4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 483A.1, Code 2017, is amended to read as
2follows:
   3483A.1  Licenses — fees.
   4Except as otherwise provided in this chapter, a person
5shall not fish, trap, hunt, pursue, catch, kill, take in any
6manner, use, have possession of, sell, or transport all or a
7part of any wild animal, bird, game, or fish, the protection
8and regulation of which is desirable for the conservation of
9resources of the state, without first obtaining a license for
10that purpose and the payment of a fee as follows:

20   Sec. 2.  NEW SECTION.  483A.1B  License fees — periodic
21evaluation.
   221.  The license fees established in section 483A.1 shall be
23periodically evaluated by the department, but not less often
24than once every three years to ensure that the fees paid are
25sufficient to meet the needs of natural resource management and
26the public.
   272.  By December 15 of each year that an evaluation of the
28license fees is completed, the department shall file a written
29report with the commission which shall include the findings of
30the evaluation and recommendations, if any.
31   Sec. 3.  Section 483A.3, subsection 1, paragraphs c and d,
32Code 2017, are amended to read as follows:
   33c.  Eleven Fifteen dollars of the fee paid for each resident
34or nonresident hunting or fur harvester license that includes
35the wildlife habitat fee and twenty dollars of the fee paid for
-5-1each nonresident hunting or fur harvester license that includes
2the wildlife habitat fee
shall be designated as a wildlife
3habitat fee.
   4d.  All wildlife habitat fees shall be administered in
5the same manner as hunting and fur harvester licenses except
6all revenue derived from wildlife habitat fees shall be used
7within the state of Iowa for habitat development and shall be
8deposited in the state fish and game protection fund, except
9as provided in subsection 2. The revenue may be used for
10the matching of federal funds. The revenues and any matched
11federal funds shall be used for acquisition of land, leasing of
12land, or obtaining of easements from willing sellers for use
13as wildlife habitats. Notwithstanding the exemption provided
14by section 427.1, any land acquired with the revenues and
15matched federal funds shall be subject to the full consolidated
16levy of property taxes, which shall be paid from those the
17income generated from those lands or, if no such income is
18generated, from the wildlife habitat fee
revenues. In addition
19the revenue may be used for the development and enhancement of
20wildlife lands and habitat areas.
21   Sec. 4.  Section 483A.3, subsection 3, Code 2017, is amended
22to read as follows:
   233.  Notwithstanding subsections 1 and 2, any increase in
24wildlife habitat fee revenues received on or after July 1,
252007, pursuant to this section as a result of wildlife habitat
26fee increases pursuant to 2007 Iowa Acts, ch.194,
 five dollars
27from each wildlife habitat fee paid by a resident and eight
28dollars from each wildlife habitat fee paid by a nonresident

29 shall be used by the commission only for the purpose of the
30game bird habitat development program programs as provided
31in section 483A.3B. The commission shall not reduce on an
32annual basis for these purposes the amount of other funds being
33expended as of July 1, 2007.

34   Sec. 5.  Section 483A.3B, subsection 1, Code 2017, is amended
35to read as follows:
-6-   11.  Allocation of revenue — accounts.  All revenue collected
2from increases in wildlife habitat fees as provided in section
3483A.3, subsection 3, that is deposited in the state fish and
4game protection fund shall be allocated as follows:
   5a.  Two Three dollars of each resident wildlife habitat
6fee and five dollars of each nonresident wildlife habitat
7fee
collected shall be allocated to the game bird wetlands
8conservation account.
   9b.  One dollar Two dollars of each resident wildlife habitat
10fee and three dollars of each nonresident wildlife habitat fee
11 collected shall be allocated to the game bird buffer strip
12assistance account.
   13c.  Notwithstanding section 12C.7, subsection 2, interest or
14earnings on moneys collected from wildlife habitat fees that
15are deposited in each account created under this section shall
16be credited to that account. Notwithstanding section 8.33 or
17section 456A.17, moneys credited to each account created under
18this section shall not revert to the state general fund at the
19close of a fiscal year.
   20d.  All revenue generated by increases in the collected
21from
wildlife habitat fee fees as provided in section 483A.3,
22subsection 3, shall be used as provided in this section, except
23for that part which is specified by the department for use in
24paying administrative expenses as provided in section 456A.17.
25   Sec. 6.  NEW SECTION.  483A.6B  Nonresident five-day hunting
26license — fee.
   271.  A nonresident may be issued a five-day hunting license
28that costs ninety-five dollars, including the wildlife habitat
29fee. A nonresident hunting with a license issued under this
30section shall be otherwise qualified to hunt in this state.
   312.  This section is repealed on December 15, 2020.
32   Sec. 7.  Section 483A.7, subsection 3, paragraph a, Code
332017, is amended to read as follows:
   34a.  A nonresident wild turkey hunter is required to purchase
35a nonresident annual hunting license that includes the wildlife
-7-1habitat fee and a nonresident wild turkey hunting license. The
2commission shall annually limit to two thousand three hundred
3licenses the number of nonresidents allowed to have wild turkey
4hunting licenses. Of the two thousand three hundred licenses,
5one hundred fifty licenses shall be valid for hunting with
6muzzle loading shotguns only. The commission shall allocate
7the nonresident wild turkey hunting licenses issued among the
8zones based on the populations of wild turkey. A nonresident
9applying for a wild turkey hunting license must exhibit proof
10of having successfully completed a hunter education program as
11provided in section 483A.27 or its equivalent as determined by
12the department before the license is issued.
13   Sec. 8.  Section 483A.8, subsection 3, paragraph a, Code
142017, is amended to read as follows:
   15a.  A nonresident hunting deer is required to purchase
16a nonresident annual hunting license that includes the
17wildlife habitat fee and a nonresident deer hunting license.
18In addition, a nonresident who purchases a deer hunting
19license shall pay a one dollar fee that shall be used and
20is appropriated for the purpose of deer herd population
21management, including assisting with the cost of processing
22deer donated to the help us stop hunger program administered
23by the commission.
24   Sec. 9.  Section 483A.8, subsection 4, Code 2017, is amended
25to read as follows:
   264.  The commission may provide, by rule, for the issuance
27of an additional antlerless deer hunting license to a person
28who has been issued an antlerless deer hunting license. The
29rules shall specify the number of additional antlerless deer
30hunting licenses which may be issued, and the season and zone
31in which the license is valid. The fee for an additional
32antlerless deer hunting license shall be ten seventeen dollars
33for residents.
34   Sec. 10.  Section 483A.8, subsection 6, Code 2017, is amended
35to read as follows:
-8-   16.  The commission shall provide by rule for the annual
2issuance to a nonresident of a nonresident antlerless deer
3hunting license that is valid for use only during the period
4beginning on December 24 and ending at sunset on January 2 of
5the following year and costs seventy-five one hundred dollars.
6A nonresident hunting deer with a license issued under this
7subsection shall be otherwise qualified to hunt deer in this
8state and shall purchase a nonresident annual hunting license
9that includes the wildlife habitat fee, and pay the one dollar
10fee for the purpose of deer herd population management as
11provided in subsection 3. Pursuant to this subsection, the
12commission shall make available for issuance only the remaining
13nonresident antlerless deer hunting licenses allocated under
14subsection 3 that have not yet been issued for the current
15year’s nonresident antlerless deer hunting seasons.
16   Sec. 11.  Section 483A.24, subsection 3, paragraph a, Code
172017, is amended to read as follows:
   18a.  Fifty of the nonresident deer hunting licenses shall be
19allocated as requested by a majority of a committee consisting
20of the majority leader of the senate, speaker of the house
21of representatives, and director of the economic development
22authority, or their designees. The licenses provided pursuant
23to this subsection shall be in addition to the number of
24nonresident licenses authorized pursuant to section 483A.8.
25The purpose of the special nonresident licenses is to allow
26state officials and local development groups to promote the
27state and its natural resources to nonresident guests and
28dignitaries. Photographs, videotapes, or any other form
29of media resulting from the hunting visitation shall not
30be used for political campaign purposes. The nonresident
31licenses shall be issued without application upon purchase of a
32nonresident annual hunting license that includes the wildlife
33habitat fee and the purchase of a nonresident deer hunting
34license. The licenses are valid in all zones open to deer
35hunting. The hunter education certificate requirement pursuant
-9-1to section 483A.27 is waived for a nonresident issued a license
2pursuant to this subsection.
3   Sec. 12.  Section 483A.24, subsection 4, paragraph a, Code
42017, is amended to read as follows:
   5a.  Fifty of the nonresident wild turkey hunting licenses
6shall be allocated as requested by a majority of a committee

8the house of representatives, and director of the economic
9development authority, or their designees. The licenses
10provided pursuant to this subsection shall be in addition

18The nonresident licenses shall be issued without application
19upon purchase of a nonresident annual hunting license that
20includes the wildlife habitat fee and the purchase of a
21nonresident wild turkey hunting license. The licenses are
22valid in all zones open to wild turkey hunting. The hunter
23education certificate requirement pursuant to section 483A.27
24is waived for a nonresident issued a license pursuant to this
25subsection.
26   Sec. 13.  EFFECTIVE DATE.  This Act takes effect December 15,
272017.
28EXPLANATION
29The inclusion of this explanation does not constitute agreement with
30the explanation’s substance by the members of the general assembly.
   31This bill increases certain fees and reallocates certain
32revenues related to hunting, fishing, and fur harvesting.
   33The bill increases most fees for resident and nonresident
34fishing, hunting, and fur harvester licenses. The bill
35requires the department of natural resources to evaluate the
-10-1license fees at least every three years and report the results
2of that evaluation to the natural resource commission by
3December 15 of each year that an evaluation is made. The bill
4also includes a new five-day nonresident adult hunting license,
5including the wildlife habitat fee, that costs $95 and is
6available for issuance for three years. The bill provides that
7a nonresident who purchases a hunting license in conjunction
8with a deer or turkey hunting license must purchase an annual
9hunting license.
   10The bill also increases the wildlife habitat fee for
11residents and nonresidents from $11 to $15 for residents and
12$20 for nonresidents. The bill amends Code section 483A.3(1)
13to provide that the income generated from land acquired with
14revenues from wildlife habitat fees and matched federal funds
15shall be used to pay property taxes on that land, and if no
16income is generated, wildlife habitat fee revenue shall be used
17to pay the taxes. Currently, the taxes are paid only with
18wildlife habitat fee revenues.
   19The bill amends Code section 483A.3(3) to provide that
20$5 from each resident wildlife habitat fee paid and $8 from
21each nonresident wildlife habitat fee paid shall be used by
22the natural resource commission only for the purpose of game
23bird habitat development programs. Currently, the increase
24in wildlife habitat fee revenues received as a result of an
25increase in the resident and nonresident wildlife habitat fees
26in 2007 from $8 to $11, can be used by the commission for the
27purpose of those programs.
   28The bill amends Code section 483A.3B to provide that all
29revenue collected from wildlife habitat fees, not just the
30increase in fees since 2007, shall be allocated to game bird
31habitat development programs.
   32The bill provides that $3 of each resident wildlife habitat
33fee and $5 of each nonresident fee collected shall be allocated
34to the game bird wetlands conservation account. Currently, $2
35of each resident and nonresident fee collected is allocated to

   2The bill also provides that $2 of each resident fee and $3 of
3each nonresident fee collected shall be allocated to the game
4bird buffer strip assistance account. Currently, $1 of each
5resident and nonresident fee collected is allocated to that
6account.
   7The bill takes effect December 15, 2017.
