Senate Study Bill 3138 - IntroducedA Bill ForAn Act 1relating to energy conservation requirements contained
2within the state building code or adopted by governmental
3subdivisions, and including effective date provisions.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 103A.8A, Code 2018, is amended to read
2as follows:
   3103A.8A  Energy conservation requirements.
   41.   a.  The state building code commissioner shall adopt
5as a part of the state building code a requirement that
6new single-family or two-family residential construction
7shall comply with energy conservation requirements. The
8requirements shall be adopted by the commissioner and approved
9by the council no later than July 1, 2018, and
shall be
10based upon a nationally recognized standard or code for
11energy conservation. The requirements shall only apply to
12single-family or two-family residential construction commenced
13after the adoption of the requirements
 the international
14energy conservation code, 2018 edition
In approving the
15requirements, the council may make modifications to such
16requirements as the council deems necessary by a majority vote
17of the members.

   18b.  Notwithstanding any other provision of this chapter to
19the contrary, the energy conservation requirements adopted
20by the commissioner and approved by the council pursuant to
21paragraph “a”
shall apply to new all single-family or two-family
22residential construction commenced on or after July 1, 2008,
23and shall supersede and replace any minimum requirements for
24energy conservation adopted or enacted by a governmental
25subdivision prior to that date applicable to such construction
26
 2018. The state building code commissioner may provide
27training to builders, contractors, and other interested persons
28on the adopted energy conservation requirements.
   292.  Notwithstanding subsection 1, a governmental subdivision
30may, no later than December 21, 2018, adopt minimum energy
31conservation requirements applicable to residential
32construction described in subsection 1 that are not less
33restrictive than the minimum energy conservation requirements
34adopted by the commissioner and approved by the council.
35If adopted, such requirements shall apply to residential
-1-1construction within the governmental subdivision in lieu of the
2energy conservation requirements adopted by the commissioner
3and approved by the council.
4   Sec. 2.  Section 103A.10, subsection 5, Code 2018, is amended
5by striking the subsection.
6   Sec. 3.  EFFECTIVE DATE.  This Act, being deemed of immediate
7importance, takes effect upon enactment.
8EXPLANATION
9The inclusion of this explanation does not constitute agreement with
10the explanation’s substance by the members of the general assembly.
   11This bill relates to energy conservation requirements
12contained within the state building code or adopted by
13governmental subdivisions.
   14Code section 103A.8A requires new single-family or
15two-family residential construction commenced on or after
16July 1, 2008, to comply with energy conservation requirements
17adopted by the state building code commissioner and approved by
18the state building code advisory council. “New construction”,
19as defined in Code chapter 103A, is expressly made inapplicable
20to building renovations and repairs. The energy conservation
21requirements adopted by the commissioner and approved by the
22council supersede and replace any minimum energy conservation
23requirements adopted by a governmental subdivision.
   24The bill amends Code section 103A.8A to provide that the
25energy conservation requirements shall be adopted by the
26commissioner and approved by the council no later than July
271, 2018, and shall be based upon the 2018 edition of the
28international energy conservation code. In approving the
29requirements, the council may make modifications by a majority
30vote of the members. The bill provides that all single-family
31or two-family residential construction commenced on or after
32July 1, 2018, shall comply with the energy conservation
33requirements, extending the requirements to existing residence
34renovations and repairs.
   35The bill removes language from Code section 103A.8A that
-2-1provides that the energy conservation requirements adopted by
2the commissioner and approved by the council are to supersede
3any minimum requirements adopted by a governmental subdivision.
4The bill makes conforming changes consistent with this
5modification in Code section 103A.10(5).
   6The bill provides that a governmental subdivision may, no
7later than December 21, 2018, adopt minimum energy conservation
8requirements for residential construction that are not less
9restrictive than the minimum energy conservation requirements
10adopted by the commissioner and approved by the council. If
11a governmental subdivision adopts such minimum requirements,
12then applicable residential construction must comply with the
13requirements adopted by the governmental subdivision.
   14The bill takes effect upon enactment.
