5BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 20.3, subsection 11, Code 2018, is
2amended by adding the following new paragraph:
3   NEW PARAGRAPH.  g.  An employee of the department of
4corrections.
5   Sec. 2.  EMERGENCY RULES.  The public employment relations
6board may adopt emergency rules under section 17A.4, subsection
73, and section 17A.5, subsection 2, paragraph “b”, to implement
8the provisions of this Act and the rules shall be effective
9immediately upon filing unless a later date is specified in the
10rules. Any rules adopted in accordance with this section shall
11also be published as a notice of intended action as provided
12in section 17A.4.
13   Sec. 3.  EFFECTIVE DATE.  This Act, being deemed of immediate
14importance, takes effect upon enactment.
15   Sec. 4.  APPLICABILITY.  This Act applies to collective
16bargaining procedures pursuant to chapter 20 initiated on or
17after the effective date of this Act.
18EXPLANATION
19The inclusion of this explanation does not constitute agreement with
20the explanation’s substance by the members of the general assembly.
   21This bill designates employees of the department of
22corrections as public safety employees for the purposes of
23collective bargaining pursuant to Code chapter 20, the public
24employment relations Act. Code chapter 20 and Code chapter
25400 include collective bargaining procedures specifically
26applicable to public safety employees that are not applicable
27to other public employees, including procedures relating to
28the scope of collective bargaining negotiations, arbitration
29procedures, and certain matters relating to city civil service
30employment.
   31The bill takes effect upon enactment and applies to
32collective bargaining procedures pursuant to Code chapter 20
33initiated on or after the effective date of the bill.
