3subdivisions, and including retroactive applicability
4provisions.
5BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 103A.8A, Code 2017, is amended to read
2as follows:
   3103A.8A  Energy conservation requirements.
   41.  The state building code commissioner shall adopt as
5a part of the state building code a requirement that new
6single-family or two-family residential construction shall
7comply with energy conservation requirements. The requirements
8adopted by the commissioner shall be based upon a nationally
9recognized standard or code for energy conservation. The
10requirements shall only apply to single-family or two-family
11residential construction commenced after the adoption of
12the requirements. Notwithstanding any other provision
13of this chapter to the contrary, the energy conservation
14requirements adopted by the commissioner and approved by
15the council shall apply to new single-family or two-family
16residential construction commenced on or after July 1, 2008,
17and shall supersede and replace any minimum requirements for
18energy conservation adopted or enacted by a governmental
19subdivision prior to that date applicable to such construction
20
 to all single-family or two-family residential construction
21commenced on or after July 1, 2010
. The state building code
22commissioner may provide training to builders, contractors, and
23other interested persons on the adopted energy conservation
24requirements.
   252.  If a governmental subdivision has adopted minimum
26energy conservation requirements applicable to residential
27construction described in subsection 1 that are not less
28restrictive than the minimum energy conservation requirements
29provided in the international energy conservation code, 2009
30edition, then such residential construction shall comply
31with the energy conservation requirements adopted by the
32governmental subdivision in lieu of the energy conservation
33requirements adopted by the commissioner.
34   Sec. 2.  Section 103A.10, subsection 5, Code 2017, is amended
35by striking the subsection.

1   Sec. 3.  RETROACTIVE APPLICABILITY.  This Act applies
2retroactively to July 1, 2010.
3EXPLANATION
4The inclusion of this explanation does not constitute agreement with
5the explanation’s substance by the members of the general assembly.
   6This bill relates to energy conservation requirements
7contained within the state building code or adopted by
8governmental subdivisions.
   9Code chapter 103A requires new single-family or two-family
10residential construction commenced on or after July 1, 2008,
11to comply with energy conservation requirements adopted by
12the state building code commissioner. “New construction”, as
13defined in the Code chapter, is expressly made inapplicable
14to building renovations and repairs. The energy conservation
15requirements adopted by the state building code commissioner
16supersede and replace any minimum energy conservation
17requirements adopted by a governmental subdivision.
   18The bill amends Code section 103A.8A to provide that all
19single-family or two-family residential construction on or
20after July 1, 2010, shall comply with the energy conservation
21requirements, extending the requirements to existing residence
22renovations and repairs.
   23The bill removes the language from Code section 103A.8A that
24provides that the energy conservation requirements adopted
25by the state building code commissioner are to supersede any
26minimum requirements adopted by a governmental subdivision.
27The bill makes conforming changes consistent with this
28modification by striking Code section 103A.10(5).
   29The bill provides that if a governmental subdivision adopts
30minimum energy conservation requirements that are not less
31restrictive than the 2009 edition of the international energy
32conservation code, then applicable residential construction
33must comply with the energy conservation requirements
34adopted by the governmental subdivision in lieu of the energy
35conservation requirements adopted by the commissioner.
