House Study Bill 112 - IntroducedA Bill ForAn Act 1providing for the establishment of permanent emergency

3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 29C.8, Code 2017, is amended by adding
2the following new subsection:
3   NEW SUBSECTION.  6.  The director may establish permanent
4emergency personnel positions that are directly related to the
5governor’s proclamation of a state of disaster emergency or
6when the president of the United States has declared a major
7disaster to exist in this state. All such emergency personnel
8shall be exempt from the merit system described in chapter 8A,
9subchapter IV, and shall be excluded from collective bargaining
10as described in chapter 20. All such emergency personnel shall
11be classified, compensated, and eligible to receive benefits in
12accordance with chapter 8A, subchapter IV.
13EXPLANATION
14The inclusion of this explanation does not constitute agreement with
15the explanation’s substance by the members of the general assembly.
   16This bill provides that the director of the department
17of homeland security and emergency management may establish
18permanent emergency personnel positions that are directly
19related to the governor’s proclamation of a state of disaster
20emergency or when the president of the United States has
21declared a major disaster to exist in this state. The bill
22provides that all such emergency personnel shall be exempt
23from the merit system as provided in Code chapter 8A and
24excluded from collective bargaining under Code chapter 20. The
25bill further provides that such emergency personnel shall be
26classified, compensated, and eligible to receive benefits in
27accordance with Code chapter 8A.
