4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  68B.2C  Prohibited outside
2employment and activities — agents of foreign principals.
   3Officials and state employees shall not engage in any
4outside employment or activity that requires the person to
5register under the federal Foreign Agents Registration Act, 22
6U.S.C. §611 et seq., as amended.
7EXPLANATION
8The inclusion of this explanation does not constitute agreement with
9the explanation’s substance by the members of the general assembly.
   10This bill prohibits officials and state employees from
11engaging in any outside employment or activity that requires
12the person to register under the federal Foreign Agents
13Registration Act.
   14An “official” is defined in Code section 68B.2 as all
15statewide elected officials, the executive or administrative
16head or heads of an agency of state government, the deputy
17executive or administrative head or heads of an agency of
18state government, members of boards or commissions as defined
19under Code section 7E.4, and heads of the major subunits of
20departments or independent state agencies whose positions
21involve a substantial exercise of administrative discretion
22or the expenditure of public funds as defined under rules
23of the board adopted in consultation with the department or
24agency and pursuant to Code chapter 17A. “Official” does
25not include officers or employees of political subdivisions
26of the state, members of the general assembly, legislative
27employees, officers or employees of the judicial branch of
28government who are not members or employees of the office of
29attorney general, members of state government entities which
30are or exercise the same type of authority that is exercised by
31councils or committees as defined under Code section 7E.4, or
32members of any agricultural commodity promotional board, if the
33board is subject to a producer referendum. A “state employee”
34is an employee of the executive branch and does not include
35independent contractors.

   1A person who knowingly and intentionally violates this
2provision is guilty of a serious misdemeanor and may be
3reprimanded, suspended, or dismissed from the person’s position
4or otherwise sanctioned. A serious misdemeanor is punishable
5by confinement for no more than one year and a fine of at least
6$315 but not more than $1,875.
