3general appropriation for fy 2017-2018
4   Section 1.  GENERAL FUND — DEPARTMENT.
   51.  There is appropriated from the general fund of the state
6to the department of agriculture and land stewardship for the
7fiscal year beginning July 1, 2017, and ending June 30, 2018,
8the following amount, or so much thereof as is necessary, to be
9used for the purposes designated:
   10For purposes of supporting the department, including its
11divisions, for administration, regulation, and programs; for
12salaries, support, maintenance, and miscellaneous purposes; and
13for not more than the following full-time equivalent positions:

   162.  Of the amount appropriated in subsection 1, the following
17amount is transferred to Iowa state university of science and
18technology, to be used for the university’s midwest grape and

   213.  The department shall submit a report each quarter of the
22fiscal year to the legislative services agency, the department
23of management, the members of the joint appropriations
24subcommittee on agriculture and natural resources, and the
25chairpersons and ranking members of the senate and house
26committees on appropriations. The report shall describe in
27detail the expenditure of moneys appropriated in this section
28to support the department’s administration, regulation, and
29programs.
30DESIGNATED Appropriations
31MISCELLANEOUS FUNDS
32   Sec. 2.  UNCLAIMED PARI-MUTUEL WAGERING WINNINGS —
33HORSE AND DOG RACING.
  There is appropriated from the moneys
34available under section 99D.13 to the department of agriculture
35and land stewardship for the fiscal year beginning July 1,
-1-12017, and ending June 30, 2018, the following amount, or so
2much thereof as is necessary, to be used for the purposes
3designated:
   4For purposes of supporting the department’s administration
5and enforcement of horse and dog racing law pursuant to section
699D.22, including for salaries, support, maintenance, and
7miscellaneous purposes:

9   Sec. 3.  RENEWABLE FUEL INFRASTRUCTURE FUND — MOTOR FUEL
10INSPECTION.
   111.  There is appropriated from the renewable fuel
12infrastructure fund created in section 159A.16 to the
13department of agriculture and land stewardship for the fiscal
14year beginning July 1, 2017, and ending June 30, 2018, the
15following amount, or so much thereof as is necessary, to be
16used for the purposes designated:
   17For purposes of the inspection of motor fuel, including
18salaries, support, maintenance, and miscellaneous purposes:

   202.  The department shall establish and administer programs
21for the auditing of motor fuel including biofuel processing
22and production plants, for screening and testing motor fuel,
23including renewable fuel, and for the inspection of motor fuel
24sold by dealers including retail dealers who sell and dispense
25motor fuel from motor fuel pumps.
26SPECIAL APPROPRIATIONS
27GENERAL FUND
28   Sec. 4.  DAIRY REGULATION.
   291.  There is appropriated from the general fund of the state
30to the department of agriculture and land stewardship for the
31fiscal year beginning July 1, 2017, and ending June 30, 2018,
32the following amount, or so much thereof as is necessary, to be
33used for the purposes designated:
   34For purposes of performing functions pursuant to section
35192.109, including conducting a survey of grade “A” milk and

   32.  Notwithstanding section 8.33, moneys appropriated in
4this section that remain unencumbered or unobligated at the
5close of the fiscal year shall not revert but shall remain
6available to be used for the purposes designated until the

8   Sec. 5.  LOCAL FOOD AND FARM PROGRAM.
   91.  There is appropriated from the general fund of the state
10to the department of agriculture and land stewardship for the
11fiscal year beginning July 1, 2017, and ending June 30, 2018,
12the following amount, or so much thereof as is necessary, to be
13used for the purposes designated:
   14For purposes of supporting the local food and farm program
15pursuant to chapter 267A:

   172.  The department shall enter into a cost-sharing agreement
18with Iowa state university of science and technology to support
19the local food and farm program coordinator position as part of
20the university’s cooperative extension service in agriculture
21and home economics pursuant to chapter 267A.
   223.  Notwithstanding section 8.33, moneys appropriated in
23this section that remain unencumbered or unobligated at the
24close of the fiscal year shall not revert but shall remain
25available to be used for the purposes designated until the
26close of the succeeding fiscal year.
27   Sec. 6.  AGRICULTURAL EDUCATION.
   281.  There is appropriated from the general fund of the state
29to the department of agriculture and land stewardship for the
30fiscal year beginning July 1, 2017, and ending June 30, 2018,
31the following amount, or so much thereof as is necessary, to be
32used for the purposes designated:
   33For purposes of allocating moneys to an Iowa association
34affiliated with a national organization which promotes
35agricultural education providing for future farmers:

   22.  Notwithstanding section 8.33, moneys appropriated in
3this section that remain unencumbered or unobligated at the
4close of the fiscal year shall not revert but shall remain
5available to be used for the purposes designated until the
6close of the succeeding fiscal year.
7   Sec. 7.  FARMERS WITH DISABILITIES PROGRAM.
   81.  There is appropriated from the general fund of the state
9to the department of agriculture and land stewardship for the
10fiscal year beginning July 1, 2017, and ending June 30, 2018,
11the following amount, or so much thereof as is necessary, to be
12used for the purposes designated:
   13For purposes of supporting a program for farmers with
14disabilities:

   162.  The moneys appropriated in subsection 1 shall be used for
17the public purpose of providing a grant to a national nonprofit
18organization with over 80 years of experience in assisting
19children and adults with disabilities and special needs. The
20moneys shall be used to support a nationally recognized program
21that began in 1986 and has been replicated in at least 30 other
22states, but which is not available through any other entity
23in this state, and that provides assistance to farmers with
24disabilities in all 99 counties to allow the farmers to remain
25in their own homes and be gainfully engaged in farming through
26provision of agricultural worksite and home modification
27consultations, peer support services, services to families,
28information and referral, and equipment loan services.
   293.  Notwithstanding section 8.33, moneys appropriated in
30this section that remain unencumbered or unobligated at the
31close of the fiscal year shall not revert but shall remain
32available for expenditure for the purposes designated until the
33close of the succeeding fiscal year.

35GENERAL FUND

2WATER QUALITY INITIATIVE
3APPROPRIATIONS FOR fy 2017-2018
4   Sec. 8.  WATER QUALITY INITIATIVE — GENERAL.
   51.  There is appropriated from the general fund of the state
6to the department of agriculture and land stewardship for the
7fiscal year beginning July 1, 2017, and ending June 30, 2018,
8the following amount, or so much thereof as is necessary, to be
9used for the purposes designated:
   10For deposit in the water quality initiative fund created in
11section 466B.45, for purposes of supporting the water quality
12initiative administered by the division of soil conservation
13and water quality as provided in section 466B.42, including
14salaries, support, maintenance, and miscellaneous purposes:

   162.  a.  The moneys appropriated in subsection 1 shall be
17used to support projects in subwatersheds as designated by the
18division that are part of high-priority watersheds identified
19by the water resources coordinating council established
20pursuant to section 466B.3.
   21b.  The moneys appropriated in subsection 1 shall be used to
22support projects in watersheds generally, including regional
23watersheds, as designated by the division and high-priority
24watersheds identified by the water resources coordinating
25council established pursuant to section 466B.3.
   263.  In supporting projects in subwatersheds and watersheds
27as provided in subsection 2, all of the following shall apply:
   28a.  The demonstration projects shall utilize water quality
29practices as described in the latest revision of the document
30entitled “Iowa Nutrient Reduction Strategy” initially presented
31in November 2012 by the department of agriculture and land
32stewardship, the department of natural resources, and Iowa
33state university of science and technology.
   34b.  The division shall implement demonstration projects as
35provided in paragraph “a” by providing for participation by
-5-1persons who hold a legal interest in agricultural land used in
2farming. To every extent practical, the division shall provide
3for collaborative participation by such persons who hold a
4legal interest in agricultural land located within the same
5subwatershed.
   6c.  The division shall implement a demonstration project on
7a cost-share basis as determined by the division. However,
8except for edge-of-field practices, the state’s share of the
9amount shall not exceed 50 percent of the estimated cost of
10establishing the practice as determined by the division or
1150 percent of the actual cost of establishing the practice,
12whichever is less.
   13d.  The demonstration projects shall be used to educate other
14persons about the feasibility and value of establishing similar
15water quality practices. The division shall promote field day
16events for purposes of allowing interested persons to establish
17water quality practices on their agricultural land.
   18e.  The division shall conduct water quality evaluations
19within supported subwatersheds. Within a reasonable period
20after accumulating information from such evaluations, the
21division shall create an aggregated database of water quality
22practices. Any information identifying a person holding a
23legal interest in agricultural land or specific agricultural
24land shall be a confidential record under section 22.7.
   254.  The moneys appropriated in subsection 1 shall be used
26to support education and outreach in a manner that encourages
27persons who hold a legal interest in agricultural land used for
28farming to implement water quality practices, including the
29establishment of such practices in watersheds generally, and
30not limited to subwatersheds or high-priority watersheds.
   315.  The moneys appropriated in subsection 1 may be used
32to contract with persons to coordinate the implementation of
33efforts provided in this section.
   346.  The moneys appropriated in subsection 1 may be used by
35the department to support urban soil and water conservation
-6-1efforts, which may include but are not limited to management
2practices related to bioretention, landscaping, the use of
3permeable or pervious pavement, and soil quality restoration.
4The moneys shall be allocated on a cost-share basis as provided
5in chapter 161A.
   67.  Notwithstanding any other provision of law to the
7contrary, the department may use moneys appropriated in
8subsection 1 to carry out the provisions of this section on a
9cost-share basis in combination with other moneys available to
10the department from a state or federal source.
   118.  Not more than 10 percent of the moneys appropriated in
12this section may be used to pay for the costs of administering
13and implementing the water quality initiative by the
14department’s division of soil conservation and water quality as
15provided in section 466B.42 and this section.
16DIVISION III
17department of natural resources
18general appropriations for fy 2017-2018
19   Sec. 9.  GENERAL FUND — DEPARTMENT.
   201.  There is appropriated from the general fund of the state
21to the department of natural resources for the fiscal year
22beginning July 1, 2017, and ending June 30, 2018, the following
23amount, or so much thereof as is necessary, to be used for the
24purposes designated:
   25For purposes of supporting the department, including its
26divisions, for administration, regulation, and programs; for
27salaries, support, maintenance, and miscellaneous purposes; and
28for not more than the following full-time equivalent positions:

   312.  Of the number of full-time equivalent positions
32authorized to the department pursuant to subsection 1, 50
33full-time equivalent positions shall be allocated by the
34department for seasonal employees for purposes of providing
35maintenance, upkeep, and sanitary services at state parks.

2positions within the department.
   33.  The department shall submit a report each quarter of the
4fiscal year to the legislative services agency, the department
5of management, the members of the joint appropriations
6subcommittee on agriculture and natural resources, and the
7chairpersons and ranking members of the senate and house
8committees on appropriations. The report shall describe in
9detail the expenditure of moneys appropriated under this
10section to support the department’s administration, regulation,
11and programs.
12   Sec. 10.  STATE FISH AND GAME PROTECTION FUND — REGULATION
13AND ADVANCEMENT OF OUTDOOR ACTIVITIES.
   141.  There is appropriated from the state fish and game
15protection fund to the department of natural resources for the
16fiscal year beginning July 1, 2017, and ending June 30, 2018,
17the following amount, or so much thereof as is necessary, to be
18used for the purposes designated:
   19For purposes of supporting the regulation or advancement of
20hunting, fishing, or trapping, or the protection, propagation,
21restoration, management, or harvest of fish or wildlife,
22including for administration, regulation, law enforcement, and
23programs; and for salaries, support, maintenance, equipment,
24and miscellaneous purposes:

   262.  Notwithstanding section 455A.10, the department may use
27the unappropriated balance remaining in the state fish and game
28protection fund to provide for the funding of health and life
29insurance premium payments from unused sick leave balances of
30conservation peace officers employed in a protection occupation
31who retire, pursuant to section 97B.49B.
   323.  Notwithstanding section 455A.10, the department of
33natural resources may use the unappropriated balance remaining
34in the state fish and game protection fund for the fiscal
35year beginning July 1, 2017, and ending June 30, 2018, as is
-8-1necessary to fund salary adjustments for departmental employees
2for which the general assembly has made an operating budget
3appropriation in subsection 1.
4   Sec. 11.  GROUNDWATER PROTECTION FUND — WATER
5QUALITY.
  There is appropriated from the groundwater protection
6fund created in section 455E.11 to the department of natural
7resources for the fiscal year beginning July 1, 2017,
8and ending June 30, 2018, from those moneys which are not
9allocated pursuant to that section, the following amount, or
10so much thereof as is necessary, to be used for the purposes
11designated:
   12For purposes of supporting the department’s protection
13of the state’s groundwater, including for administration,
14regulation, and programs, and for salaries, support,
15maintenance, equipment, and miscellaneous purposes:

11purpose designated:

   152.  Of the amount appropriated in subsection 1, up to
16$400,000 may be used by the department to acquire or install
17stream gages for purposes of tracking and predicting flood
18events and for compiling necessary data to improve flood
19frequency analysis.
   203.  Notwithstanding section 8.33, moneys appropriated in
21subsection 1 that remain unencumbered or unobligated at the
22close of the fiscal year shall not revert but shall remain
23available for expenditure for the purposes designated until the
24close of the succeeding fiscal year.
25   Sec. 15.  FORESTRY HEALTH MANAGEMENT.
   261.  There is appropriated from the general fund of the state
27to the department of natural resources for the fiscal year
28beginning July 1, 2017, and ending June 30, 2018, the following
29amount, or so much thereof as is necessary, to be used for the
30purposes designated:
   31For purposes of providing for forestry health management

   91.  There is appropriated from the general fund of the state
10to Iowa state university of science and technology for the
11fiscal year beginning July 1, 2017, and ending June 30, 2018,
12the following amount, or so much thereof as is necessary, to be
13used for the purposes designated:
   14For purposes of supporting the college of veterinary
15medicine for the operation of the veterinary diagnostic
16laboratory and for not more than the following full-time
17equivalent positions:

   202.  a.  Iowa state university of science and technology
21shall not reduce the amount that it allocates to support the
22college of veterinary medicine from any other source due to the
23appropriation made in this section.

26percentage of reduction imposed on the college of veterinary
27medicine is also imposed on all of Iowa state university of
28science and technology’s budget units.
   293.  If by June 30, 2018, Iowa state university of science and
30technology fails to allocate the moneys appropriated in this
31section to the college of veterinary medicine in accordance
32with this section, the moneys appropriated in this section for
33that fiscal year shall revert to the general fund of the state.
34DIVISION V
35environment first fund

2   Sec. 17.  DEPARTMENT OF AGRICULTURE AND LAND
3STEWARDSHIP.
  There is appropriated from the environment first
4fund created in section 8.57A to the department of agriculture
5and land stewardship for the fiscal year beginning July 1,
62017, and ending June 30, 2018, the following amounts, or so
7much thereof as is necessary, to be used for the purposes
8designated:
   91.  CONSERVATION RESERVE ENHANCEMENT PROGRAM (CREP)
   10a.  For the conservation reserve enhancement program to
11restore and construct wetlands for the purposes of intercepting
12tile line runoff, reducing nutrient loss, improving water
13quality, and enhancing agricultural production practices:

   15b.  Not more than 10 percent of the moneys appropriated
16in paragraph “a” may be used for costs of administration and
17implementation of soil and water conservation practices.
   18c.  Notwithstanding any other provision in law, the
19department may use moneys appropriated in this subsection,
20in combination with other appropriate environment first
21fund appropriations, for cost sharing to match United States
22department of agriculture, natural resources conservation
23service, wetlands reserve enhancement program (WREP) funding
24available to Iowa.
   252.  WATERSHED PROTECTION
   26a.  For continuation of a program that provides
27multiobjective resource protections for flood control, water
28quality, erosion control, and natural resource conservation:

   30b.  Not more than 10 percent of the moneys appropriated
31in paragraph “a” may be used for costs of administration and
32implementation of soil and water conservation practices.
   333.  FARM MANAGEMENT DEMONSTRATION PROGRAM
   34a.  For continuation of a statewide voluntary farm
35management demonstration program to demonstrate the

2agronomy that protect water resources and provide other
3environmental benefits:

6allocated to an organization representing soybean growers to
7provide for an agriculture and environment performance program.
   84.  SOIL AND WATER CONSERVATION — ADMINISTRATION

10implementation of soil and water conservation practices:

13is allocated to support field staff providing technical
14assistance.
   155.  CONSERVATION RESERVE PROGRAM (CRP)
   16a.  To encourage and assist farmers in enrolling in and the
17implementation of the federal conservation reserve program and
18to work with them to enhance their revegetation efforts to
19improve water quality and habitat:

   21b.  Not more than 10 percent of the moneys appropriated
22in paragraph “a” may be used for costs of administration and
23implementation of soil and water conservation practices.
   246.  SOIL AND WATER CONSERVATION
   25a.  For use by the department in providing for soil and water
26conservation:

   28b.  (1)  Of the amount appropriated in paragraph “a”, for
29transfer to the loess hills development and conservation fund
30created in section 161D.2:

   32(2)  (a)  Of the amount transferred to the loess hills
33development and conservation fund in subparagraph (1), $450,000
34shall be allocated to the fund’s hungry canyons account.
   35(b)  Not more than 10 percent of the moneys allocated to

2division (a) may be used for administrative costs.
   3(3)  (a)  Of the amount transferred to the loess hills
4development and conservation fund in subparagraph (1), $40,000
5shall be allocated to the fund’s loess hills alliance account.
   6(b)  Not more than 10 percent of the moneys allocated to the
7fund’s loess hills alliance account as provided in subparagraph
8division (a) may be used for administrative costs.
   9c.  Of the remaining amount appropriated in paragraph “a”,
10for use by the department in providing for soil and water
11conservation administration, the conservation of soil and
12water resources, or the support of soil and water conservation
13districts:

   15d.  Of the amount appropriated in paragraph “c” that the
16department allocates to a soil and water conservation district,
17the first $15,000 may be expended by the district for the
18purpose of providing financial incentives under section 161A.73
19to establish management practices for the control of soil
20erosion on land that is row-cropped, including but not limited
21to nontill planting, ridge-till planting, and contouring
22strip-cropping. Of any remaining amount of that appropriation
23allocated by the department to a district, 30 percent may be
24expended by the district for that same purpose.
   25e.  Not more than 5 percent of the moneys appropriated in
26paragraph “c” may be allocated for cost sharing to address
27complaints filed under section 161A.47.
   28f.  Of the moneys appropriated in paragraph “c”, 5 percent
29shall be allocated for financial incentives to establish
30practices to protect watersheds above publicly owned lakes of
31the state from soil erosion and sediment as provided in section
32161A.73.
   33g.  The state soil conservation committee established by
34section 161A.4 may allocate moneys appropriated in paragraph
35“c” to conduct research and demonstration projects to promote
-14-1conservation tillage and nonpoint source pollution control
2practices.
   3h.  The allocation of moneys as financial incentives as
4provided in section 161A.73 may be used in combination with
5moneys allocated by the department of natural resources.
   6i.  Not more than 15 percent of the moneys appropriated
7in paragraph “c” may be used for costs of administration and
8implementation of soil and water conservation practices.
   9j.  In lieu of moneys appropriated in section 466A.5, not
10more than $25,000 of the moneys appropriated in paragraph “c”
11shall be used by the division of soil conservation and water
12quality of the department of agriculture and land stewardship
13to provide administrative support to the watershed improvement
14review board established in section 466A.3.
15   Sec. 18.  DEPARTMENT OF NATURAL RESOURCES.  There is
16appropriated from the environment first fund created in section
178.57A to the department of natural resources for the fiscal
18year beginning July 1, 2017, and ending June 30, 2018, the
19following amounts, or so much thereof as is necessary, to be
20used for the purposes designated:
   211.  STATE PARKS MAINTENANCE AND OPERATIONS
   22a.  For regular maintenance and operations of state parks and
23staff time associated with these activities:

35fiscal year shall not revert but instead shall remain available

2succeeding fiscal year, or until the project for which the
3appropriation was made is completed, whichever is earlier.
   4b.  Notwithstanding section 8.33, moneys appropriated for
5the fiscal year beginning July 1, 2017, in this division of
6this Act to the department of agriculture and land stewardship
7to provide financial assistance for the establishment of
8permanent soil and water conservation practices that remain
9unencumbered or unobligated at the close of the fiscal year
10shall not revert but instead shall remain available for
11expenditure for the purposes designated until the close of the
12fiscal year beginning July 1, 2020.
   132.  Subsection 1 does not apply to moneys transferred
14pursuant to this division to the loess hills development and
15conservation fund created in section 161D.2 which shall not
16revert as provided in that section.

18ENVIRONMENT FIRST FUND
19SPECIAL APPROPRIATIONS FOR FY 2017-2018
20   Sec. 20.  WATER QUALITY INITIATIVE — DEPARTMENT OF
21AGRICULTURE AND LAND STEWARDSHIP.
   221.  There is appropriated from the environment first fund
23created in section 8.57A to the department of agriculture
24and land stewardship for the fiscal year beginning July 1,
252017, and ending June 30, 2018, the following amount, or so
26much thereof as is necessary, to be used for the purposes
27designated:
   28For deposit in the water quality initiative fund created in
29section 466B.45, for purposes of supporting the water quality
30initiative administered by the division of soil conservation
31and water quality as provided in section 466B.42, including
32salaries, support, maintenance, and miscellaneous purposes:

   342.  a.  The moneys appropriated in subsection 1 shall be
35used to support projects in subwatersheds as designated by the
-17-1division that are part of high-priority watersheds identified
2by the water resources coordinating council established
3pursuant to section 466B.3.
   4b.  The moneys appropriated in subsection 1 shall be used to
5support projects in watersheds generally, including regional
6watersheds, as designated by the division and high-priority
7watersheds identified by the water resources coordinating
8council established pursuant to section 466B.3.
   93.  In supporting projects in subwatersheds and watersheds
10as provided in subsection 2, all of the following shall apply:
   11a.  The demonstration projects shall utilize water quality
12practices as described in the latest revision of the document
13entitled “Iowa Nutrient Reduction Strategy” initially presented
14in November 2012 by the department of agriculture and land
15stewardship, the department of natural resources, and Iowa
16state university of science and technology.
   17b.  The division shall implement demonstration projects as
18provided in paragraph “a” by providing for participation by
19persons who hold a legal interest in agricultural land used in
20farming. To every extent practical, the division shall provide
21for collaborative participation by such persons who hold a
22legal interest in agricultural land located within the same
23subwatershed.
   24c.  The division shall implement a demonstration project on
25a cost-share basis as determined by the division. However,
26except for edge-of-field practices, the state’s share of the
27amount shall not exceed 50 percent of the estimated cost of
28establishing the practice as determined by the division or
2950 percent of the actual cost of establishing the practice,
30whichever is less.
   31d.  The demonstration projects shall be used to educate other
32persons about the feasibility and value of establishing similar
33water quality practices. The division shall promote field day
34events for purposes of allowing interested persons to establish
35water quality practices on their agricultural land.

   1e.  The division shall conduct water quality evaluations
2within supported subwatersheds. Within a reasonable period
3after accumulating information from such evaluations, the
4division shall create an aggregated database of water quality
5practices. Any information identifying a person holding a
6legal interest in agricultural land or specific agricultural
7land shall be a confidential record under section 22.7.
   84.  The moneys appropriated in subsection 1 shall be used
9to support education and outreach in a manner that encourages
10persons who hold a legal interest in agricultural land used for
11farming to implement water quality practices, including the
12establishment of such practices in watersheds generally, and
13not limited to subwatersheds or high-priority watersheds.
   145.  The moneys appropriated in subsection 1 may be used
15to contract with persons to coordinate the implementation of
16efforts provided in this section.
   176.  The moneys appropriated in subsection 1 may be used by
18the department to support urban soil and water conservation
19efforts, which may include but are not limited to management
20practices related to bioretention, landscaping, the use of
21permeable or pervious pavement, and soil quality restoration.
22The moneys shall be allocated on a cost-share basis as provided
23in chapter 161A.
   247.  Notwithstanding any other provision of law to the
25contrary, the department may use moneys appropriated in
26subsection 1 to carry out the provisions of this section on a
27cost-share basis in combination with other moneys available to
28the department from a state or federal source.
   298.  Not more than 10 percent of the moneys appropriated in
30this section may be used to pay for the costs of administering
31and implementing the water quality initiative by the
32department’s division of soil conservation and water quality as
33provided in section 466B.42 and this section.
34   Sec. 21.  REAP — IN LIEU OF GENERAL FUND APPROPRIATION.
   35Notwithstanding the standing appropriation in section 455A.18,
-19-1there is appropriated from the environment first fund created
2in section 8.57A to the Iowa resources enhancement and
3protection fund, in lieu of the appropriation made in section
4455A.18, for the fiscal year beginning July 1, 2017, and
5ending June 30, 2018, the following amount, to be allocated as
6provided in section 455A.19:

12   Sec. 22.  MANAGEMENT OF MONEYS IN THE WATERSHED IMPROVEMENT
13FUND — APPROPRIATION.
   141.  Notwithstanding section 466A.2, and the repeal of
15chapter 466A as provided in this division of this Act, on and
16after December 31, 2017, the department of agriculture and land
17stewardship shall manage the watershed improvement fund in the
18same manner as required in 2016 Acts, chapter 1134, section
1935, including by making necessary payments to satisfy any
20outstanding obligations incurred by the watershed improvement
21review board prior to December 31, 2017.
   222.  Any unobligated and unencumbered moneys remaining in
23the watershed improvement fund on December 31, 2017, are
24appropriated to the department for use by the department in
25providing for soil and water conservation administration, the
26conservation of soil and water resources, or the support of
27soil and water conservation districts in the same manner as
28provided in the section of this Act appropriating moneys to the
29department from the environment first fund created in section
308.57A.
31   Sec. 23.  Section 461.33, subsection 2, paragraph a, Code
322017, is amended to read as follows:
   33a.  Soil conservation and watershed protection, including by
34supporting the division of soil conservation and water quality
35within the department of agriculture and land stewardship
-20-1and soil and water conservation district commissioners. The
2department may provide for the installation of conservation
3practices and watershed protection improvements as provided in
4chapters 161A, 161C, 461A, and 466, and 466A.
5   Sec. 24.  REPEAL.  Chapter 466A, Code 2017, is repealed.
6   Sec. 25.  EFFECTIVE DATES.
   71.  The section of this division of this Act repealing
8chapter 466A takes effect January 1, 2018.
   92.  The remainder of the provisions in this division of this
10Act take effect July 1, 2017.
11DIVISION VIII
12IOWA RESOURCES ENHANCEMENT AND PROTECTION FUND
13SPECIAL USE OF MONEYS FOR FY 2017-2018
14   Sec. 26.  OPEN SPACES ACCOUNT — PARK MAINTENANCE AND
15REPAIR.
  Notwithstanding section 455A.19, subsection 1,
16paragraph “a”, subparagraph (1), of the moneys allocated to
17the open spaces account of the Iowa resources enhancement and
18protection fund, $288,000 shall be used by the department of
19natural resources for state park maintenance and repair for
20the fiscal year beginning July 1, 2017, and ending on June 30,
212018.

23LIVESTOCK HEALTH SPECIAL APPROPRIATION FOR FY 2017-2018
24GENERAL FUND — RELATED STATUTORY CHANGES
25   Sec. 27.  FOREIGN ANIMAL DISEASES AFFLICTING LIVESTOCK —
26APPROPRIATION.
  There is appropriated from the general fund of
27the state to the department of agriculture and land stewardship
28for the fiscal year beginning July 1, 2017, and ending June 30,
292018, the following amount, or so much thereof as is necessary,
30to be used for the purposes designated:
   311.  For deposit in the foreign animal disease preparedness
32and response fund created in section 163.3B as enacted in this
33division of this Act:

   352.  In developing a foreign animal disease preparedness and
-21-1response strategy as required in section 163.3C as enacted in
2this division of this Act, the department shall prepare an
3interim report to be submitted to the joint appropriations
4subcommittee on agriculture and natural resources not later
5than January 10, 2018. The interim report shall include
6preliminary findings and recommendations together with plans
7for completing the strategy. The department shall prepare
8a final report to be submitted to the joint appropriations
9subcommittee on agriculture and natural resources not later
10than January 10, 2019. The report shall include final
11findings and recommendations for establishing the strategy,
12and may include any proposed notice of intended action for
13consideration by the department or proposed legislation for
14consideration by the general assembly.
15   Sec. 28.  NEW SECTION.  163.3B  Foreign animal disease
16preparedness and response fund.
   171.  A foreign animal disease preparedness and response
18fund is created in the state treasury under the control and
19management of the department.
   202.  The fund shall include moneys appropriated by the general
21assembly credited to the fund. The fund may include other
22moneys available to and obtained or accepted by the department
23as provided in section 159.6A, including but not limited to the
24federal government, other public sources, or private sources.
   253.  Moneys in the fund are appropriated to the department and
26shall be used exclusively to develop, establish, and implement
27a foreign animal disease preparedness and response strategy
28as described in section 163.3C, and shall not require further
29special authorization by the general assembly.
   304.  a.  Notwithstanding section 12C.7, interest or earnings
31on moneys in the fund shall be credited to the fund.
   32b.  Notwithstanding section 8.33, moneys credited to the fund
33that remain unexpended or unobligated at the end of a fiscal
34year shall not revert to any other fund.
35   Sec. 29.  NEW SECTION.  163.3C  Foreign animal disease
-22-1preparedness and response strategy.
   21.  As used in this section, unless the context otherwise
3requires:
   4a.  “Foreign animal disease” means a disease introduced into
5this state that negatively affects the health of livestock
6and is transmittable between the same or different species of
7livestock.
   8b.  “Livestock” means an animal belonging to the bovine,
9caprine, equine, ovine, or porcine species, ostriches, rheas,
10emus; farm deer as defined in section 170.1; or turkeys,
11chickens, or other poultry.
   122.  The department shall develop and establish a foreign
13animal disease preparedness and response strategy for use by
14the department in order to prevent, control, or eradicate the
15transmission of foreign animal diseases among populations
16of livestock. The strategy may be part of the department’s
17veterinary emergency preparedness and response services
18as provided in section 163.3A. The strategy shall provide
19additional expertise and resources to increase biosecurity
20efforts that assist in the prevention of a foreign animal
21disease outbreak in this state. In developing and establishing
22the strategy, the department shall consult with interested
23persons including but not limited to the following:
   24a.  The Iowa cattlemen’s association.
   25b.  The Iowa state dairy association.
   26c.  The Iowa pork producers association.
   27d.  The Iowa sheep producers industry association.
   28e.  The Iowa turkey federation.
   29f.  The Iowa poultry association.
   30g.  The college of veterinary medicine at Iowa state
31university.
   32h.  The livestock health advisory council created in section
33267.2.
   343.  The department shall implement the foreign animal
35disease preparedness and response strategy if necessary
-23-1to prevent, control, or eradicate the transmission and
2incidence of foreign animal diseases that may threaten or
3actually threaten livestock in this state. In implementing
4the strategy, the department may utilize emergency response
5measures as otherwise required under section 163.3A. The
6department may but is not required to consult with interested
7persons when implementing the strategy.
8DIVISION X
9APPROPRIATION AND STATUTORY CHANGES — ELIMINATION
10OF LEOPOLD CENTER FOR SUSTAINABLE AGRICULTURE
11   Sec. 30.  Section 266.39A, Code 2017, is amended to read as
12follows:
   13266.39A  Agricultural research.
   14Iowa state university of science and technology shall
15conduct continuing agricultural research to provide information
16about environmental and social impacts of agricultural research
17on the small or family farm and information about population
18trends and impact of the trends on Iowa agriculture, in
19addition to research that may include the categories specified
20in section 266.39B, subsection 2
. The research shall include
21an agricultural land tenure study conducted every five years to
22determine the ownership of farmland, and to analyze ownership
23trends, using the categories of land ownership defined in
24chapter 9H. The study shall be conducted on the basis of
25regions established by the university. A region shall be
26composed of not more than twenty-three contiguous counties.
27   Sec. 31.  Section 455E.11, subsection 2, paragraph b,
28subparagraph (3), subparagraph division (a), Code 2017, is
29amended to read as follows:
   30(a)  Thirty-five percent is appropriated annually for
31the Leopold center for sustainable agriculture at Iowa state
32university of science and technology
 to the Iowa nutrient
33research fund created in section 466B.46
.
34   Sec. 32.  Section 466B.46, subsection 2, Code 2017, is
35amended by adding the following new paragraph:
-24-1   NEW PARAGRAPH.  0b.  Moneys appropriated from the agriculture
2management account of the groundwater protection fund pursuant
3to section 455E.11, subsection 2, paragraph “b”, subparagraph
4(3), subparagraph division (a).
5   Sec. 33.  ONGOING ACTIVITIES AND EXPENSES.
   61.  Until July 1, 2017, the Leopold center for sustainable
7agriculture established in section 266.39 shall not initiate
8any new activity that otherwise could be conducted under
9section 266.39 or 266.39B, including but not limited to
10research grants and projects. The Leopold center for
11sustainable agriculture shall not incur any obligation or
12expense unless approved by the college of agriculture and life
13sciences at Iowa state university of science and technology.
14The Leopold center for sustainable agriculture shall cancel
15any existing grant or project that is not in the process of
16being immediately completed. However, the Leopold center
17for sustainable agriculture shall not cancel a grant or
18project that would result in a default of a legal or equitable
19obligation, including breach of contract.
   202.  On and after July 1, 2017, the college of agriculture
21and life sciences at Iowa state university of science and
22technology shall administer any ongoing activity that the
23Leopold center for sustainable agriculture had administered
24under section 266.39 or 266.39B prior to that date. The
25college may expend moneys appropriated from the Iowa nutrient
26research fund created in section 466B.46 in order to pay for
27any necessary expenses associated with the Leopold center
28for sustainable agriculture and for completing any ongoing
29activity. The college shall cancel any existing grant
30or project that is not in the process of being completed.
31However, the college shall not cancel a grant or project that
32would result in a default of a legal or equitable obligation,
33including breach of contract. The college shall submit a
34report to the general assembly by January 10, 2018, which
35shall include a summary of the ongoing activities and expenses
-25-1described in this section and the expected completion date of
2those activities and expenses.
3   Sec. 34.  REPEAL.  Sections 266.39 and 266.39B, Code 2017,
4are repealed.
5   Sec. 35.  EFFECTIVE DATES.
   61.  The section of this division of this Act providing for
7ongoing activities and expenses, being deemed of immediate
8importance, takes effect upon enactment.
   92.  The remaining sections of this division of this Act,
10including the section of this division of this Act repealing
11sections 266.39 and 266.39B take effect on July 1, 2017.

23used for the purposes designated:

28the public purpose of providing a grant to a national nonprofit
29organization with over 80 years of experience in assisting
30children and adults with disabilities and special needs. The
31moneys shall be used to support a nationally recognized program
32that began in 1986 and has been replicated in at least 30 other
33states, but which is not available through any other entity
34in this state, and that provides assistance to farmers with
35disabilities in all 99 counties to allow the farmers to remain

2provision of agricultural worksite and home modification
3consultations, peer support services, services to families,
4information and referral, and equipment loan services.
   53.  Notwithstanding section 8.33, moneys appropriated in
6this section that remain unencumbered or unobligated at the
7close of the fiscal year shall not revert but shall remain
8available for expenditure for the purposes designated until the
9close of the succeeding fiscal year.

   29e.  The division shall conduct water quality evaluations
30within supported subwatersheds. Within a reasonable period
31after accumulating information from such evaluations, the
32division shall create an aggregated database of water quality
33practices. Any information identifying a person holding a
34legal interest in agricultural land or specific agricultural
35land shall be a confidential record under section 22.7.

   14.  The moneys appropriated in subsection 1 shall be used
2to support education and outreach in a manner that encourages
3persons who hold a legal interest in agricultural land used for
4farming to implement water quality practices, including the
5establishment of such practices in watersheds generally, and
6not limited to subwatersheds or high-priority watersheds.
   75.  The moneys appropriated in subsection 1 may be used
8to contract with persons to coordinate the implementation of
9efforts provided in this section.
   106.  The moneys appropriated in subsection 1 may be used by
11the department to support urban soil and water conservation
12efforts, which may include but are not limited to management
13practices related to bioretention, landscaping, the use of
14permeable or pervious pavement, and soil quality restoration.
15The moneys shall be allocated on a cost-share basis as provided
16in chapter 161A.
   177.  Notwithstanding any other provision of law to the
18contrary, the department may use moneys appropriated in
19subsection 1 to carry out the provisions of this section on a
20cost-share basis in combination with other moneys available to
21the department from a state or federal source.
   228.  Not more than 10 percent of the moneys appropriated in
23this section may be used to pay for the costs of administering
24and implementing the water quality initiative by the
25department’s division of soil conservation and water quality as
26provided in section 466B.42 and this section.
27DIVISION XIII
28department of natural resources
29general appropriations for fy 2018-2019
30   Sec. 44.  GENERAL FUND — DEPARTMENT.
   311.  There is appropriated from the general fund of the state
32to the department of natural resources for the fiscal year
33beginning July 1, 2018, and ending June 30, 2019, the following
34amount, or so much thereof as is necessary, to be used for the
35purposes designated:

13positions within the department.
   143.  The department shall submit a report each quarter of the
15fiscal year to the legislative services agency, the department
16of management, the members of the joint appropriations
17subcommittee on agriculture and natural resources, and the
18chairpersons and ranking members of the senate and house
19committees on appropriations. The report shall describe in
20detail the expenditure of moneys appropriated under this
21section to support the department’s administration, regulation,
22and programs.
23   Sec. 45.  STATE FISH AND GAME PROTECTION FUND — REGULATION
24AND ADVANCEMENT OF OUTDOOR ACTIVITIES.
   251.  There is appropriated from the state fish and game
26protection fund to the department of natural resources for the
27fiscal year beginning July 1, 2018, and ending June 30, 2019,
28the following amount, or so much thereof as is necessary, to be
29used for the purposes designated:
   30For purposes of supporting the regulation or advancement of
31hunting, fishing, or trapping, or the protection, propagation,

   83.  Notwithstanding section 455A.10, the department of
9natural resources may use the unappropriated balance remaining
10in the state fish and game protection fund for the fiscal

12necessary to fund salary adjustments for departmental employees
13for which the general assembly has made an operating budget

   20c.  Of the remaining amount appropriated in paragraph “a”,
21for use by the department in providing for soil and water
22conservation administration, the conservation of soil and
23water resources, or the support of soil and water conservation
24districts:

27department allocates to a soil and water conservation district,
28the first $7,500 may be expended by the district for the

32to nontill planting, ridge-till planting, and contouring
33strip-cropping. Of any remaining amount of that appropriation
34allocated by the department to a district, 30 percent may be

6practices to protect watersheds above publicly owned lakes of
7the state from soil erosion and sediment as provided in section
8161A.73.
   9g.  The state soil conservation committee established by
10section 161A.4 may allocate moneys appropriated in paragraph
11“c” to conduct research and demonstration projects to promote
12conservation tillage and nonpoint source pollution control
13practices.
   14h.  The allocation of moneys as financial incentives as
15provided in section 161A.73 may be used in combination with
16moneys allocated by the department of natural resources.
   17i.  Not more than 15 percent of the moneys appropriated
18in paragraph “c” may be used for costs of administration and
19implementation of soil and water conservation practices.
20   Sec. 53.  DEPARTMENT OF NATURAL RESOURCES.  There is
21appropriated from the environment first fund created in section
228.57A to the department of natural resources for the fiscal

4Act that remain unencumbered or unobligated at the close of the
5fiscal year shall not revert but instead shall remain available
6to be used for the purposes designated until the close of the
7succeeding fiscal year, or until the project for which the
8appropriation was made is completed, whichever is earlier.
   9b.  Notwithstanding section 8.33, moneys appropriated for
10the fiscal year beginning July 1, 2018, in this division of
11this Act to the department of agriculture and land stewardship
12to provide financial assistance for the establishment of
13permanent soil and water conservation practices that remain
14unencumbered or unobligated at the close of the fiscal year
15shall not revert but instead shall remain available for
16expenditure for the purposes designated until the close of the
17fiscal year beginning July 1, 2021.
   182.  Subsection 1 does not apply to moneys transferred
19pursuant to this division to the loess hills development and
20conservation fund created in section 161D.2 which shall not
21revert as provided in that section.
22DIVISION XVI
23ENVIRONMENT FIRST FUND
24SPECIAL APPROPRIATION FOR FY 2018-2019
25   Sec. 55.  WATER QUALITY INITIATIVE — DEPARTMENT OF
26AGRICULTURE AND LAND STEWARDSHIP.
   271.  There is appropriated from the environment first fund
28created in section 8.57A to the department of agriculture
29and land stewardship for the fiscal year beginning July 1,
302018, and ending June 30, 2019, the following amount, or so
31much thereof as is necessary, to be used for the purposes
32designated:
   33For deposit in the water quality initiative fund created in
34section 466B.45, for purposes of supporting the water quality
35initiative administered by the division of soil conservation

   42.  a.  The moneys appropriated in subsection 1 shall be
5used to support projects in subwatersheds as designated by the
6division that are part of high-priority watersheds identified
7by the water resources coordinating council established
8pursuant to section 466B.3.
   9b.  The moneys appropriated in subsection 1 shall be used to
10support projects in watersheds generally, including regional
11watersheds, as designated by the division and high-priority
12watersheds identified by the water resources coordinating
13council established pursuant to section 466B.3.
   143.  In supporting projects in subwatersheds and watersheds
15as provided in subsection 2, all of the following shall apply:
   16a.  The demonstration projects shall utilize water quality
17practices as described in the latest revision of the document
18entitled “Iowa Nutrient Reduction Strategy” initially presented
19in November 2012 by the department of agriculture and land
20stewardship, the department of natural resources, and Iowa
21state university of science and technology.
   22b.  The division shall implement demonstration projects as
23provided in paragraph “a” by providing for participation by
24persons who hold a legal interest in agricultural land used in
25farming. To every extent practical, the division shall provide
26for collaborative participation by such persons who hold a
27legal interest in agricultural land located within the same
28subwatershed.
   29c.  The division shall implement a demonstration project on
30a cost-share basis as determined by the division. However,
31except for edge-of-field practices, the state’s share of the
32amount shall not exceed 50 percent of the estimated cost of
33establishing the practice as determined by the division or
3450 percent of the actual cost of establishing the practice,
35whichever is less.

   1d.  The demonstration projects shall be used to educate other
2persons about the feasibility and value of establishing similar
3water quality practices. The division shall promote field day
4events for purposes of allowing interested persons to establish
5water quality practices on their agricultural land.
   6e.  The division shall conduct water quality evaluations
7within supported subwatersheds. Within a reasonable period
