Senate Study Bill 1174 - IntroducedA Bill ForAn Act 1relating to the commercial and noncommercial harvest of
2turtles, including effective date provisions.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 481A.67, subsections 2 and 3, Code 2017,
2are amended to read as follows:
   32.  Notwithstanding any provision of law to the contrary,
4the natural resource commission shall adopt rules pursuant to
5chapter 17A establishing seasons and daily catch limits for the
6noncommercial harvest of turtles in any waters of the state
7pursuant to section 483A.28. Seasons established pursuant to
8this subsection shall not apply to the noncommercial harvest of
9snapping turtles. The commission shall adopt rules providing
10that beginning on June 15, 2018, the annual season for the
11noncommercial harvest of turtles shall begin on June 15 and end
12on May 15.

   133.  Notwithstanding any provision of law to the contrary,
14the natural resource commission shall adopt rules pursuant to
15chapter 17A establishing seasons and daily catch limits for
16the commercial harvest of turtles in any waters of the state.
 17The commission shall adopt rules providing that beginning on
18June 15, 2018, the annual season for the commercial harvest of
19turtles shall begin on June 15 and end on May 15, and the annual
20possession limit for the commercial harvest of turtles shall be
21three thousand five hundred turtles for a person who is legally
22licensed to harvest commercial turtles.

23   Sec. 2.  RESCISSION OF AMENDMENTS TO ADMINISTRATIVE RULES.
   241.  The amendments to 571 Iowa administrative code,
25chapter 86, as appearing in ARC 2951C, as published in the
26Iowa administrative bulletin, volume XXXIX, number 17, dated
27February 15, 2017, pp.1685-1687, are rescinded.
   282.  As soon as practicable, the Iowa administrative code
29editor shall restore the language of the Iowa administrative
30code chapter referenced in subsection 1 of this section to the
31language that existed on February 14, 2017.
32   Sec. 3.  EFFECTIVE UPON ENACTMENT.  This Act, being deemed of
33immediate importance, takes effect upon enactment.
34EXPLANATION
35The inclusion of this explanation does not constitute agreement with

   2This bill relates to the noncommercial and commercial
3harvest of turtles.
   4The bill requires the natural resource commission to adopt
5rules providing that beginning on June 15, 2018, the annual
6season for the noncommercial and commercial harvest of turtles
7shall begin on June 15 and end May 15.
   8The bill also requires the commission to adopt rules
9providing that the annual possession limit for the commercial
10harvest of turtles is 3,500 turtles for a person who is legally
11licensed to harvest commercial turtles.
   12The bill rescinds amendments to specified rules relating
13to harvesting commercial and noncommercial turtles that were
14published in the Iowa administrative code on February 15, 2017,
15and directs the Iowa administrative code editor to restore the
16language of the Iowa administrative code to the language that
17existed on February 14, 2017.
   18The bill is effective upon enactment.
