4enrollment.
5BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 282.18, subsection 8, Code 2017, is
2amended to read as follows:
   38.  If a request filed under this section is for a child
4requiring special education under chapter 256B, the request to
5transfer to the other district shall only be granted if the
6receiving district maintains a special education instructional
7program which is appropriate to meet the child’s educational
8needs and the enrollment of the child in the receiving
9district’s program would not cause the size of the class in
10that special education instructional program in the receiving
11district to exceed the maximum class size in rules adopted by
12the state board of education for that program. For children
13requiring special education, the board of directors of the
14district of residence shall promptly provide all reasonable
15assistance in completing forms necessary in order for the
16receiving district to receive medical assistance reimbursement
17for services the receiving district provides in accordance
18with the student’s individualized education program, and shall

19 pay to the receiving district the actual costs incurred in
20providing the appropriate special education.
21EXPLANATION
22The inclusion of this explanation does not constitute agreement with
23the explanation’s substance by the members of the general assembly.
   24This bill requires the school district of residence to
25promptly assist the receiving district in completing Medicaid
26reimbursement forms that the receiving district must submit in
27order to receive reimbursement for special education services
28that it provides to a child who requires special education and
29is participating in open enrollment.
