3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 542B.2, subsection 9, Code 2017, is
2amended by adding the following new paragraph:
3   NEW PARAGRAPH.  c.  Notwithstanding paragraphs “a” and “b”,
4a person shall not be construed to be engaged in the practice
5of engineering if the person establishes or constructs a soil
6and water conservation practice that does not require a permit
7from the department of natural resources. For purposes of
8this paragraph, a “soil and water conservation practice” means
9grassed waterways, terraces, water and sediment control basins,
10wetlands, tile and tile drainage systems, saturated buffers,
11and bioreactors designed to treat wastewater.
12EXPLANATION
13The inclusion of this explanation does not constitute agreement with
14the explanation’s substance by the members of the general assembly.
   15This bill provides that the establishment or construction
16of a soil and water conservation practice, as defined in the
17bill, shall not be construed as the practice of engineering, as
18that term is defined in current Code chapter 542B, relating to
19licensure of professional engineers and land surveyors.
