Senate Study Bill 1112 - IntroducedA Bill ForAn Act 1providing for the confidentiality of certain records
2provided by gambling licensees to the racing and gaming
3commission.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 99D.19, Code 2017, is amended by adding
2the following new subsection:
3   NEW SUBSECTION.  3.  The records of the commission shall be
4governed by the provisions of chapter 22, provided that, in
5addition to records that may be kept confidential pursuant to
6section 22.7, the following records provided by a licensee to
7the commission shall be kept confidential, unless otherwise
8ordered by a court, by the lawful custodian of the records, or
9by another person duly authorized to release such information:
   10a.  Promotional play receipts records.
   11b.  Patron and customer records.
   12c.  Surveillance records.
   13d.  Security reports and network audits.
   14e.  Internal control records.
   15f.  Employee records.
   16g.  Any audit information and records, except for those books
17and records as described in subsection 1 of this section, that
18are obtained by the commission in connection with the annual
19audit under section 99D.20.
20   Sec. 2.  Section 99F.12, subsection 3, Code 2017, is amended
21to read as follows:
   223.  The Except as provided in subsection 4, the books
23and records kept by a licensee as provided by this section
24are public records and the examination, publication, and
25dissemination of the books and records are governed by the
26provisions of chapter 22.
27   Sec. 3.  Section 99F.12, Code 2017, is amended by adding the
28following new subsection:
29   NEW SUBSECTION.  4.  The records of the commission shall be
30governed by the provisions of chapter 22, provided that, in
31addition to records that may be kept confidential pursuant to
32section 22.7, the following records provided by a licensee to
33the commission shall be kept confidential, unless otherwise
34ordered by a court, by the lawful custodian of the records, or
35by another person duly authorized to release such information:

   1a.  Promotional play receipts records.
   2b.  Patron and customer records.
   3c.  Surveillance records.
   4d.  Security reports and network audits.
   5e.  Internal control records.
   6f.  Employee records.
   7g.  Any audit information and records, except for those books
8and records as described in subsection 1 of this section, that
9are obtained by the commission in connection with the annual
10audit under section 99F.13.
11EXPLANATION
12The inclusion of this explanation does not constitute agreement with
13the explanation’s substance by the members of the general assembly.
   14This bill provides that certain records provided by a
15licensee under Code chapter 99D or 99F to the racing and gaming
16commission shall be kept confidential by the commission unless
17otherwise ordered by a court, by the lawful custodian of the
18records, or by another person duly authorized to release
19such information. The bill lists the records to be kept
20confidential as promotional play receipts records, patron and
21customer records, surveillance records, security reports and
22network audits, internal control records, employee records, and
23most audit information and records that are obtained by the
24commission in connection with the annual audit conducted under
25Code section 99D.20 or 99F.13, as applicable.
