House Study Bill 517 - IntroducedA Bill ForAn Act 1relating to access to certain child abuse and dependent

3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 235A.15, subsection 2, paragraph e, Code
22018, is amended by adding the following new subparagraph:
3   NEW SUBPARAGRAPH.  (25)  To a free clinic as defined in
4section 135.24 for purposes of record checks of potential
5volunteers and existing volunteers at the free clinic.
6   Sec. 2.  Section 235B.6, subsection 2, paragraph e, Code
72018, is amended by adding the following new subparagraph:
8   NEW SUBPARAGRAPH.  (19)  To a free clinic as defined in
9section 135.24 for purposes of record checks of potential
10volunteers and existing volunteers at the free clinic.
11EXPLANATION
12The inclusion of this explanation does not constitute agreement with
13the explanation’s substance by the members of the general assembly.
   14This bill relates to access to certain child abuse and
15dependent adult abuse information by free clinics.
   16Code section 235A.15, relating to access to child abuse
17information in the central child abuse registry, is amended
18to authorize free clinics to have access to report data and
19disposition data for cases of founded child abuse for purposes
20of potential and existing volunteer record checks. The bill
21amends Code section 235B.6, relating to access to dependent
22adult abuse information in the central dependent adult abuse
23registry, to authorize free clinics to have access to dependent
24adult abuse information, other than unfounded information, for
25the same purpose.
   26Code section 135.24 defines a free clinic as a facility
27other than a hospital or health care provider’s office which is
28exempt from taxation under section 501(c)(3) of the Internal
29Revenue Code and which has as its sole purpose the provision
30of health care services without charge to individuals who are
31otherwise unable to pay for the services.
