a number
16of programs administered by DALS and DNR. For DALS, the
17moneys are appropriated to support programs involving soil
18conservation, watershed protection and nutrient management,
19and the loess hills development and conservation fund. For
20DNR, moneys are appropriated to support programs involving
21state parks, geographic information systems, water quality
22monitoring, public water supplies, regulation of animal feeding
23operations, air quality, and floodplain management and dam
24safety. The bill also appropriates moneys from EFF to UI to
25support the geological and water survey for its operations and
26to measure, assess, and evaluate water quantity sources and
27assist DNR in regulating water quantity.
   28DALS — EFF SPECIAL WQI APPROPRIATION. The bill
29appropriates additional moneys from the EFF to the water
30quality initiative fund to support the WQI administered by
31DALS, subject to the same conditions applicable to moneys
32appropriated to that fund from the general fund.
   33IOWA RESOURCES ENHANCEMENT AND PROTECTION (REAP) FUND —
34SPECIAL PROVISIONS. The bill also appropriates moneys from
35the EFF to the REAP fund in lieu of the $20 million standing
-28-1limited appropriation from the general fund (Code section
2455A.18). The bill appropriates moneys from the REAP fund to
3DNR to support the regular maintenance and operations of state
4parks and staff prior to allocations made from the fund. DNR
5is also authorized to use moneys allocated to the fund’s open
6spaces account for state park maintenance and repair.
   7IOWA CODE CHANGES. The bill provides that DNR request
8cooperation with the state geologist and requires the state
9geologist to maintain, collect, and compile data regarding
10water resources, including surface water sources and
11groundwater sources, and geological formations that impact upon
12those water resources. The state geologist is also required
13to measure, assess, and evaluate groundwater sources and
14subsurface geological formations in a manner that assists DNR
15in optimizing allocations and uses of groundwater sources in
