Senate File 467 - ReprintedA Bill ForAn Act 1relating to restrictions on the receipt by certain
2felons of certain insurance proceeds and other benefits.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 633.535, Code 2017, is amended by adding
2the following new subsection:
3   NEW SUBSECTION.  4.  a.  A named beneficiary of a bond
4or life insurance policy
   convicted of a felony referenced
5in paragraph “d” that was perpetrated against the principal
6obligee or person upon whose life the policy is issued or whose
7death generates the benefits, in the six months immediately
8prior to the obligee’s or person’s death, is not entitled to
9any benefit under the bond or policy.
   10b.  The procedure set out in section 633.536 applies and
11the benefits become payable as though the convicted obligee or
12person had predeceased the decedent.
   13c.  However, a principal obligee or person upon whose life
14the policy is issued or whose death generates the benefits, in
15the six months immediately prior to the obligee’s or person’s
16death, may affirm by a signed, notarized affidavit that the
17beneficiary should receive any benefit under the bond or policy
18despite a felony conviction referenced in this subsection.
   19d.  This subsection applies to a conviction for any of the
20following felonies:
   21(1)  Any felony contained in chapter 707.
   22(2)  Any felony contained in chapter 708.
   23(3)  Any felony contained in chapter 709.
   24(4)  Any felony contained in chapter 710.
   25(5)  Any felony contained in chapter 710A.
