Senate Study Bill 1196 - IntroducedA Bill ForAn Act 1making appropriations to the department of cultural

7BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1DIVISION I
2 FY 2017-2018
3   Section 1.  DEPARTMENT OF CULTURAL AFFAIRS.
   41.  There is appropriated from the general fund of the state
5to the department of cultural affairs for the fiscal year
6beginning July 1, 2017, and ending June 30, 2018, the following
7amounts, or so much thereof as is necessary, to be used for the
8purposes designated:
   9a.  ADMINISTRATION
   10For salaries, support, maintenance, and miscellaneous
11purposes, and for not more than the following full-time
12equivalent positions for the department:

   15The department of cultural affairs shall coordinate
16activities with the tourism office of the economic development
17authority to promote attendance at the state historical
18building and at this state’s historic sites.
   19Full-time equivalent positions authorized under this

21appropriated under this paragraph and paragraphs “c” through
22“g”.
   23b.  COMMUNITY CULTURAL GRANTS

   162.  Notwithstanding section 8.33, moneys appropriated in
17this section that remain unencumbered or unobligated at the
18close of the fiscal year shall not revert but shall remain
19available for expenditure for the purposes designated until the
20close of the succeeding fiscal year.
21   Sec. 2.  GOALS AND ACCOUNTABILITY — ECONOMIC DEVELOPMENT.
   221.  For the fiscal year beginning July 1, 2017, the goals
23for the economic development authority shall be to expand and
24stimulate the state economy, increase the wealth of Iowans, and
25increase the population of the state.
   262.  To achieve the goals in subsection 1, the economic
27development authority shall do all of the following for the
28fiscal year beginning July 1, 2017:
   29a.  Concentrate its efforts on programs and activities that
30result in commercially viable products and services.
   31b.  Adopt practices and services consistent with free
32market, private sector philosophies.
   33c.  Ensure economic growth and development throughout the
34state.
   35d.  Work with businesses and communities to continually
-2-1improve the economic development climate along with the
2economic well-being and quality of life for Iowans.
   3e.  Coordinate with other state agencies to ensure that they
4are attentive to the needs of an entrepreneurial culture.
   5f.  Establish a strong and aggressive marketing image to
6showcase Iowa’s workforce, existing industry, and potential.
7A priority shall be placed on recruiting new businesses,
8business expansion, and retaining existing Iowa businesses.
9Emphasis shall be placed on entrepreneurial development through
10helping entrepreneurs secure capital, and developing networks
11and a business climate conducive to entrepreneurs and small
12businesses.
   13g.  Encourage the development of communities and quality of
14life to foster economic growth.
   15h.  Prepare communities for future growth and development
16through development, expansion, and modernization of
17infrastructure.
   18i.  Develop public-private partnerships with Iowa businesses
19in the tourism industry, Iowa tour groups, Iowa tourism
20organizations, and political subdivisions in this state to
21assist in the development of advertising efforts.
   22j.  Develop, to the fullest extent possible, cooperative
23efforts for advertising with contributions from other sources.
24   Sec. 3.  ECONOMIC DEVELOPMENT AUTHORITY.
   251.  APPROPRIATION
   26a.  There is appropriated from the general fund of the state
27to the economic development authority for the fiscal year
28beginning July 1, 2017, and ending June 30, 2018, the following
29amount, or so much thereof as is necessary, to be used for the
30purposes designated in this subsection, and for not more than
31the following full-time equivalent positions:

   34b.  (1)  For salaries, support, miscellaneous purposes,
35programs, marketing, and the maintenance of an administration
-3-1division, a business development division, a community
2development division, a small business development division,
3and other divisions the authority may organize.
   4(2)  The full-time equivalent positions authorized under
5this section are funded, in whole or in part, by the moneys
6appropriated under this subsection or by other moneys received
7by the authority, including certain federal moneys.
   8(3)  For business development operations and programs,
9international trade, export assistance, workforce recruitment,
10and the partner state program.
   11(4)  For transfer to a fund created pursuant to section
1215.313 for purposes of financing strategic infrastructure
13projects.
   14(5)  For community economic development programs, tourism
15operations, community assistance, plans for Iowa green corps
16and summer youth programs, the mainstreet and rural mainstreet
17programs, the school-to-career program, the community
18development block grant, and housing and shelter-related
19programs.
   20(6)  For achieving the goals and accountability, and
21fulfilling the requirements and duties required under this Act.
   22c.  Notwithstanding section 8.33, moneys appropriated in
23this subsection that remain unencumbered or unobligated at the
24close of the fiscal year shall not revert but shall remain
25available for expenditure for the purposes designated in this
26subsection until the close of the succeeding fiscal year.
   272.  FINANCIAL ASSISTANCE RESTRICTIONS
   28a.  A business creating jobs through moneys appropriated in
29subsection 1 shall be subject to contract provisions requiring
30new and retained jobs to be filled by individuals who are
31citizens of the United States who reside within the United
32States or any person authorized to work in the United States
33pursuant to federal law, including legal resident aliens in the
34United States.
   35b.  Any vendor who receives moneys appropriated in
-4-1subsection 1 shall adhere to such contract provisions and
2provide periodic assurances as the state shall require that the
3jobs are filled solely by citizens of the United States who
4reside within the United States or any person authorized to
5work in the United States pursuant to federal law, including
6legal resident aliens in the United States.
   7c.  A business that receives financial assistance from
8the authority from moneys appropriated in subsection 1 shall
9only employ individuals legally authorized to work in this
10state. In addition to all other applicable penalties provided
11by current law, all or a portion of the assistance received
12by a business which is found to knowingly employ individuals
13not legally authorized to work in this state is subject to
14recapture by the authority.
   153.  USES OF APPROPRIATIONS
   16a.  From the moneys appropriated in subsection 1, the
17authority may provide financial assistance in the form of a
18grant to a community economic development entity for conducting
19a local workforce recruitment effort designed to recruit former
20citizens of the state and former students at colleges and
21universities in the state to meet the needs of local employers.
   22b.  From the moneys appropriated in subsection 1, the
23authority may provide financial assistance to early stage
24industry companies being established by women entrepreneurs.
   25c.  From the moneys appropriated in subsection 1, the
26authority may provide financial assistance in the form of
27grants, loans, or forgivable loans for advanced research and
28commercialization projects involving value-added agriculture,
29advanced technology, or biotechnology.
   30d.  The authority shall not use any moneys appropriated in
31subsection 1 for purposes of providing financial assistance for
32the Iowa green streets pilot project or for any other program
33or project that involves the installation of geothermal systems
34for melting snow and ice from streets or sidewalks.
   354.WORLD FOOD PRIZE

1There is appropriated from the general fund of the state
2to the economic development authority for the fiscal year
3beginning July 1, 2017, and ending June 30, 2018, the following
4amount for the world food prize and in lieu of the standing
5appropriation in section 15.368:

8There is appropriated from the general fund of the state
9to the economic development authority for the fiscal year
10beginning July 1, 2017, and ending June 30, 2018, the following
11amount for allocation to the Iowa commission on volunteer
12service for purposes of the Iowa state commission grant
13program, the Iowa’s promise and Iowa mentoring partnership
14programs, and for not more than the following full-time
15equivalent positions:

18Of the moneys appropriated in this subsection, the
19authority shall allocate $75,000 for purposes of the Iowa state
20commission grant program and $93,201 for purposes of the Iowa’s

23subsection that remain unencumbered or unobligated at the close
24of the fiscal year shall not revert but shall remain available
25for expenditure for the purposes designated until the close of
26the succeeding fiscal year.
   276.  COUNCILS OF GOVERNMENTS — ASSISTANCE
   28There is appropriated from the general fund of the state
29to the economic development authority for the fiscal year
30beginning July 1, 2017, and ending June 30, 2018, the following
31amount to be used for the purposes of providing financial
32assistance to Iowa’s councils of governments:

   347.  SCIENCE, TECHNOLOGY, ENGINEERING, AND MATHEMATICS
35INTERNSHIPS

   1a.  There is appropriated from the Iowa skilled worker and
2job creation fund created in section 8.75 to the Iowa economic
3development authority for the fiscal year beginning July 1,
42017, and ending June 30, 2018, the following amount, or so
5much thereof as is necessary, for the purposes designated:
   6For the funding of internships for students studying in the
7fields of science, technology, engineering, and mathematics
8with eligible Iowa employers as provided in section 15.411,
9subsection 3, paragraph “c”:

   11b.  No more than 3 percent of the moneys appropriated in this
12subsection may be used by the authority for costs associated
13with administration of the internship program.
   14c.  Notwithstanding section 8.33, moneys appropriated in
15this subsection which remain unencumbered or unobligated at

17available for expenditure for the purposes designated in
18subsequent fiscal years.
19   Sec. 4.  LIMITATIONS OF STANDING APPROPRIATIONS — FY
202017-2018.
  Notwithstanding the standing appropriations
21in the following designated sections for the fiscal year
22beginning July 1, 2017, and ending June 30, 2018, the amounts
23appropriated from the general fund of the state pursuant to
24these sections for the following purposes shall not exceed the
25following amounts:
   261.  For operational support grants and community cultural
27grants under section 99F.11, subsection 3, paragraph “d”,
28subparagraph (1):

   302.  For the purposes of regional tourism marketing under
31section 99F.11, subsection 3, paragraph “d”, subparagraph (2):

33   Sec. 5.  INSURANCE ECONOMIC DEVELOPMENT.  From the moneys
34collected by the division of insurance in excess of the
35anticipated gross revenues under section 505.7, subsection
-7-13, during the fiscal year beginning July 1, 2017, $100,000
2shall be transferred to the economic development authority for
3insurance economic development and international insurance
4economic development.
5   Sec. 6.  IOWA FINANCE AUTHORITY.
   61.  There is appropriated from the general fund of the state
7to the Iowa finance authority for the fiscal year beginning
8July 1, 2017, and ending June 30, 2018, the following amount,
9or so much thereof as is necessary, to be used to provide
10reimbursement for rent expenses to eligible persons under the
11rent subsidy program:

   132.  Participation in the rent subsidy program shall be
14limited to only those persons who meet the requirements for the
15nursing facility level of care for home and community-based
16services waiver services as in effect on July 1, 2017,
17and to those individuals who are eligible for the federal
18money follows the person grant program under the medical
19assistance program. If the Iowa finance authority utilizes
20a waiting list, the authority shall give priority to a
21person participating in the state’s money follows the person
22partnership for community integration project who has been
23assigned to work with a transition specialist. Of the moneys
24appropriated in this section, not more than $35,000 may be used
25for administrative costs.
26   Sec. 7.  IOWA FINANCE AUTHORITY AUDIT.  The auditor of state
27is requested to review the audit of the Iowa finance authority
28performed by the auditor hired by the authority.
29   Sec. 8.  PUBLIC EMPLOYMENT RELATIONS BOARD.
   301.  There is appropriated from the general fund of the state
31to the public employment relations board for the fiscal year
32beginning July 1, 2017, and ending June 30, 2018, the following
33amount, or so much thereof as is necessary, for the purposes
34designated:
   35For salaries, support, maintenance, and miscellaneous

   52.  Of the moneys appropriated in this section, the board
6shall allocate $15,000 for maintaining an internet site that
7allows searchable access to a database of collective bargaining

9   Sec. 9.  DEPARTMENT OF WORKFORCE DEVELOPMENT.  There
10is appropriated from the general fund of the state to the
11department of workforce development for the fiscal year
12beginning July 1, 2017, and ending June 30, 2018, the following
13amounts, or so much thereof as is necessary, for the purposes
14designated:
   151.  DIVISION OF LABOR SERVICES
   16a.  For the division of labor services, including salaries,
17support, maintenance, and miscellaneous purposes, and for not
18more than the following full-time equivalent positions:

   21b.  From the contractor registration fees, the division of
22labor services shall reimburse the department of inspections
23and appeals for all costs associated with hearings under
24chapter 91C, relating to contractor registration.
   252.  DIVISION OF WORKERS’ COMPENSATION
   26a.  For the division of workers’ compensation, including
27salaries, support, maintenance, and miscellaneous purposes, and
28for not more than the following full-time equivalent positions:

   31b.  The division of workers’ compensation shall charge a
32$100 filing fee for workers’ compensation cases. The filing
33fee shall be paid by the petitioner of a claim. However, the
34fee can be taxed as a cost and paid by the losing party, except
35in cases where it would impose an undue hardship or be unjust
-9-1under the circumstances. The moneys generated by the filing
2fee allowed under this subsection are appropriated to the
3department of workforce development to be used for purposes of
4administering the division of workers’ compensation.
   53.  WORKFORCE DEVELOPMENT OPERATIONS
   6a.  For the operation of field offices, the workforce
7development board, and for not more than the following
8full-time equivalent positions:

   11b.  Of the moneys appropriated in paragraph “a” of this
12subsection, the department shall allocate $150,000 to the state
13library for the purpose of licensing an online resource which
14prepares persons to succeed in the workplace through programs

   164.  OFFENDER REENTRY PROGRAM
   17a.  For the development and administration of an offender
18reentry program to provide offenders with employment skills,
19and for not more than the following full-time equivalent
20positions:

   23b.  The department of workforce development shall partner
24with the department of corrections to provide staff within the
25correctional facilities to improve offenders’ abilities to find
26and retain productive employment.

29administrative services related to the integrated information
30for Iowa system:

3   Sec. 10.  GENERAL FUND — EMPLOYEE MISCLASSIFICATION
4PROGRAM.
  There is appropriated from the general fund of the
5state to the department of workforce development for the fiscal
6year beginning July 1, 2017, and ending June 30, 2018, the
7following amount, or so much thereof as is necessary, to be
8used for the purposes designated:
   9For enhancing efforts to investigate employers that
10misclassify workers and for not more than the following
11full-time equivalent positions:

14   Sec. 11.  SPECIAL EMPLOYMENT SECURITY CONTINGENCY FUND.
   151.  There is appropriated from the special employment
16security contingency fund to the department of workforce
17development for the fiscal year beginning July 1, 2017, and
18ending June 30, 2018, the following amount, or so much thereof
19as is necessary, to be used for field offices:

   212.  Any remaining additional penalty and interest revenue
22collected by the department of workforce development is
23appropriated to the department for the fiscal year beginning
24July 1, 2017, and ending June 30, 2018, to accomplish the
25mission of the department.
26   Sec. 12.  UNEMPLOYMENT COMPENSATION RESERVE FUND —
27FIELD OFFICES.
  Notwithstanding section 96.9, subsection 8,
28paragraph “e”, there is appropriated from interest earned on
29the unemployment compensation reserve fund to the department
30of workforce development for the fiscal year beginning July 1,
312017, and ending June 30, 2018, the following amount, or so
32much thereof as is necessary, for the purposes designated:

35   Sec. 13.  VIRTUAL ACCESS WORKFORCE DEVELOPMENT OFFICES.  The
-11-1department of workforce development shall require a unique
2identification login for all users of workforce development
3centers operated through electronic means.
4   Sec. 14.  UNEMPLOYMENT COMPENSATION PROGRAM.  Notwithstanding
5section 96.9, subsection 4, paragraph “a”, moneys credited to
6the state by the secretary of the treasury of the United
7States pursuant to section 903 of the Social Security
8Act are appropriated to the department of workforce
9development and shall be used by the department for the
10administration of the unemployment compensation program only.
11This appropriation shall not apply to any fiscal year
12beginning after December 31, 2017.
13   Sec. 15.  UNEMPLOYMENT INSURANCE SYSTEMS MODERNIZATION
14— USE OF FUNDS AUTHORIZATION.
  Incentive payment moneys
15transferred by the secretary of labor of the United States to
16the state as a special transfer pursuant to section 2003 of
17the Assistance for Unemployed Workers and Struggling Families
18Act, enacted pursuant to Pub.L. No.111-5, and credited to
19the unemployment compensation fund established pursuant to
20section 96.9, are appropriated to the department of workforce
21development for the fiscal year beginning July 1, 2017, for the
22purpose of unemployment insurance systems modernization and
23for the acquisition of programming, software, and equipment
24required to provide an administrative system for the Iowa
25unemployment insurance program, in an amount not to exceed the
26following amount:

28   Sec. 16.  UNEMPLOYMENT COMPENSATION AND EMPLOYMENT SERVICES
29PROGRAMS — USE OF FUNDS AUTHORIZATION.
  Incentive payment
30moneys transferred by the secretary of labor of the United
31States to the state as a special transfer pursuant to section
322003 of the Assistance for Unemployed Workers and Struggling
33Families Act, enacted pursuant to Pub.L. No.111-5, and
34credited to the unemployment compensation fund established
35pursuant to section 96.9, are appropriated to the department
-12-1of workforce development for the fiscal year beginning July 1,
22017, for the administration of the Iowa employment security
3law and public employment offices, in an amount not to exceed
4the following amount:

6   Sec. 17.   IOWA SKILLED WORKER AND JOB CREATION FUND.
   71.  There is appropriated from the Iowa skilled worker and
8job creation fund created in section 8.75 to the following
9departments, agencies, and institutions for the fiscal year
10beginning July 1, 2017, and ending June 30, 2018, the following
11amounts, or so much thereof as is necessary, to be used for the
12purposes designated:
   13a.  ECONOMIC DEVELOPMENT AUTHORITY
   14(1)  For the purposes of providing assistance under the high
15quality jobs program as described in section 15.335B:

   17(2)  From the moneys appropriated in this lettered paragraph
18“a”, the economic development authority may use not more than
19$1,000,000 for purposes of providing infrastructure grants to
20mainstreet communities under the main street Iowa program.
   21(3)  As a condition of receiving moneys appropriated in
22this lettered paragraph “a”, an entity shall testify upon the
23request of the joint appropriations subcommittee on economic
24development regarding the expenditure of such moneys.
   25b.  STATE BOARD OF REGENTS AND REGENTS INSTITUTIONS
   26(1)  STATE BOARD OF REGENTS. For capacity building
27infrastructure in areas related to technology
28commercialization, marketing and business development
29efforts in areas related to technology commercialization,
30entrepreneurship, and business growth, and infrastructure
31projects and programs needed to assist in implementation of
32activities under chapter 262B:

   34Of the moneys appropriated pursuant to this subparagraph
35(1), 35 percent shall be allocated for Iowa state university of
-13-1science and technology, 35 percent shall be allocated for the
2state university of Iowa, and 30 percent shall be allocated for
3the university of northern Iowa.
   4(a)  The institutions shall provide a one-to-one match
5of additional moneys for the activities funded with moneys
6appropriated under this subparagraph (1).
   7(b)  The state board of regents shall annually submit a
8report by January 15 to the governor, the general assembly,
9and the legislative services agency regarding the activities,
10projects, and programs funded with moneys appropriated under
11this subparagraph (1). The report shall be provided in an
12electronic format and shall include a list of metrics and
13criteria mutually agreed to in advance by the board of regents
14and the economic development authority. The metrics and
15criteria shall allow the governor’s office and the general
16assembly to quantify and evaluate the progress of the board of
17regents institutions with regard to their activities, projects,
18and programs in the areas of technology commercialization,
19entrepreneurship, regional development, and market research.
   20(2)  IOWA STATE UNIVERSITY OF SCIENCE AND TECHNOLOGY. For
21small business development centers, the science and technology
22research park, and the center for industrial research and
23service, and for not more than the following full-time
24equivalent positions:

   27(a)  Of the moneys appropriated in this subparagraph (2),
28Iowa state university of science and technology shall allocate
29at least $735,728 for purposes of funding small business
30development centers. Iowa state university of science and
31technology may allocate the appropriated moneys to the various
32small business development centers in any manner necessary to
33achieve the purposes of this subparagraph.
   34(b)  Iowa state university of science and technology shall
35do all of the following:

   1(i)  Direct expenditures for research toward projects that
2will provide economic stimulus for Iowa.
   3(ii)  Provide emphasis to providing services to Iowa-based
4companies.
   5(c)  It is the intent of the general assembly that the
6industrial incentive program focus on Iowa industrial sectors
7and seek contributions and in-kind donations from businesses,
8industrial foundations, and trade associations, and that moneys
9for the center for industrial research and service industrial
10incentive program shall be allocated only for projects which
11are matched by private sector moneys for directed contract
12research or for nondirected research. The match required of
13small businesses as defined in section 15.102, subsection 8,
14for directed contract research or for nondirected research
15shall be $1 for each $3 of state funds. The match required
16for other businesses for directed contract research or
17for nondirected research shall be $1 for each $1 of state
18funds. The match required of industrial foundations or trade
19associations shall be $1 for each $1 of state funds.
   20Iowa state university of science and technology shall
21report annually to the joint appropriations subcommittee on
22economic development and the legislative services agency the
23total amount of private contributions, the proportion of
24contributions from small businesses and other businesses, and
25the proportion for directed contract research and nondirected
26research of benefit to Iowa businesses and industrial sectors.
   27(3)  STATE UNIVERSITY OF IOWA. For the state university
28of Iowa research park and for the advanced drug development
29program at the Oakdale research park, including salaries,
30support, maintenance, equipment, and miscellaneous purposes,
31and for not more than the following full-time equivalent
32positions:

17   Sec. 18.  DEPARTMENT OF CULTURAL AFFAIRS.

19state to the department of cultural affairs for the fiscal year

1   Sec. 19.  GOALS AND ACCOUNTABILITY — ECONOMIC DEVELOPMENT.
   2 1.  For the fiscal year beginning July 1, 2018, the goals
3for the economic development authority shall be to expand and
4stimulate the state economy, increase the wealth of Iowans, and
5increase the population of the state.
   6 2.  To achieve the goals in subsection 1, the economic
7development authority shall do all of the following for the
8fiscal year beginning July 1, 2018:
   9 a.  Concentrate its efforts on programs and activities that
10result in commercially viable products and services.
   11 b.  Adopt practices and services consistent with free
12market, private sector philosophies.
   13 c.  Ensure economic growth and development throughout the
14state.
   15 d.  Work with businesses and communities to continually
16improve the economic development climate along with the
17economic well-being and quality of life for Iowans.
   18 e.  Coordinate with other state agencies to ensure that they
19are attentive to the needs of an entrepreneurial culture.
   20 f.  Establish a strong and aggressive marketing image to
21showcase Iowa’s workforce, existing industry, and potential.
22A priority shall be placed on recruiting new businesses,
23business expansion, and retaining existing Iowa businesses.
24Emphasis shall be placed on entrepreneurial development through
25helping entrepreneurs secure capital, and developing networks
26and a business climate conducive to entrepreneurs and small
27businesses.
   28 g.  Encourage the development of communities and quality of
29life to foster economic growth.
   30 h.  Prepare communities for future growth and development
31through development, expansion, and modernization of
32infrastructure.
   33 i.  Develop public-private partnerships with Iowa
34businesses in the tourism industry, Iowa tour groups, Iowa
35tourism organizations, and political subdivisions in this state
-19-1to assist in the development of advertising efforts.
   2 j.  Develop, to the fullest extent possible, cooperative
3efforts for advertising with contributions from other sources.
4   Sec. 20.  ECONOMIC DEVELOPMENT AUTHORITY.
   5 1.  APPROPRIATION
   6 a.  There is appropriated from the general fund of the
7state to the economic development authority for the fiscal year
8beginning July 1, 2018, and ending June 30, 2019, the following
9amount, or so much thereof as is necessary, to be used for the
10purposes designated in this subsection, and for not more than
11the following full-time equivalent positions:

   14 b.  (1)  For salaries, support, miscellaneous purposes,
15programs, marketing, and the maintenance of an administration
16division, a business development division, a community
17development division, a small business development division,

20this section are funded, in whole or in part, by the moneys
21appropriated under this subsection or by other moneys received
22by the authority, including certain federal moneys.
   23 (3)  For business development operations and programs,
24international trade, export assistance, workforce recruitment,
25and the partner state program.
   26 (4)  For transfer to a fund created pursuant to section
2715.313 for purposes of financing strategic infrastructure
28projects.
   29 (5)  For community economic development programs, tourism
30operations, community assistance, plans for Iowa green corps
31and summer youth programs, the mainstreet and rural mainstreet
32programs, the school-to-career program, the community
33development block grant, and housing and shelter-related
34programs.
   35 (6)  For achieving the goals and accountability, and
-20-1fulfilling the requirements and duties required under this Act.
   2 c.  Notwithstanding section 8.33, moneys appropriated in
3this subsection that remain unencumbered or unobligated at the
4close of the fiscal year shall not revert but shall remain
5available for expenditure for the purposes designated in this
6subsection until the close of the succeeding fiscal year.
   7 2.  FINANCIAL ASSISTANCE RESTRICTIONS
   8 a.  A business creating jobs through moneys appropriated in
9subsection 1 shall be subject to contract provisions requiring
10new and retained jobs to be filled by individuals who are
11citizens of the United States who reside within the United
12States or any person authorized to work in the United States
13pursuant to federal law, including legal resident aliens in the
14United States.
   15 b.  Any vendor who receives moneys appropriated in
16subsection 1 shall adhere to such contract provisions and
17provide periodic assurances as the state shall require that the
18jobs are filled solely by citizens of the United States who
19reside within the United States or any person authorized to
20work in the United States pursuant to federal law, including
21legal resident aliens in the United States.
   22 c.  A business that receives financial assistance from
23the authority from moneys appropriated in subsection 1 shall
24only employ individuals legally authorized to work in this
25state. In addition to all other applicable penalties provided
26by current law, all or a portion of the assistance received
27by a business which is found to knowingly employ individuals
28not legally authorized to work in this state is subject to
29recapture by the authority.
   30 3.  USES OF APPROPRIATIONS
   31 a.  From the moneys appropriated in subsection 1, the
32authority may provide financial assistance in the form of a
33grant to a community economic development entity for conducting
34a local workforce recruitment effort designed to recruit former
35citizens of the state and former students at colleges and
-21-1universities in the state to meet the needs of local employers.
   2 b.  From the moneys appropriated in subsection 1, the
3authority may provide financial assistance to early stage
4industry companies being established by women entrepreneurs.
   5 c.  From the moneys appropriated in subsection 1, the
6authority may provide financial assistance in the form of
7grants, loans, or forgivable loans for advanced research and
8commercialization projects involving value-added agriculture,
9advanced technology, or biotechnology.
   10 d.  The authority shall not use any moneys appropriated in
11subsection 1 for purposes of providing financial assistance for
12the Iowa green streets pilot project or for any other program
13or project that involves the installation of geothermal systems
14for melting snow and ice from streets or sidewalks.
   15 4.WORLD FOOD PRIZE
16 There is appropriated from the general fund of the state
17to the economic development authority for the fiscal year
18beginning July 1, 2018, and ending June 30, 2019, the following
19amount for the world food prize and in lieu of the standing
20appropriation in section 15.368:

11amount to be used for the purposes of providing financial
12assistance to Iowa’s councils of governments:

   14 7.  SCIENCE, TECHNOLOGY, ENGINEERING, AND MATHEMATICS
15INTERNSHIPS
   16 a.  There is appropriated from the Iowa skilled worker and
17job creation fund created in section 8.75 to the Iowa economic
18development authority for the fiscal year beginning July 1,
192018, and ending June 30, 2019, the following amount, or so
20much thereof as is necessary, for the purposes designated:
   21 For the funding of internships for students studying in the
22fields of science, technology, engineering, and mathematics
23with eligible Iowa employers as provided in section 15.411,
24subsection 3, paragraph “c”:

   26 b.  No more than 3 percent of the moneys appropriated
27in this subsection may be used by the authority for costs
28associated with administration of the internship program.

32available for expenditure for the purposes designated in
33subsequent fiscal years.
34   Sec. 21.  LIMITATIONS OF STANDING APPROPRIATIONS — FY
352018-2019.
  Notwithstanding the standing appropriations

2beginning July 1, 2018, and ending June 30, 2019, the amounts
3appropriated from the general fund of the state pursuant to
4these sections for the following purposes shall not exceed the
5following amounts:
   6 1.  For operational support grants and community cultural
7grants under section 99F.11, subsection 3, paragraph “d”,
8subparagraph (1):

14collected by the division of insurance in excess of the
15anticipated gross revenues under section 505.7, subsection 3,
16during the fiscal year beginning July 1, 2018, $50,000 shall be
17transferred to the economic development authority for insurance
18economic development and international insurance economic
19development.
20   Sec. 23.  IOWA FINANCE AUTHORITY.
   21 1.  There is appropriated from the general fund of the state
22to the Iowa finance authority for the fiscal year beginning
23July 1, 2018, and ending June 30, 2019, the following amount,
24or so much thereof as is necessary, to be used to provide
25reimbursement for rent expenses to eligible persons under the
26rent subsidy program:

   28 2.  Participation in the rent subsidy program shall be
29limited to only those persons who meet the requirements for the
30nursing facility level of care for home and community-based
31services waiver services as in effect on July 1, 2018,
32and to those individuals who are eligible for the federal
33money follows the person grant program under the medical
34assistance program. If the Iowa finance authority utilizes
35a waiting list, the authority shall give priority to a
-24-1person participating in the state’s money follows the person
2partnership for community integration project who has been
3assigned to work with a transition specialist. Of the moneys
4appropriated in this section, not more than $17,500 may be used
5for administrative costs.
6   Sec. 24.  IOWA FINANCE AUTHORITY AUDIT.  The auditor of state
7is requested to review the audit of the Iowa finance authority
8performed by the auditor hired by the authority.
9   Sec. 25.  PUBLIC EMPLOYMENT RELATIONS BOARD.
   10 1.  There is appropriated from the general fund of the state
11to the public employment relations board for the fiscal year
12beginning July 1, 2018, and ending June 30, 2019, the following
13amount, or so much thereof as is necessary, for the purposes
14designated:
   15 For salaries, support, maintenance, and miscellaneous
16purposes, and for not more than the following full-time

12$100 filing fee for workers’ compensation cases. The filing
13fee shall be paid by the petitioner of a claim. However, the

16under the circumstances. The moneys generated by the filing
17fee allowed under this subsection are appropriated to the
18department of workforce development to be used for purposes of
19administering the division of workers’ compensation.
   20 3.  WORKFORCE DEVELOPMENT OPERATIONS
   21 a.  For the operation of field offices, the workforce

17identification login for all users of workforce development

19   Sec. 31.  UNEMPLOYMENT COMPENSATION PROGRAM.  Notwithstanding
20section 96.9, subsection 4, paragraph “a”, moneys credited to
21the state by the secretary of the treasury of the United
22States pursuant to section 903 of the Social Security
23Act are appropriated to the department of workforce
24development and shall be used by the department for the
25administration of the unemployment compensation program only.
26This appropriation shall not apply to any fiscal year
27beginning after December 31, 2018.
28   Sec. 32.   IOWA SKILLED WORKER AND JOB CREATION FUND.
   29 1.  There is appropriated from the Iowa skilled worker and
30job creation fund created in section 8.75 to the following
31departments, agencies, and institutions for the fiscal year
32beginning July 1, 2018, and ending June 30, 2019, the following
33amounts, or so much thereof as is necessary, to be used for the
34purposes designated:
   35 a.  ECONOMIC DEVELOPMENT AUTHORITY

   1 (1)  For the purposes of providing assistance under the high
2quality jobs program as described in section 15.335B:

   12 b.  STATE BOARD OF REGENTS AND REGENTS INSTITUTIONS
   13 (1)  STATE BOARD OF REGENTS. For capacity
14building infrastructure in areas related to technology
15commercialization, marketing and business development
16efforts in areas related to technology commercialization,
17entrepreneurship, and business growth, and infrastructure
18projects and programs needed to assist in implementation of
19activities under chapter 262B:

   21 Of the moneys appropriated pursuant to this subparagraph
22(1), 35 percent shall be allocated for Iowa state university of
23science and technology, 35 percent shall be allocated for the

   26 (a)  The institutions shall provide a one-to-one match
27of additional moneys for the activities funded with moneys
28appropriated under this subparagraph (1).
   29 (b)  The state board of regents shall annually submit a
30report by January 15 to the governor, the general assembly,
31and the legislative services agency regarding the activities,
32projects, and programs funded with moneys appropriated under
33this subparagraph (1). The report shall be provided in an
34electronic format and shall include a list of metrics and
35criteria mutually agreed to in advance by the board of regents
-29-1and the economic development authority. The metrics and
2criteria shall allow the governor’s office and the general
3assembly to quantify and evaluate the progress of the board of
4regents institutions with regard to their activities, projects,
5and programs in the areas of technology commercialization,
6entrepreneurship, regional development, and market research.
   7 (2)  IOWA STATE UNIVERSITY OF SCIENCE AND TECHNOLOGY. For
8small business development centers, the science and technology
9research park, and the center for industrial research and
10service, and for not more than the following full-time
11equivalent positions:

   14 (a)  Of the moneys appropriated in this subparagraph (2),
15Iowa state university of science and technology shall allocate
16at least $367,864 for purposes of funding small business
17development centers. Iowa state university of science and

19small business development centers in any manner necessary to
20achieve the purposes of this subparagraph.
   21 (b)  Iowa state university of science and technology shall
22do all of the following:
   23 (i)  Direct expenditures for research toward projects that
24will provide economic stimulus for Iowa.
   25 (ii)  Provide emphasis to providing services to Iowa-based
26companies.
   27 (c)  It is the intent of the general assembly that the
28industrial incentive program focus on Iowa industrial sectors
29and seek contributions and in-kind donations from businesses,
30industrial foundations, and trade associations, and that moneys
31for the center for industrial research and service industrial
32incentive program shall be allocated only for projects which
33are matched by private sector moneys for directed contract
34research or for nondirected research. The match required of
35small businesses as defined in section 15.102, subsection 8,
-30-1for directed contract research or for nondirected research
2shall be $1 for each $3 of state funds. The match required
3for other businesses for directed contract research or
4for nondirected research shall be $1 for each $1 of state
5funds. The match required of industrial foundations or trade
6associations shall be $1 for each $1 of state funds.
   7 Iowa state university of science and technology shall
8report annually to the joint appropriations subcommittee on
9economic development and the legislative services agency the
10total amount of private contributions, the proportion of
11contributions from small businesses and other businesses, and
12the proportion for directed contract research and nondirected
13research of benefit to Iowa businesses and industrial sectors.
   14 (3)  STATE UNIVERSITY OF IOWA. For the state university
15of Iowa research park and for the advanced drug development
16program at the Oakdale research park, including salaries,
17support, maintenance, equipment, and miscellaneous purposes,
18and for not more than the following full-time equivalent
19positions:

34institute, the MyEntreNet internet application, and the
35institute of decision making, including salaries, support,
-31-1maintenance, and miscellaneous purposes, and for not more than
2the following full-time equivalent positions:

   5 (a)  Of the moneys appropriated pursuant to this
6subparagraph (5), the university of northern Iowa shall
7allocate at least $308,819 for purposes of support of
8entrepreneurs through the university’s center for business
9growth and innovation and advance Iowa program.
   10 (b)  The university of northern Iowa shall do all of the
11following:
   12 (i)  Direct expenditures for research toward projects that
13will provide economic stimulus for Iowa.
   14 (ii)  Provide emphasis to providing services to Iowa-based
15companies.
   16 (6)  As a condition of receiving moneys appropriated in
17this lettered paragraph “b”, an entity shall testify upon the
18request of the joint appropriations subcommittee on economic
19development regarding the expenditure of such moneys.
   20 c.  DEPARTMENT OF WORKFORCE DEVELOPMENT
   21 To develop a long-term sustained program to train
22unemployed and underemployed central Iowans with skills
23necessary to advance to higher-paying jobs with full benefits:
..................................................  $24 50,000
   25 (1)  The department of workforce development shall begin
26a request for proposals process, issued for purposes of this
27lettered paragraph “c”, no later than September 1, 2018.
   28 (2)  As a condition of receiving moneys appropriated under
29this lettered paragraph “c”, an entity shall testify upon the
30request of the joint appropriations subcommittee on economic
31development regarding the expenditure of such moneys.
   32 2.  Notwithstanding section 8.33, moneys appropriated
33in this section of this Act that remain unencumbered or
34unobligated at the close of the fiscal year shall not revert
35but shall remain available for expenditure for the purposes
-32-1designated until the close of the succeeding fiscal year.
2DIVISION III
3 PUBLIC EMPLOYMENT RELATIONS BOARD — COSTS AND FEES
4   Sec. 33.  NEW SECTION.  20.33  Retention of costs and fees.
   5 1.  All moneys paid in advance by the board and subsequently
6taxed as a cost to a party or parties pursuant to section
720.6, subsection 6, and section 20.11, subsection 3, shall,
8when reimbursed by the party or parties taxed under those
9sections, be retained by the board as repayment receipts and
10used exclusively to offset the cost of the certified shorthand
11reporter reporting the proceeding and of any transcript
12requested by the board.
   13 2.  All fees established and collected by the board
14pursuant to section 20.6, subsection 7, shall be retained by
15the board as repayment receipts and used exclusively for the
16purpose of covering the cost of elections required pursuant to
17section 20.15, including payment for the services of any vendor
18retained by the board to conduct or assist in the conduct of
19such an election.
20DIVISION IV
21IOWA ENERGY CENTER
22   Sec. 34.  Section 15.108, subsection 9, Code 2017, is amended
23by adding the following new paragraph:
24   NEW PARAGRAPH.  g.  Administer the Iowa energy center
25established in section 15.120. This paragraph “g” is repealed
26July 1, 2022.
27   Sec. 35.  NEW SECTION.  15.120  The Iowa energy center.
   281.  The Iowa energy center is established within the
29authority with the following purposes:
   30a.  To expand workforce and career opportunities for workers
31in the energy sector to ensure that the state is able to
32attract and train professionals to meet the state’s future
33energy needs.
   34b.  To support technology-based development by encouraging
35public-private partnerships and innovative manufacturers to
-33-1develop and bring to market new energy technologies.
   2c.  To support rural and underserved areas and vulnerable
3populations by creating opportunities for greater access to
4energy efficiency expertise, training, programs, and cyber
5security preparedness for small utilities.
   6d.  To support the expansion of natural gas infrastructure to
7rural and underserved areas of the state where the absence is a
8limiting factor to economic development.
   9e.  To promote and fund research, development, and
10commercialization of biomass technology to benefit the state
11economically and environmentally by further realizing the
12value-added attributes of biomass in the development of
13bioenergy, biofuels, and biochemicals.
   14f.  To encourage growth of the alternative fuel vehicle
15market, particularly for electric vehicles, and the
16infrastructure necessary to support the market.
   17g.  To support efforts to modernize the electric grid
18infrastructure of the state to support increased capacity and
19new technologies.
   202.  a.  A governing board is established consisting of the
21following members appointed by the governor:
   22(1)  One member representing Iowa state university of
23science and technology, in consultation with the president of
24that university.
   25(2)  One member representing the university of Iowa, in
26consultation with the president of that university.
   27(3)  One member representing the university of northern
28Iowa, in consultation with the president of that university.
   29(4)  One member representing private colleges and
30universities within the state, in consultation with the Iowa
31association of independent colleges and universities.
   32(5)  One member representing community colleges, in
33consultation with the Iowa association of community college
34trustees.
   35(6)  One member representing the economic development
-34-1authority, in consultation with the director of the economic
2development authority.
   3(7)  One member representing the state department of
4transportation, in consultation with the director of the
5department of transportation.
   6(8)  One member representing the office of consumer
7advocate, in consultation with the consumer advocate.
   8(9)  One member representing the utilities board, in
9consultation with the chair of the utilities board.
   10(10)  One member representing rural electric cooperatives,
11in consultation with the Iowa association of electric
12cooperatives.
   13(11)  One member representing municipal utilities, in
14consultation with the Iowa association of municipal utilities.
   15(12)  Two members representing investor-owned utilities,
16one representing gas utilities, and one representing electric
17utilities, in consultation with the Iowa utility association.
   18b.  The terms of the members shall begin and end as provided
19in section 69.19 and any vacancy shall be filled by the
20governor as provided for in this subsection. The terms shall
21be for four years and shall be staggered as determined by the
22director of the economic development authority.
   23c.  The board shall oversee, approve, and provide direction
24concerning the programs established by the center and shall
25coordinate with the center and the director of the authority
26for the implementation of such programs. In overseeing the
27center and its programs, the board shall ensure that all
28ratepayer moneys remitted by the utilities board pursuant to
29section 476.10A are expended on programs and projects designed
30to provide benefits to gas and electric utility ratepayers.
   31d.  The deliberations or meetings of the governing board
32shall be conducted in accordance with chapter 21.
   33e.  The board, in consultation with center staff, shall adopt
34rules for the administration of the center and its programs
35pursuant to chapter 17A.

   13.  a.  The center shall employ necessary support staff.
2The center staff shall be employees of the authority. Moneys
3appropriated to the center shall be used to sponsor grants and
4projects submitted on a competitive basis by Iowa businesses,
5colleges and universities, and private nonprofit agencies and
6foundations, and for the salaries and benefits of the employees
7of the center. The center may also solicit additional grants
8and funding from public and private nonprofit agencies and
9foundations.
   10b.  The center shall prepare an annual report in coordination
11with the authority. The center shall submit the report to the
12general assembly and the legislative services agency by January
1315 of each year.
   144.  The governing board shall oversee the center in the
15development of a budget, on the policies and procedures of
16the center, in the funding of grant proposals, and in matters
17relating to program planning and review. The center’s annual
18budget shall be approved by the board.
   195.  This section is repealed July 1, 2022.
20   Sec. 36.  Section 476.1A, subsection 1, paragraph e, Code
212017, is amended to read as follows:
   22e.  Assessment of fees for the support of the Iowa energy
23center created in section 266.39C 15.120 and the center for
24global and regional environmental research established by the
25state board of regents. This paragraph “e” is repealed July 1,
262022.

27   Sec. 37.  Section 476.1B, subsection 1, paragraph k, Code
282017, is amended to read as follows:
   29k.  Assessment of fees for the support of the Iowa energy
30center created in section 266.39C 15.120 and the center for
31global and regional environmental research created by the state
32board of regents. This paragraph “k” is repealed July 1, 2022.
33   Sec. 38.  Section 476.1C, subsection 1, paragraph b, Code
342017, is amended to read as follows:
   35b.  Shall be subject to the assessment of fees for the
-36-1support of the Iowa energy center created in section 266.39C

 15.120 and the center for global and regional environmental
3research created by the state board of regents and shall file
4energy efficiency plans and energy efficiency results with
5the board. The energy efficiency plans as a whole shall be
6cost-effective. The board may waive all or part of the energy
7efficiency filing requirements if the gas utility demonstrates
8superior results with existing energy efficiency efforts

9paragraph “b” is repealed July 1, 2022.

10   Sec. 39.  Section 476.1C, subsection 1, Code 2017, is amended
11by adding the following new paragraph:
12   NEW PARAGRAPH.  0c.  Shall file energy efficiency plans
13and energy efficiency results with the board. The energy
14efficiency plans as a whole shall be cost-effective. The
15board may waive all or part of the energy efficiency filing
16requirements if the gas utility demonstrates superior results
17with existing energy efficiency efforts.
18   Sec. 40.  Section 476.10A, subsection 1, paragraph c,
19subparagraph (1), Code 2017, is amended to read as follows:
   20(1)  Eighty-five percent of the remittances collected
21pursuant to this section is appropriated to the Iowa energy
22center created in section 266.39C 15.120.
23   Sec. 41.  Section 476.10A, Code 2017, is amended by adding
24the following new subsection:
25   NEW SUBSECTION.  4.  This section is repealed July 1, 2022.
26   Sec. 42.  Section 476.46, subsection 1, Code 2017, is amended
27to read as follows:
   281.  The Iowa energy center created under section 266.39C

 15.120 shall establish and administer an alternate energy
30revolving loan program to encourage the development of
31alternate energy production facilities and small hydro
32facilities within the state.
33   Sec. 43.  Section 476.46, subsection 3, Code 2017, is amended
34by striking the subsection.
35   Sec. 44.  Section 478.29, unnumbered paragraph 1, Code 2017,
-37-1is amended to read as follows:
   2A person who violates a provision of this chapter is subject
3to a civil penalty, which may be levied by the board, of not
4more than one hundred dollars per violation or one thousand
5dollars per day of a continuing violation, whichever is
6greater. Civil penalties collected pursuant to this section
7shall be forwarded by the executive secretary of the board
8to the treasurer of state to be credited to the Iowa energy
9center created in section 266.39C
 the general fund of the state
10and appropriated to the division of community action agencies
11of the department of human rights for purposes of the low
12income home energy assistance program and the weatherization
13assistance program
.
14   Sec. 45.  Section 479.31, subsection 1, Code 2017, is amended
15to read as follows:
   161.  A person who violates this chapter or any rule or order
17issued pursuant to this chapter shall be subject to a civil
18penalty levied by the board not to exceed one hundred thousand
19dollars for each violation. Each day that the violation
20continues shall constitute a separate offense. However, the
21maximum civil penalty shall not exceed one million dollars
22for any related series of violations. Civil penalties
23collected pursuant to this section shall be credited to and
24are appropriated for the Iowa energy center created in section
25266.39C

13   Sec. 47.  REPEAL.  Section 266.39C, Code 2017, is repealed.
14   Sec. 48.  TRANSITION PROVISIONS.
   151.  Any moneys remaining in any account or fund under the
16control of Iowa state university of science and technology
17on the effective date of this division of this Act that
18were appropriated to the Iowa energy center, including
19moneys appropriated pursuant to section 476.10A, section
20476.46, section 478.29, section 479.31, or section 479B.21,
21shall, as directed by the economic development authority, be
22transferred to a comparable fund or account under the control
23of the economic development authority for such purposes.
24Notwithstanding section 8.33, the moneys transferred in
25accordance with this subsection shall not revert to the account
26or fund from which appropriated or transferred and shall be
27retained for the designated purposes.
   282.  Grants, loans, scholarships, and other financial
29commitments pledged or awarded by the Iowa energy center or
30by Iowa state university of science and technology on behalf
31of the Iowa energy center prior to the effective date of this
32division of this Act shall continue as provided by the terms of
33the grants, loans, scholarships, or other financial commitments
34and shall be administered by the Iowa economic development
35authority. Moneys received from any future repayments or
-39-1recaptures, or other moneys derived from these commitments,
2after the effective date of this division of this Act shall be
3credited to a fund or account under the control of the economic
4development authority as directed by the economic development
5authority. Contracts for the procurement of goods and
6services, leases, and facility use agreements entered into by
7the Iowa energy center or by Iowa state university of science
8and technology on behalf of the Iowa energy center shall not be
9transferred to the economic development authority and shall be
10assumed by Iowa state university of science and technology.
   113.  Title to real and personal property procured by the
12Iowa energy center or by the Iowa state university of science
13and technology on behalf of the Iowa energy center prior to
14the effective date of this division of this Act shall remain
15with or be assumed by Iowa state university of science and
16technology, except that ownership of real or personal property
17pledged as collateral on existing loans shall be transferred to
18the economic development authority.
   194.  Staff of the Iowa energy center employed by Iowa state
20university of science and technology shall not become employees
21of the economic development authority upon the effective date
22of this division of this Act.
   235.  The economic development authority and the Iowa state
24university of science and technology shall collaborate their
25efforts in transitioning the Iowa energy center to the economic
26development authority.
27   Sec. 49.  EFFECTIVE DATE.  This division of this Act takes
28effect October 1, 2017.
29 EXPLANATION
30 The inclusion of this explanation does not constitute agreement with
31the explanation’s substance by the members of the general assembly.
   32 This bill makes appropriations and transfers for FY
332017-2018 and FY 2018-2019 from the general fund of the state
34and other funds to the department of cultural affairs, the
35economic development authority, the Iowa finance authority, the
-40-1public employment relations board, the department of workforce
2development, the board of regents, the state university
3of Iowa, the university of northern Iowa, and Iowa state
4university of science and technology. The bill is organized
5by divisions.
   6 The bill appropriates moneys for FY 2017-2018 and FY
72018-2019 from the special employment security contingency fund
8to the department of workforce development for field offices.
   9 The bill appropriates interest earned on the unemployment
10compensation reserve fund for FY 2017-2018 and FY 2018-2019 to
11the department of workforce development for the operation of
12field offices.
   13 The bill appropriates moneys for FY 2017-2018 from the
14unemployment compensation fund to the department of workforce
15development for modernization of systems and for other
16programs.
   17 The bill appropriates moneys for FY 2017-2018 and FY
182018-2019 from the Iowa skilled worker and job creation fund to
19the economic development authority and the board of regents and
20certain regents institutions.
   21 The bill limits standing appropriations, established in
22Code, for the world food prize, certain operational support
23grants, community cultural grants, and regional tourism
24marketing for FY 2017-2018 and FY 2018-2019.
   25 The bill also provides for the retention of certain costs
26and fees by the public employment relations board.
   27The bill transfers the administration of the Iowa energy
28center from the Iowa state university of science and technology
29(Iowa state) to the economic development authority (EDA). The
30bill repeals Code section 266.39C and establishes new Code
31section 15.120, which places the center within the EDA. The
32bill provides that the center has the following specified
33purposes: to expand workforce and career opportunities for
34workers in the energy sector; to support technology-based
35development with public-private partnerships and innovative
-41-1manufacturers; to support rural and underserved areas and
2vulnerable populations by providing resources for energy
3efficiency and cyber security-related resources; to support
4the expansion of natural gas infrastructure to rural and
5underserved areas of the state; to promote the research,
6development, and commercialization of biomass technology; to
7encourage growth of the alternative fuel vehicle market and
8infrastructure; and to support efforts to modernize the state’s
9electric grid infrastructure.
   10The bill establishes a governing board consisting of the
11same number and background of members in the advisory council
12established in current Code section 266.39C, but all to be
13appointed by the governor in consultation with specified
14persons. The board must oversee, approve, and provide
15direction for the center’s programs and shall ensure that all
16ratepayer moneys remitted by the utilities board pursuant to
17Code section 476.10A are used on programs designed to provide
18benefits to gas and electric utility ratepayers. The board
19must also oversee the center in the development of a budget
20and other matters and approve the center’s annual budget. The
21bill excludes provisions relating to the appointment of a
22director as contained in current Code section 266.39C. The
23bill requires the center to employ necessary support staff
24and prepare an annual report in coordination with the EDA and
25submit the report to the general assembly and the legislative
26services agency.
   27The bill makes conforming changes throughout the Code by
28replacing references to Code section 266.39C with Code section
2915.120, and provides transition provisions.
   30The division of the bill related to the Iowa energy center
31takes effect October 1, 2017. The division provides for the
32repeal of the Code section establishing the Iowa energy center,
33effective July 1, 2022, and includes additional conforming
34provisions.
