3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 152.1, subsection 7, paragraph e, Code
22017, is amended to read as follows:
   3e.  Make the pronouncement of death for a patient whose death
4is anticipated if the death occurs in a licensed hospital,
5a licensed health care facility, a correctional institution
6listed in section 904.102,
a Medicare-certified home health
7agency, a Medicare-certified hospice program or facility, an
8assisted living facility, or a residential care facility, with
9notice of the death to a physician, advanced registered nurse
10practitioner, or physician assistant.
11   Sec. 2.  Section 148C.4, subsection 1, Code 2017, is amended
12to read as follows:
   131.  A physician assistant may perform medical services
14when the services are rendered under the supervision of a
15physician. A physician assistant student may perform medical
16services when the services are rendered within the scope of an
17approved program. For the purposes of this section, “medical
18services when the services are rendered under the supervision
19of a physician”
includes making a pronouncement of death for
20a patient whose death is anticipated if the death occurs
21in a licensed hospital, a licensed health care facility,
 22a correctional institution listed in section 904.102, a
23Medicare-certified home health agency, or a Medicare-certified
24hospice program or facility, with notice of the death to a
25physician and in accordance with the directions of a physician.
26EXPLANATION
27The inclusion of this explanation does not constitute agreement with
28the explanation’s substance by the members of the general assembly.
   29This bill adds correctional institutions under the control
30of the department of corrections, as enumerated in Code section
31904.102, to the list of places where a nurse or a physician
32assistant may make a pronouncement of death for a patient
33whose death is anticipated. Currently, nurses and physician
34assistants working in these institutions must request a doctor
35to make pronouncements of death.
