3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 262.9, subsection 17, Code 2017, is
2amended by adding the following new paragraph:
3   NEW PARAGRAPH.  c.  Adopt rules establishing that for an
4individual to be classified as a resident for purposes of
5in-state tuition and mandatory fees, the individual, except as
6otherwise provided under this subsection, shall have resided in
7this state for at least thirty consecutive months immediately
8prior to enrollment in an institution of higher learning
9governed by the board.
10EXPLANATION
11The inclusion of this explanation does not constitute agreement with
12the explanation’s substance by the members of the general assembly.
   13This bill directs the state board of regents to adopt rules
14to establish that for an individual to be classified as a
15resident for purposes of in-state tuition and mandatory fees,
16the individual must have resided in Iowa for 30 consecutive
17months immediately prior to their enrollment in a regents
18university.
   19Currently, the board may, at its discretion, adopt rules
20relating to the residency of students, for fee purposes, who
21are also residents of Iowa’s sister states. The board is
22directed to adopt rules to classify as residents, for purposes
23of undergraduate tuition and mandatory fees, qualified veterans
24and qualified military persons and their spouses and dependent
25children who are domiciled in this state while enrolled in a
26regents university. These current statutory provisions are
27exempted from the residency requirement established by the
28bill.
