4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  147.115  Notice regarding requests
2for personal information.
   3If a licensee requests a patient or client of the licensee
4to provide personal information unrelated to the treatment or
5provision of service to or billing of the patient or client,
6the licensee shall notify the patient or client that providing
7such information is not required for treatment or provision
8of service to or billing of the patient or client and shall
9state the purpose for collecting and the intended use of the
10information.
11EXPLANATION
12The inclusion of this explanation does not constitute agreement with
13the explanation’s substance by the members of the general assembly.
   14This bill requires a licensee of a health-related profession
15who requests a patient or client to provide personal
16information unrelated to the treatment or provision of service
17to or billing of the patient or client to notify the patient
18or client that providing that information is not required for
19treatment or provision of service to or billing of the patient
20or client and shall state the purpose for collecting and the
21intended use of the information.
   22A licensee, as used in the bill, refers to a physician
23and surgeon, podiatric physician, osteopathic physician and
24surgeon, physician assistant, psychologist, chiropractor,
25nurse, dentist, dental hygienist, dental assistant,
26optometrist, speech pathologist, audiologist, pharmacist,
27physical therapist, physical therapist assistant, occupational
28therapist, occupational therapy assistant, orthotist,
29prosthetist, pedorthist, respiratory care practitioner,
30practitioner of cosmetology arts and sciences, practitioner
31of barbering, funeral director, dietitian, marital and
32family therapist, mental health counselor, respiratory
33care and polysomnography practitioner, polysomnographic
34technologist, social worker, massage therapist, athletic
35trainer, acupuncturist, nursing home administrator, hearing aid
