8EXPLANATION
9The inclusion of this explanation does not constitute agreement with
10the explanation’s substance by the members of the general assembly.
11This bill relates to energy conservation requirements
12contained within the state building code or adopted by
13governmental subdivisions.
   14Code section 103A.8A requires new single-family or
15two-family residential construction commenced on or after
16July 1, 2008, to comply with energy conservation requirements
17adopted by the state building code commissioner and approved
18by the state building code advisory council. The energy
19conservation requirements adopted by the commissioner and
20approved by the council supersede and replace any minimum
21energy conservation requirements adopted by a governmental
22subdivision.
23The bill amends Code section 103A.8A to provide that the
24energy conservation requirements shall be adopted by the
25commissioner and approved by the council no later than July
261, 2018, and shall be based upon the 2018 edition of the
27international energy conservation code. In approving the
28requirements, the council may make modifications by a majority
29vote of the members. The bill provides that new residential
30construction commenced on or after July 1, 2018, shall comply
31with the energy conservation requirements, extending the
32applicability of such requirements to any type of residential
33building.
34The bill removes language from Code section 103A.8A that
35provides that the energy conservation requirements adopted by
-2-1the commissioner and approved by the council are to supersede
2any minimum requirements adopted by a governmental subdivision.
3The bill makes conforming changes consistent with this
4modification in Code section 103A.10(5).
5The bill provides that a governmental subdivision may, no
6later than December 21, 2018, adopt minimum energy conservation
7requirements for residential construction that are not less
8restrictive than the minimum energy conservation requirements
9adopted by the commissioner and approved by the council. If
10a governmental subdivision adopts such minimum requirements,
11then applicable residential construction must comply with the
12requirements adopted by the governmental subdivision.
13The bill takes effect upon enactment.
