House Study Bill 204 - IntroducedA Bill ForAn Act 1relating to and making appropriations to state

5fund, providing for related matters, and including effective

7BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1DIVISION I
2REBUILD IOWA INFRASTRUCTURE FUND
3   Section 1.  REBUILD IOWA INFRASTRUCTURE FUND —
4APPROPRIATIONS.
  There is appropriated from the rebuild Iowa
5infrastructure fund to the following departments and agencies
6for the fiscal year beginning July 1, 2017, and ending June
730, 2018, the following amounts, or so much thereof as is
8necessary, to be used for the purposes designated:
   91.  DEPARTMENT OF ADMINISTRATIVE SERVICES
   10For major maintenance projects:

   12Of the moneys appropriated in this subsection, the
13department shall expend such amount as is necessary for the
14repair of elevators in facilities on the state capitol complex.
   152.  DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP
   16a.  (1)  For deposit in the water quality initiative fund
17created in section 466B.45 for purposes of supporting the
18water quality initiative administered by the division of soil
19conservation and water quality as provided in section 466B.42,
20including salaries, support, maintenance, and miscellaneous
21purposes, notwithstanding section 8.57, subsection 5, paragraph
22“c”:

   24(2)  (a)  The moneys appropriated in this lettered
25paragraph shall be used to support demonstration projects in
26subwatersheds as designated by the department that are part
27of high-priority watersheds identified by the water resources
28coordinating council.
   29(b)  The moneys appropriated in this lettered paragraph
30shall be used to support demonstration projects in watersheds
31generally, including regional watersheds, as designated by the
32division and high-priority watersheds identified by the water
33resources coordinating council.
   34(c)  Of the moneys appropriated in this lettered paragraph
35for each fiscal year, $225,000 is allocated to the Iowa
-1-1nutrient research center at Iowa state university of science
2and technology for nutrient water monitoring network technology
3and equipment. Of the moneys allocated in this subparagraph
4division, not more than $150,000 may be used for the operations
5and maintenance of the nutrient water monitoring network.
   6(3)  In supporting projects in watersheds and subwatersheds
7as provided in subparagraph (2), subparagraph divisions (a) and
8(b), all of the following shall apply:
   9(a)  The demonstration projects shall utilize water quality
10practices as described in the latest revision of the document
11entitled “Iowa Nutrient Reduction Strategy” initially presented
12in November 2012 by the department of agriculture and land
13stewardship, the department of natural resources, and Iowa
14state university of science and technology.
   15(b)  The division shall implement demonstration projects
16as provided in subparagraph division (a) by providing
17for participation by persons who hold a legal interest in
18agricultural land used in farming. To every extent practical,
19the division shall provide for collaborative participation by
20such persons who hold a legal interest in agricultural land
21located within the same subwatershed.
   22(c)  The division shall implement demonstration projects on
23a cost-share basis as determined by the division. However, the
24state’s share of the amount shall not exceed 50 percent of the
25estimated cost of establishing the practice as determined by
26the division or 50 percent of the actual cost of establishing
27the practice, whichever is less.
   28(d)  The demonstration projects shall be used to educate
29other persons about the feasibility and value of establishing
30similar water quality practices. The division shall promote
31field day events for purposes of allowing interested persons to
32establish water quality practices on their agricultural land.
   33(e)  The division shall conduct water quality evaluations
34within supported subwatersheds. Within a reasonable period
35after accumulating information from such evaluations, the
-2-1division shall create an aggregated database of water quality
2practices. Any information identifying a person holding a
3legal interest in agricultural land or specific agricultural
4land shall be a confidential record.
   5(4)  The moneys appropriated in this lettered paragraph
6shall be used to support education and outreach in a manner
7that encourages persons who hold a legal interest in
8agricultural land used for farming to implement water quality
9practices, including the establishment of such practices in
10watersheds generally, and not limited to subwatersheds or
11high-priority watersheds.
   12(5)  The moneys appropriated in this lettered paragraph
13may be used to contract with persons to coordinate the
14implementation of efforts provided in this paragraph.
   15(6)  The moneys appropriated in this lettered paragraph
16may be used by the department to support urban soil and water
17conservation efforts, which may include but are not limited
18to management practices related to bioretention, landscaping,
19the use of permeable or pervious pavement, and soil quality
20restoration. The moneys shall be allocated on a cost-share
21basis as provided in chapter 161A.
   22(7)  Notwithstanding any other provision of law to the
23contrary, the department may use moneys appropriated in
24this lettered paragraph to carry out the provisions of this
25paragraph on a cost-share basis in combination with other
26moneys available to the department from a state or federal
27source.
   28(8)  Not more than 10 percent of the moneys appropriated in
29this lettered paragraph may be used for costs of administration
30and implementation of the water quality initiative administered
31by the soil conservation division.
   32b.  For deposit in the agricultural drainage well water
33quality assistance fund created in section 460.303 for
34purposes of supporting the agricultural drainage well water
35quality assistance program as provided in section 460.304,

28ends three years after the end of the fiscal year for which the
29appropriation is made. However, if the project or projects for
30which such appropriation was made are completed in an earlier
31fiscal year, unencumbered or unobligated moneys shall revert at

27DIVISION V
28MISCELLANEOUS PROVISIONS
29   Sec. 15.  Section 8.57, subsection 5, paragraph c, Code 2017,
30is amended to read as follows:
   31c.  Moneys in the rebuild Iowa infrastructure fund in a
32fiscal year shall be used as directed by the general assembly
33for public vertical infrastructure projects. For the purposes
34of this subsection, “vertical infrastructure” includes only land
35acquisition and construction; major renovation and major repair
-13-1of buildings; routine, recurring maintenance; all appurtenant
2structures; utilities; site development; recreational trails;
 3renewable fuel infrastructure programs; and debt service
4payments on academic revenue bonds issued in accordance
5with chapter 262A for capital projects at board of regents
6institutions. “Vertical infrastructure” does not include
7operational expenses or leasing of a building, appurtenant
8structure, or utility without a lease-purchase agreement.
9   Sec. 16.  Section 8.57C, subsection 3, paragraph a,
10subparagraph (2), Code 2017, is amended to read as follows:
   11(2)  The fiscal year beginning July 1, 2017 2018, and for
12each subsequent fiscal year thereafter.
13   Sec. 17.  Section 8.57C, subsection 3, Code 2017, is amended
14by adding the following new paragraph:
15   NEW PARAGRAPH.  f.  There is appropriated from the rebuild
16Iowa infrastructure fund for the fiscal year beginning July 1,
172017, and ending June 30, 2018, the sum of ten million dollars
18to the technology reinvestment fund, notwithstanding section
198.57, subsection 5, paragraph “c”.
20   Sec. 18.  Section 12.88, Code 2017, is amended by adding the
21following new subsection:
22   NEW SUBSECTION.  6.  For the fiscal year beginning July 1,
232017, any unobligated and unencumbered moneys in the fund from
24the previous fiscal year are appropriated to the department of
25administrative services for major maintenance projects.
26EXPLANATION
27The inclusion of this explanation does not constitute agreement with
28the explanation’s substance by the members of the general assembly.
   29This bill relates to and makes appropriations to state
30departments and agencies from the rebuild Iowa infrastructure
31fund and the revenue bonds capitals fund, and provides for
32related matters. The bill is organized by divisions.
   33DIVISION I — REBUILD IOWA INFRASTRUCTURE FUND. This
34division appropriates project funding for FY 2017-2018 from
35the rebuild Iowa infrastructure fund for projects for the
-14-1departments of administrative services, agriculture and land
2stewardship, the blind, cultural affairs, human rights, human
3services, natural resources, public defense, public safety, and
4transportation, and for the economic development authority,
5treasurer of state, and the board of regents.
   6DIVISION II — TECHNOLOGY REINVESTMENT FUND. This division
7appropriates project funding for FY 2017-2018 from the
8technology reinvestment fund for the departments of education,
9human rights, human services, management, public health, public
10safety, and homeland security and emergency management, and
11for the office of the chief information officer and the state
12public defender.
   13DIVISION III — MISCELLANEOUS APPROPRIATIONS. This division
14appropriates project funding for FY 2016-2017 from the revenue
15bonds capitals fund to the department of administrative
16services for major maintenance projects and for FY 2017-2018
17from the state bond repayment fund for the state board of
18regents for tuition replacement. This division takes effect
19upon enactment.
   20DIVISION IV — CHANGES TO PRIOR APPROPRIATIONS. This
21division makes a change to moneys appropriated from the
22rebuild Iowa infrastructure fund to the board of regents for
23a project at the state university of Iowa and projects at
24the Iowa state university of science and technology for FY
252017-2018 and FY 2021-2022. The division also makes a change
26to moneys appropriated from the state bond repayment fund to
27the department of administrative services for repair of the
28dome of the Iowa state capitol for FY 2016-2017 to authorize
29expenditure of moneys remaining upon completion of repairs to
30the dome for maintenance projects for the Iowa state capitol
31and the Ola Babcock Miller building. This provision takes
32effect upon enactment.
   33This division also makes a change to moneys appropriated
34from the rebuild Iowa infrastructure fund to the department of
35administrative services for major maintenance projects for FY
-15-12016-2017. This provision takes effect upon enactment.
   2This division also makes a change in moneys appropriated
3from the rebuild Iowa infrastructure fund to the state fair
4authority for FY 2017-2018.
   5DIVISION V — MISCELLANEOUS PROVISIONS. Code section 8.57,
6concerning the rebuild Iowa infrastructure fund, is amended
7to provide that the definition of “vertical infrastructure”
8specifically includes renewable fuel infrastructure programs.
9Code section 8.57C, concerning the technology reinvestment
10fund, is amended to provide that the appropriation to the
11fund from the general fund for fiscal years beginning on or
12after July 1, 2017, is changed to fiscal years beginning on
13or after July 1, 2018, and to provide for an appropriation to
14the fund from the rebuild Iowa infrastructure fund for the
15fiscal year beginning July 1, 2017, of $10 million. Code
16section 12.88, concerning the revenue bonds capitals fund, is
17amended to provide that for FY 2017-2018, any unobligated and
18unencumbered moneys in the fund from the previous fiscal year
19are appropriated to the department of administrative services
20for major maintenance projects.
