7BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1DIVISION I
2REBUILD IOWA INFRASTRUCTURE FUND
3   Section 1.  REBUILD IOWA INFRASTRUCTURE FUND —
4APPROPRIATIONS.
  There is appropriated from the rebuild Iowa
5infrastructure fund to the following departments and agencies
6for the fiscal year beginning July 1, 2017, and ending June
730, 2018, the following amounts, or so much thereof as is
8necessary, to be used for the purposes designated:
   91.  DEPARTMENT OF ADMINISTRATIVE SERVICES
   10For major maintenance projects:

   12Of the moneys appropriated in this subsection, $2,000,000
13is allocated for the cost to modernize, upgrade, or replace
14elevator systems in facilities on the state capitol complex.
15The department shall give priority for projects modernizing
16elevator systems wherever possible.
   172.  DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP
   18a.  (1)  For deposit in the water quality initiative fund
19created in section 466B.45 for purposes of supporting the
20water quality initiative administered by the division of soil
21conservation and water quality as provided in section 466B.42,
22including salaries, support, maintenance, and miscellaneous
23purposes, notwithstanding section 8.57, subsection 5, paragraph
24“c”:

   26(2)  (a)  The moneys appropriated in this lettered
27paragraph shall be used to support demonstration projects in
28subwatersheds as designated by the department that are part
29of high-priority watersheds identified by the water resources
30coordinating council.
   31(b)  The moneys appropriated in this lettered paragraph
32shall be used to support demonstration projects in watersheds
33generally, including regional watersheds, as designated by the
34division and high-priority watersheds identified by the water
35resources coordinating council.

   1(3)  In supporting projects in watersheds and subwatersheds
2as provided in subparagraph (2), subparagraph divisions (a) and
3(b), all of the following shall apply:
   4(a)  The demonstration projects shall utilize water quality
5practices as described in the latest revision of the document
6entitled “Iowa Nutrient Reduction Strategy” initially presented
7in November 2012 by the department of agriculture and land
8stewardship, the department of natural resources, and Iowa
9state university of science and technology.
   10(b)  The division shall implement demonstration projects
11as provided in subparagraph division (a) by providing
12for participation by persons who hold a legal interest in
13agricultural land used in farming. To every extent practical,
14the division shall provide for collaborative participation by
15such persons who hold a legal interest in agricultural land
16located within the same subwatershed.
   17(c)  The division shall implement demonstration projects on
18a cost-share basis as determined by the division. However,
19the state’s share of the amount, except for edge-of-field
20practices, shall not exceed 50 percent of the estimated cost
21of establishing the practice as determined by the division or
2250 percent of the actual cost of establishing the practice,
23whichever is less.
   24(d)  The demonstration projects shall be used to educate
25other persons about the feasibility and value of establishing
26similar water quality practices. The division shall promote
27field day events for purposes of allowing interested persons to
28establish water quality practices on their agricultural land.
   29(e)  The division shall conduct water quality evaluations
30within supported subwatersheds. Within a reasonable period
31after accumulating information from such evaluations, the
32division shall create an aggregated database of water quality
33practices. Any information identifying a person holding a
34legal interest in agricultural land or specific agricultural
35land shall be a confidential record.

   1(4)  The moneys appropriated in this lettered paragraph
2shall be used to support education and outreach in a manner
3that encourages persons who hold a legal interest in
4agricultural land used for farming to implement water quality
5practices, including the establishment of such practices in
6watersheds generally, and not limited to subwatersheds or
7high-priority watersheds.
   8(5)  The moneys appropriated in this lettered paragraph
9may be used to contract with persons to coordinate the
10implementation of efforts provided in this paragraph.
   11(6)  The moneys appropriated in this lettered paragraph
12may be used by the department to support urban soil and water
13conservation efforts, which may include but are not limited
14to management practices related to bioretention, landscaping,
15the use of permeable or pervious pavement, and soil quality
16restoration. The moneys shall be allocated on a cost-share
17basis as provided in chapter 161A.
   18(7)  Notwithstanding any other provision of law to the
19contrary, the department may use moneys appropriated in
20this lettered paragraph to carry out the provisions of this
21paragraph on a cost-share basis in combination with other
22moneys available to the department from a state or federal
23source.
   24(8)  Not more than 10 percent of the moneys appropriated in
25this lettered paragraph may be used for costs of administration
26and implementation of the water quality initiative administered
27by the soil conservation division.
   28b.  For deposit in the agricultural drainage well water
29quality assistance fund created in section 460.303 for
30purposes of supporting the agricultural drainage well water
31quality assistance program as provided in section 460.304,
32notwithstanding section 8.57, subsection 5, paragraph “c”:

28   Sec. 2.  REBUILD IOWA INFRASTRUCTURE FUND — FY 2018-2019

  There is appropriated from the rebuild Iowa
30infrastructure fund to the economic development authority for
31the fiscal year beginning July 1, 2018, and ending June 30,
322019, the following amount, or so much thereof as is necessary,
33to be used for the purposes designated:
34For connection of communities to the Lewis and Clark

   2The authority shall establish a plan for the repayment of
3moneys appropriated pursuant to this paragraph once federal
4moneys for the project have been received. The authority shall
5submit a report to the general assembly by February 1, 2019,
6on the status of any federal moneys being appropriated for the

8   Sec. 3.  REVERSION.  For purposes of section 8.33, unless
9specifically provided otherwise, unencumbered or unobligated
10moneys made from an appropriation in this division of this Act
11shall not revert but shall remain available for expenditure for
12the purposes designated until the close of the fiscal year that
13ends three years after the end of the fiscal year for which the
14appropriation is made. However, if the project or projects for
15which such appropriation was made are completed in an earlier
16fiscal year, unencumbered or unobligated moneys shall revert at
17the close of that same fiscal year.
18DIVISION II
19TECHNOLOGY REINVESTMENT FUND
20   Sec. 4.  TECHNOLOGY REINVESTMENT FUND.  There is
21appropriated from the technology reinvestment fund created in
22section 8.57C to the following departments and agencies for the

13DIVISION V
14MISCELLANEOUS PROVISIONS
15   Sec. 16.  Section 8.57, subsection 5, paragraph c, Code 2017,
16is amended to read as follows:
   17c.  Moneys in the rebuild Iowa infrastructure fund in a
18fiscal year shall be used as directed by the general assembly
19for public vertical infrastructure projects. For the purposes
20of this subsection, “vertical infrastructure” includes only land
21acquisition and construction; major renovation and major repair
22of buildings; routine, recurring maintenance; all appurtenant
23structures; utilities; site development; recreational trails;
 24renewable fuel infrastructure programs; and debt service
25payments on academic revenue bonds issued in accordance
26with chapter 262A for capital projects at board of regents
27institutions. “Vertical infrastructure” does not include
28operational expenses or leasing of a building, appurtenant
29structure, or utility without a lease-purchase agreement.
30   Sec. 17.  Section 8.57C, subsection 3, paragraph a,
31subparagraph (2), Code 2017, is amended to read as follows:
   32(2)  The fiscal year beginning July 1, 2017 2018, and for
33each subsequent fiscal year thereafter.
34   Sec. 18.  Section 8.57C, subsection 3, Code 2017, is amended
35by adding the following new paragraph:
-14-1   NEW PARAGRAPH.  f.  There is appropriated from the rebuild
2Iowa infrastructure fund for the fiscal year beginning July 1,
32017, and ending June 30, 2018, the sum of ten million dollars
4to the technology reinvestment fund, notwithstanding section
58.57, subsection 5, paragraph “c”.
6   Sec. 19.  Section 12.88, Code 2017, is amended by adding the
7following new subsection:
8   NEW SUBSECTION.  6.  For the fiscal year beginning July 1,
92017, any unobligated and unencumbered moneys in the fund from
10the previous fiscal year are appropriated to the department of
11administrative services for major maintenance projects.
12   Sec. 20.  DEPARTMENT OF ADMINISTRATIVE SERVICES —
13VACANT BUILDING STUDY — APPROPRIATION.
  The department of
14administrative services shall conduct an inventory and study
15of vacant buildings owned by the state. The study shall
16include an assessment as to how much revenue could be realized
17by the sale of any buildings identified. If during the
18fiscal year beginning July 1, 2017, the department sells any
19vacant buildings identified by the study, fifty percent of
20any moneys realized from the sale of any vacant buildings are
21appropriated to the department of administrative services for
22major maintenance projects and fifty percent are appropriated
23to the department of cultural affairs for costs associated with
24maintenance projects for the state historical building.
